I missed this earlier. So, there were questions about her earlier shooting? At least enough to send to the grand jury.

There is an excerpt of the police report at this link. The full report is online too. It seems cut and dried, a guy disobeyed verbal orders, he attacked them and grabbed one of their tasers and AG was forced to shoot him. In light of her latest shooting, who knows if it is all true.

Wondering if the same judge that refused to sign the warrant gave in or another judge signed it??

I’m going to hold my position that, moving forward, we will see this case handled transparently. We shall see.

I’m now going to go watch an hour of Mayberry RFD reruns to feel better about life.

Nine protesters were arrested for blocking an intersection. They had broken away from the other group at the time.

Sunday night’s protesters called on Cowboys owner Jerry Jones; quarterback Dak Prescott, who is black; and the rest of the organization to join them in the fight for justice. The protesters knelt and prayed.

Dak Prescott previously weighed in saying, “I’d never protest during the anthem, and I don’t think that’s the time or the venue to do so. The game of football has always brought me such peace, and I think it does the same for a lot of people.” Jerry Jones has said, “ Our policy is that you stand at the anthem, toe on the line."

In many criminal cases, the defendant or council are always trying to figure out what to say just in case that topic comes up. This is like a trial run with more than 12 jurors.

Sorry if this has already been asked and answered.
Someone *please* tell me this gun slinger is at minimum, on administrative leave while this is investigated? I would not feel safe knowing she was at large packing heat.

Amateur opinion and speculation only.
She is on administrative leave. Do they turn in all weapons and badges at the time of leave?

This occurs often here, on many case threads. I recall one unique case that, when it went to trial, defense lawyers used the exact arguments they used for years here on WS. Word for word. They still lost.

Usually, an officer that is on administrative leave, strips him or her of all police powers, badge, and service weapon pending the outcome of the investigation.

The DPD would not want to make a hasty decision. The defendant is also part of the union. The immediate termination could result in further civil cases although this time as the plaintiff.

I have also been wondering why she was carrying her vest, did she take it off before she left the station? I get that is hot and heavy to wear, but that seems odd to me, to take the vest off but not the uniform and weapon. Male officers I've know dressed at the station and left that stuff in their lockers. When they finished their shift they were off duty and in street clothes, but I don't know if that's the norm.

I'm going to guess that she may have took it off prior to arriving home. If you haven't lived in Texas before let me just tell you it's hotter than hell down here and the temperature doesn't discriminate at 10:00 pm either. Too bad we don't have any Facebook pages to go by, that may have atleast told us if she wears it over top or underneath most of them time.. I'm sure she has pictures of her in uniform.

Although the officer was charged with manslaughter, the DA reminded people that the grand jury will have final say over what charges she will face.

“The grand jury will decide if the charges should be different,” she said during a news conference Monday morning. “Believe me, we will make sure justice is done in this case.”

Here is some reality, the DA decides what charge the grand jury will sign a True Bill for and if the DA doesn't want her indicted for a murder charge, that grand jury will not sign any such True Bill.

A grand jury only finds probable cause and most state's grand juries today are owned and controlled by the criminal court and the DA. In some states the court hand picks the grand Jury Foreman who IS NOT elected by those allegedly selected randomly from the pool from which the foreman does not have to be included, with there being no requirement that the pool must be randomly selected via automation.

Now this Foreman, in some states is a surrogate to the DA by statute and can vote at his discretion. Typically, 12 panel members are to decide and the foreman can be the 13th panelist unless prohibited.

He arguably has great influence over the panel.

All it takes on a grand jury is one no vote for there to be no true bill and examples of 'found not guilty' by a grand jury are becoming more common. For this to continue and get even worse, all it takes is for the people to keep believing these institutions work how they ideally imagine they should and never verify they're not even close.

This being found "not guilty" by a grand jury for those in elevated positions, or may have dirt on those elevated, should be viewed with healthy skeptism. Many DA's don't even record the sessions which leaves everyone impaneled, including the Foremen, gagged by secrecy laws.

The DA there can certainly influence a panel to indict her for Murder 1, or even a higher charge if it were to exists, if the DA wants that.

One aspect of grand jury service is IF you go against what the DA wants you may find yourself targeted for politically motivated abuse. Never believe that the secrecy laws prevent the foreman from giving the DA and presiding judge a full accounting or casting either a deciding or denying vote depending on the agenda.

Heck, many courts have held they have no problem with panelists sitting in when they know of the person under presentment and they can even have bias towards and hostility against, or favor for, those whose alleged crimes are being presented before them.

Also becoming more envogue and accepted is impaneling of government employees even those from praetorian sections like LEO employees or their immediate families.

In many states, it is my opinion, as is all herein, that grand and petite (trial) juries can be stacked easier than breathing.

The test for change of venue has more than a dozen prongs and your question speaks quite directly to some of the most heavily weighted considerations for granting or denying venue change.

I foresee many showing up for jury duty in Dallas willing to say they have never heard anything about this in order to either convict or acquit her.

However, I don't foresee her standing trial in Dallas with the media saturation and excitement easily shown by defense.

so when this goes to trial what if one of us locals are called for jury duty after hashing this out on WS?

That's correct, all you have to say to be excused from any jury duty if selected to be interviewed is that you are familiar with the case and give a simple example supporting your statement. Or another way is to start forming opinions before even hearing the trial.

Like for an example, my friends and I were talking about this case at the health club, or on FB, or at the senior center during lunch.

Just an FYI about the self closing hinges - not in any way saying it was or wasn't open - but I am a hotel manager and we use a similar hinge - which we are currently in the process of changing them all out by the way. These hinges are great when they work properly but they are usually spring loaded and require proper adjustments to do so. Sometimes they are too tight and will cause the door to "slam" shut with a loud bang and sometimes they are too loose and won't close the door all the way. For most hotels that can create a security risk because the lock engages when the door is shut and guests don't often check the door to make sure it is shut because they expect it to work properly. I wouldn't think this would be the case here since the lock does not automatically engage as a hotel lock typically does and BJ's family has stated that it was his pattern to lock his door - just wanted to point out that though the vids from other tenants show the self closing hinges shutting their doors, it is possible that one or more in the complex might not be working properly so until someone shows a vid of that specific door closing on it's on, we really cannot conclude that it did or that it could not have been ajar from the vids we have seen.

That's why its important to keep countering false or slanted information that attempts to get sympathy for the killer and demonized the victim. Sometimes these campaigns seek to taint jury pools, influence public opinion and news media.
