had to take a call and we are on another break from streaming. Not sure why. But I feel like the defense is grasping at straws with this cross. Even if Tanner did nothing untoward at THIS delivery stop involving 7 and 10 year old girls, it doesn't negate the fact that the very next day he abducted, assaulted and murdered a 7 year old child.

Much like the "Did he resist or was he cooperative?" "was he respectful and courteous saying yes sir, no sir when you interviewed him?" questions, they mean nothing. He is still a monstrous human who stole the life of a child.

Am I right -- he abducted a child -- a little girl child -- in order to prove somehow that he was some kind of man?

Frustrated in life -- frustrated sexually -- so this?

I almost wonder if delivering Christmas presents as the holiday approached triggered him. Seeing all these children who were having better, more stable, more loving childhoods than he appears to have had, having to deliver all the packages to these better off than he was children, bringing them presents he never got as a child or better things, the resentment building, these kids get the things I didn't and am not able to get MY child, feeling less than a man, this monster who lives in a shed at the back of a family member's property, surrounded by his own filth, making him want to punish and hurt to hurt someone smaller, weaker, and yet more privileged than he himself.

It doesn't matter. It doesn't matter if he did 111 deliveries successfully, doesn't matter if he was polite, efficient, even overly polite, overly efficient, if one time, he steals a child. And subjects her to horrors our hearts can't handle imagining.

Deliver the package. And drive the hell away.

Kaylen Higgerman is now on the stand, she lived in Hazel TX in 2013. the witness is blurred - this would be the young girl he SA'd back then. Her appearance is being protected as a survivor of SA. She was born the product of rape and was living with her grandmother when she first started talking. He was in his Christian punk band at the time she met him.

I don't think that was it at all, at least not his motivation, but you are 100% right about this part -- wanting to punish and hurt someone smaller and weaker than him.

His job just have him access.

In June or July Tanner SA'd her. Then on August 11 2013 she was SA'd by him again.

Defense objects to State referring to this witness as "victim" judge upholds and has state rephrase. They use the term accuser rather than victim.

she was SA'd at his grandmother's house. They were drinking alcohol and smoking marijuana. Tanner had purchased the alcohol. She guesses she had drank enough to not be coherent. His grandmother was in her residence at the front of the property. She and Tanner were in his shed.

As obnoxious as they were, I'm glad the jury listened to his jail calls. It gives broad scope into TH as a person. He's not a victim, he doesn't have other personalities that pop up, he's not a vulnerable adult, he's capable of writing, speaking, organizing thoughts, lying, telling the truth, telling different stories to different people for different reasons.

It will fly in the face of whatever the Defense tries to present as mitigating.

She laid down to go to sleep and Tanner grabbed hold of her kissed her and proceeded to have sex with her. Did you tell him anything after this. She did not, she went home and showered. She told him she didn't want to have a sexual relationship with him, she felt grossed out. (again, she was a minor at this time)

They saw each other frequently as they hung in the same group of mutual friends. In August she was dropped off to hang out with Tanner and his friends at an apartment they intended to drink and smoke. She was invited by Tanner. They did drink and smoke and played drinking games.

She claims she was very intoxicated. at that time she was 16 years old . She had agreed she would spend the night (preagreed that she would be sleeping in Tanner's room) She awoke to him touching her in her vaginal area and he proceeded to have sex with her. She froze, she shut down and just let it happened. She felt violated, dirty and gross. Blamed herself. She had already told him after the last time she didn't want that with him. So she was upset because this time he KNEW. She was put off after that and would not engage with him, she was rude when he was around after that. Her friend Shayleigh Moore (sp?) is another victim and can attest to that OBJECTION - SIDEBAR

She her friend and Tanner had hung out before and attended a music festival where Tanner was playing. Shayleigh was introduced to tanner through this witness.
