I think that a routine blood test for alcohol levels can be determined pretty quickly. If alcohol was involved, that could be the reason that the Texas Rangers have slowed down the process.

The Texas laws are subject to interpretation, she can be charged with murder, manslaughter, or criminally negligent homicide. Looks like an enhancement charge may be indicated if she was intoxicated.

How wasted do you have to be to not recognize your own house??

The neighbor earwitness heard scuffling, loud footsteps (an altercation?) … then a gunshot. Ambient noise tells us, self-defense. It is imperative that the word of law enforcement take precedence over all others when it comes to crime investigation.

I find it absurd to give a free pass to anyone based on their profession, IMO- the TRUTH should take precedence when it comes to any investigation.

This promising young man was unjustly killed. I grieve for him, his family, and our society. I thought it sad enough for black men to be harassed for DWB. Are we now at a point where they get harassed for BWB? (breathing while black)

Let's imagine this scenario ended differently. If, being startled by someone trying to get in his door, Botham had shot the officer/intruder. Stand your ground or not, he'd have been arrested tout de suite IMO.

They need to stop faffing around because it just makes and already murky situation more suspicious.

This^^^. The murder happened Thursday night. They better file charges on Monday. The longer it goes, the worse it gets.

By Friday, Dallas PD knew this was a mess, and passed it on to Texas Rangers. The delay is understandable, but hasn't provided any details or clarity. Because they can't wrap this up by blaming the victim in any way.

Political dynamite here.

This should be a murder charge, not manslaughter...hope it is upgraded, if it hasn’t been. Ridiculous if she only spends a year or two in prison if at all.

I THINK if he had shot her when she was inside his apartment it would have been justifiable homicide/self defense. If police officers are executing a warrant and breaking in- it's different, but she was off duty and no official business.

I live in Texas and know a man who shot and killed at least one- maybe two- people who kicked his door in intending to rob him. He stood at the door when they kicked it in and killed them in the doorway. The man was not charged.

DALLAS (AP) — The lawyer for the family of a man who was gunned down at his home by a Dallas police officer is calling for her to be arrested and charged, saying the fact that she remains free days after the shooting shows she's receiving favorable treatment.

S. Lee Merritt, who is representing the family of 26-year-old Botham Jean, said Saturday that the family isn't calling on the authorities to jump to conclusions or to deny Officer Amber Guyger her right to due process. But Merritt, flanked by members of the family and Mothers Against Police Brutality, said they want Guyger "to be treated like every other citizen, and where there is evidence that they've committed a crime, that there's a warrant to be issued and an arrest to be made."

Police Chief U. Renee Hall said the day after the shooting that her department was seeking manslaughter charges against Guyger. But she said Saturday that the TexasRangers, who have taken over the investigation, asked her department to hold off because they had learned new information and wanted to investigate further before a warrant was issued.

That doesn't sound right to me. What would happen in case of a fire, when one isn't supposed to use the elevator, or simply if electricity is out?

Investigators are "working as vigorously and meticulously as we can to ensure the integrity of this case and ensure the integrity of the department is upheld," Hall said. The officer was off-duty at the time of the shooting and Hall said her name would be released if she's officially charged.

So, is she charged or not? I thought her name has been released.
She is not charged but they released the name, presumably because social media already had it out there.

Yea, I can't believe such a design is allowed. There are fire safety codes, how do you get out in case of a fire if the elevator is the only way to your apartment?

The doors all look the same, she could have been not paying attention to the mat. Just trying to get into what she believed was her apartment.

There is a new "spin" to the story. Not reported on MSM.

Apparently, the judge would not sign off on a Manslaughter charge, because he believed it was murder. The Dallas PD did not want to file that charge, and passed it to the Rangers. Apparently, they don't want to touch this mess, so it has not yet been assigned.

Completely believable series of events. Proverbial "Pass the Buck" syndrome. So common in government bureaucracy. CYA. And anyone associated with this needs to be of impeccable integrity, because testimony could be an issue at trial, if she doesn't accept a plea.

First social media put out. Then the Dallas Morning News publicly identified her. Hence the DPD had no choice but to comply. Politics as it is you know. And the walls come trickling and tumbling down.

I can't remember where I saw it, but a resident took a video of the emergency response from what looked like a staircase.

I don't think so, one of the residents is quoted they didn't even know that a cop lived in their building.
