An arrest affidavit prepared by a Texas Ranger was released Monday, providing a narrative of what happened. It appeared to be based almost entirely on the officer’s account.

Guyger told investigators that she had just ended a 15-hour shift Thursday when she returned in uniform to the South Side Flats apartment complex. She parked on the fourth floor, instead of the third, where she lived, according to the affidavit, possibly suggesting that she was confused or disoriented.

Authorities have not released any 911 tapes related to the shooting.

It was not clear who, if anyone, had been hired to represent the officer. Online court documents that would normally list a defendant’s attorney were not yet available.

She also forgot where the hell she parked. How could she forget that she parked on the 4th floor parking when she knew upon driving onto that parking garage floor that she would have to go down 1 flight in the elevator.
Forgive me if I am ignorant on this, but my son lived in an apartment building that had a parking garage a few floors. You park on the floor you live on and go through a secure door that leads to the apartment hallway where all the apartments are on that floor. You do not get in an elevator unless you have to go to an upper or lower floor to get to your apartment. (Or unless you come in off the street in the main entrance not the garage) So how did she end up getting on an elevator on the 4th floor that is on the forth floor? What was she doing in the damn elevator unless she knew she had to go a floor down and then all of a sudden have amnesia and not take the elevator down a floor and just step back out of the elevator still on the forth floor? I am confused about this whole murder.

Maybe the garage had a slanted deck with large floor numbers, so you could look up and see 3rd floor on the wall and miss that the other end of the deck had 4th floor painted on the wall, and get confused. This has happened to me before, but not because I had to make up a story about why I shot someone.

CNN affiliate KTVT obtained a copy of an arrest warrant affidavit from the Dallas County District Attorney's Office. Here's what it says:

  • Jean lived in apartment #1478, Guyger lives in #1378
  • Both apartments are identical or extremely similar in terms of floorplan, exterior surroundings, structure and description
  • Jean was home alone when Guyger, still in uniform after her shift, entered the apartment
  • Guyger parked her vehicle on the fourth floor, entered the building and walked toward what she thought was her apartment
  • She used her door key, which has an electronic chip, to try to enter the apartment
  • The door was slightly ajar when she approached it
  • The door opened under the force of the key insertion
  • The interior of the apartment was nearly completely dark
  • Guyger could make out a large silhouette across the room
  • She drew her weapon, believing there was an intruder in her apartment
  • Her verbal commands to Jean were ignored
  • Guyger fired two shots at Jean, striking him once in the torso
  • Guyger then entered the apartment, called 911 and started administering first aid to Jean
  • She turned on the lights while on the phone with 911, and when they asked for her address, she realized she was in the wrong apartment
  • She requested an ambulance and police to come to the apartment
  • Jean was transported to Baylor Hospital, where he died
  • Guyger remained at the scene and told officers and the 911 operator that she thought she was in her apartment when she shot Jean

B) Is nuts
C) Should never have been issued a taser or gun
D) All of the above

This beautiful man's family had better get full reparation for this reckless crime.

An investigator says a Dallas police officer who shot and killed her neighbor after mistaking his apartment for her own said that when she inserted her key in his door, it opened because it had been slightly ajar.

David Armstrong of the Texas Rangers wrote in an arrest affidavit released Monday that Officer Amber Guyger said it was nearly completely dark inside the apartment when she entered it Thursday night and she thought she was encountering a burglar in her home.

He says Guyger said the person ignored her verbal commands and she fired twice. One struck Jean in the chest and he later died.

The affidavit says Guyger was on the phone with 911 reporting the shooting when she turned on the apartment lights and discovered she was in the wrong apartment. It says Jean's apartment was the one right above Guyger's and the apartment layouts and exterior hallways were nearly identical.

What I find interesting is that she shoots him? And, she assumes there are not two or three burglars in the apartment as she turns on the light calling 911. If I thought there was an intruder in my apartment and shot one of them, why would I not be on alert for others, say in my bedroom or near the first room where I would then walk into a potential ambush? She still thinks she is in her apartment at this point. Some is not quite kosher here.

I just cannot understand how a cop can enter the wrong apartment and just shoot a man and then only gets charged with manslaughter!

That poor man. His poor family. This just breaks my heart! Unfortunately, I do not expect that lady to save one day in prison. Smdh.

Her story stinks to high heaven, imo. Even without the witnesses who report hearing "Let me in".

She gave “verbal commands” before firing her weapon twice, striking him once in the chest, the authorities said. The affidavit did not detail the nature of her commands, or how much time passed before shots were fired.

It’s unclear why Mr. Jean’s door was ajar. The authorities asked permission to examine Mr. Jean’s cellphone and laptop to see whether he may have been expecting a visitor, according to a search warrant affidavit.

On Monday, Ms. Johnson, the district attorney, hinted at a split over the handling of the case between her office and the Texas Rangers, the state’s top law enforcement agency. The Dallas Police Department asked the Texas Rangers on Friday to investigate the shooting. Ms. Johnson said the Texas Rangers coordinated the booking of Officer Guyger and recommended the charge of manslaughter.

A neighbour of the victim posted on Twitter and said she heard everything.

The tweet says:

Please notice the bright red mat in front of Bo’s door. But she didn’t realize she was at the wrong door??? Really?? #really

I am his next door neighbor, I was home Thursday night and I heard everything. I took this photo yesterday.

The apartment door appears to be the same as mine, here is a picture of the key it's plastic and has a magnet inside of it. When you insert it a green light comes on and you turn the key, then you still have to turn the door handle to open the door. It's a deadbolt with a magnetic key.

Law enforcement authorities offered multiple explanations for the shooting: that Guyger lived in the same apartment building and had gone to the wrong door, that she had been serving warrants for an extended shift and was tired, that Jean’s door had been unlocked at the time that she entered, that she thought her own home was being robbed when she saw Jean in the apartment, that she simply didn’t notice the bright red doormat Jean kept outside of the door to his apartment, that Jean ignored the “verbal commands” of the intruder in his home.

Those claims may be true, but in most cases, authorities wait until the conclusion of a criminal investigation to explain the facts of a case, rather than the beginning. Regardless, it’s unusual for law enforcement authorities to offer mitigating circumstances explaining the suspect’s side of the story. (Since Guyger was off-duty and not acting in an official capacity, the incident isn’t considered an officer-involved shooting.)

I think it's entirely possible she had zero clue what color he was. If it was dark, how could she?
Unlikely that it was pitch black in the apartment. There would have been street lights, the sky would have been lit up because it's an urban area, and it might have not been that dark yet, depending on the time. Besides, light from the hallway door would have lit up the room if the front door was open. No way she didn't know he was black.

Where was she standing when she shot him and why would she enter the apartment in the dark after shooting him if she was so afraid?

Honestly, she just seems like a dumb cop too. Dallas needs to start hiring less trigger happy people.

That poor man. He looks just like my cousin. Everytime something like this happen my first thought is that people see someone with black skin and immediately think that we are up to no good.

She couldn’t back away into the hallway, keep her gun on him and give the man a few seconds to explain!?

Ugh. I’m so angry you guys. Such a senseless death.

Well, hopefully she WILL spend time in prison.

The laws in Texas regarding murder and manslaughter are kind of blurred:

"In order to be charged with murder, the defendant must have knowingly and willingly caused the death of another person."

"To be convicted of manslaughter, a defendant must be proven beyond reasonable doubt to have recklessly caused the death of another person. As opposed to murder, intent does not need to be proven in order to convict someone of manslaughter."

DPD will hire anyone. It's known to be where cops go, when they can't get hired in other nearby cities.

She was probably focused on her cell phone, and this added to her lack of attention. I wonder if there was someone on the other end who heard something?
