The ruling restores statements Sedrick Johnson made to law enforcement incriminating himself in the death of an 18-month-old boy who was reported missing. Johnson had asked for a lawyer but ultimately waived his right to counsel before telling police he put the child’s body in a dumpster. “The question before us today is whether the request for counsel before Miranda warnings invoked Miranda protections so as to bar police-initiated interrogation after Miranda warnings were later given,” Presiding Judge Sharon Keller wrote in a decision joined by Judges Barbara Hervey, Mary Lou Keel, Jesse McClure III, Michelle Slaughter & Kevin Yeary. “In line with precedent from the United States Supreme Court, we answer that question ‘no,’” Keller wrote. “The right to counsel under Miranda cannot be invoked anticipatorily. A Dallas man who confessed that he left a toddler in a dumpster was convicted Wednesday evening for failing to seek help before the child died.
Sedrick Johnson, 33, was found guilty of injury to a child by omission in the 2019 death of Cedrick “C.J.” Jackson, the 18-month-old nephew of Johnson’s girlfriend. Johnson faces up to life in prison. The sentencing phase of the trial will begin Friday.
The jury — nine women and five men, including two alternates — deliberated Johnson’s guilt for more than three hours inside the courthouse near downtown Dallas.

Johnson is also charged with capital murder. The toddler’s aunt, Chrystal Jackson, faces a charge of child endangerment. Both cases are pending, court records show.

I thought it was a trial for both charges, but looks like the murder charge is still pending. But Chrystal's charge of child endangerment was lower to a misdemeanor & sentenced to probation & that was on 11/7/19. Wondering why the article says those charges are still pending??

I thought it was a trial for both charges, but looks like the murder charge is still pending. But Chrystal's charge of child endangerment was lower to a misdemeanor & sentenced to probation & that was on 11/7/19. Wondering why the article says those charges are still pending??

The Dallas man convicted of failing to seek medical attention for an ailing toddler and leaving the child in a dumpster was sentenced Friday to 20 years in prison.
Sedrick Johnson, 33, was found guilty earlier this week of injury to a child by omission in the 2019 death of Cedrick “C.J.” Jackson, the 18-month-old nephew of Johnson’s girlfriend.
Johnson faced up to life in prison.
About six years will be shaved off Johnson’s confinement because of the time he’s served in jail awaiting trial. He will be eligible for parole in roughly four years, according to his attorneys.

Johnson still faces a capital murder charge in connection with Cedrick’s death.
I keep forgetting that this verdict was ONLY for the injury to child.
