There are a lot of people that believe that burning a body is as simple as dosing it with an accelerant and lighting a match. Its common belief that by doing so you can cremate the body and destroy evidence.
However, during cremation, the box is placed under heat of 1400 to 2100 degrees F. The process can take from 90 minutes to over 2 hours. Once the heat process is completed, there are still large fragments of bone left that are then placed into another machine...
Most modern accelerants when burned don't reach higher than 900 degrees F, meaning it would take at least twice as long, possibly over 4 hours to reduce to bone. And would need a continuous watch of the fire, as accelerants will tend to burn out. At that temperature, the bone would be burned but not disengrated.
I say this to point out that unless "he" was in a fetal position or missing body parts, I don't see how any LE could mistake 3' for 5'.
