The defense must have had him evaluated and did not get a diagnosis of autism. If they had that diagnosis, it would have been front and center of this dog and pony show. Frankly, it’s irrelevant in my mind. Autism does not cause someone to kidnap, assault and murder a 7 year old.

The Defense attorney in the BryanKohberger case was trying to lodge an exemption to the DP due to ASD, also sans an official diagnosis iirc, despite the fact that ASP is not a recognized exemption.

I see the same strategy here. They're going off an unsubstantiated diagnosis that showed up in TH's grade school records, probably coded in order to grant him maximum access to early intervention programs.

This specialist said she didn't evaluate him for ASD because reasons and also didn't evaluate him for mental illness.

IMO the Defense doesn't want him evaluated for ASD because if they lose the illusion of that diagnosis, they lose their defense. Same with mental health. No doubt TH has all kinds of deficits but he's not low IQ, he's not severely mentally ill, psychotic, schizophrenic, etc.

IMO what he is is a dangerous predator, sexually motivated by power and violence. Sadistic. They should test him for that. They wouldn't though because IMO it would confirm that he is energized by domination and violence, inextricably tied to sexual sadism.

And that can't be fixed, short of chemical castration and a lobotomy.

TH isn't part of any exempted class. In fact, he is exactly what the DP is for.

Agreed. The premeditation is a key element here. Often, people with neurodiverent disability may respond differently to a situation. Or do something on impulse.

But, when the element of premeditation is added here, that is the differentiation. Hmm, no one seems to explain this clinically. Imagine that. All of these "doctors" don't understand the DSM criteria for diagnosis?

They can't seem to find good tests for that.

IMO even if they could produce an actual diagnosis, it won't help when the jurors apply the law.

Autism is not an exempted class in TX iiuc.

I need the State to bring in a rebuttal witness to talk about deviant sexual.sadism.

so did police misinterpret poor Tanner when he told them about his having murdered Athena? how about when he told them about how she was so terrified that she soiled herself as he beat the life out of her? Did they misinterpret that?

I hate that this parade of apologists continues. How many more days will we and the jury have to listen to the poor poor Tanner show?

I hope the state asks this witness when he was diagnosed with Asperger's and how she knows he was. Has she seen the mystery report by the person (presumably a medical professional rather than a teacher or school counselor) who diagnosed him as such?
