Reporter: Where was the last place that he was seen at, was it a house?
Penshorn: From what we understand, he was actually seen inside of the residence, there on the 2600 block of Savannah Hills Circle. In talking to the parents, they had seen him and then a matter of approximately ten minutes went by to twenty minutes, and they turn around and he was not there. ALthough the child is only 18 months old, he has been walking since the age of 10 months, and is very mobile, so it is entirely possible that he could have traveled quite a bit of an area in that time period.
Reporter: Do you guys, are you guys leaning towards maybe he went somewhere on his own or that someone possibly kidnapped him?
Penshorn: Right now, we don't have anything that specifically indicates to us that the child has been abducted. Primarily the reason that we were not able to issue an Amber Alert is because according to the Amber Alert guidelines, you have to have certain criteria, that is one of the criteria that we have to suspect an abduction or have information that would lead you to believe that it was an abduction, and we do not have it right now. We are specifically looking at it as the child may have simply wandered off, hopefully is somewhere in the near vicinity and that's how we're handling the search.
Reporter: Could anyone, the parents I guess, face any kind of criminal charges, say...
Penshorn: We aren't looking at any type of criminal actions at this time, we are just primarily concerned with the search and rescue of the child.
Reporter: I undersatnd there's a sex offender living on that street. Have y'all checked him out?
Penshorn: There is one registered sex offender that is across the street from this individual. He's been interviewed, we also have a conducted searches of his vehicles and residence, and as of right now, we have nothing to lead us to believe that he's involved in this missing child.
Reporter: How long did you search last night?
Penshorn: The search basically began at approximately 8:40 when the officers arrived, or 8:30, I believe, was the actual dispatch time, and the search has been ongoing since that time.
Reporter: So you went through the night?
Penshorn: We went through the night. We did have to, we had to change the scale and the scope of the search, just primarily because of the nighttime hours, there were a number of civilians that were involved. Once we did use our Emercency Notification system to notify the surrounding areas, and I believe it was somewhere in the neighborhood of 2400 residents that were contacted. We had somewhere in the area of 100 people that showed up at the scene to assist with the search, and again, not only were we concerned with the child's safety, but we're also concerned with the safety of the searchers, so we did change the scope somewhat for the late night hours, early morning hours, and then we take up the ground search again this morning at approximately 7:30 a.m.

Penshorn: There's a front door to the residence theres also a glass door and the glass door doesn't necessarily latch so it is concievable that the child could have been able to exit the residence without being detected.
Reporter: Do you guys think that he could have gone that far within...
Penshorn, From what we understand, being that the child has been able to walk for approximately ten months, and talking and interviewing some of the other family members that were present, he is able to travel rather quickly and it is concievable that he could have gone, especially after this amount of time, he could have gone quite some distance.
Reporter: Can he talk, can he say something or he's just, you know...
Penshorn: From what I understand, he does speak somewhat. Keeping in mind that he is eighteen months old, I'm not sure exactly the specifics of how much information he would be able to provide, an address or anything like that.
Reporter: How is the family, can you say, how is the family, what's going on, are they...
Penshorn: Obviously, the family is distraught about the situation and I'm sure their main concern is that the child is located.
Reporter: And the mom and dad were the only ones home at the time?
Penshorn: There were actually a number of other family members that we did interview that were also there at that time.
Reporter: Do they all live in the area? Are they, the other family members?
Penshorn: They primarily all live here, in the New Braunfel area.
Reporter: So did you go house to house last night?
Penshorn: We conducted multiple searches of the residence, we conducted door to door contacts with every single resident on Savannah Hill Circle, which there were several. We actually made contact with every single homeowner, and made multiple sweeps of the area, obviously by air and on foot throughout the night.
Reporter: Have you guys ever encountered anything like this, an eighteen month old, you know, wandering around in the streets?
Penshorn: We have had the circumstance with other missing children, we actually had a case approximately a week and a half ago, where we had a three month old child that went missing from an apartment complex here in New Braunfels. Fortunatley, we were able to locate him within a matter of hours, and he was in an apartment that initially we had dtried to make contact several times and no one answered the door and he was there with some other small children, we were able to recover him safely.
Reporter: So what's next for you guys now? What's the next phase?
Penshorn: Right now, we're just continuing the search. We have put ou tinformation, specifically, if there are colunteers that do want to assist, that they can come to Klein Road Elementary. We've had somwehere in the area of 100 volunteers that have arrived now, and the actual search is being coordinated with the three groups I mentioned before, specifically having the area gridded and we can go through and do a very meticulous, organized search of the area.
Reporter: What was the boy, the baby boy wearing at the time?
Penshorn: the specific infomation that we have were he was wearing two different long sleeve shirts, a long sleeve, I believe, a red and blue shirt, and he had another grey tee shirt underneath and then also had a pair of beige jeans on and black and white socks. We do not believe he was wearing shoes at the time.

I also remember when the mom or dad said to their 2 yo get in the car and they went into the house to get the other child and the 2yo went missing in seconds. The baby was found (I think down in a sewer). LE had open up the lid but did not realized the child had fallen so far in. Child was found the next day.

Socks (vs booties) don't usually stay on little toddler feet all that well anyway, but wet socks specifically seems to me would have come off as he walked. I'm having a hard time understanding why (if he wandered away) his socks have not been found.
Also the time line - mom waited 10 to 20 minutes after last seeing him to check - which seems perfectly reasonable to me. He was in his own home, with family - he should have been fine. Dad - assumably starts to search after being alerted by mom. One person left the house and returned between mom last seeing baby and call to LE.

Sadly...I am losing hope...unless...somebody nearby has him. I read above that LE says it made contact with the homes nearby...can they search them ?? And did anyone interview the big brother ? When did he last see what joshua was doing ? he may have seen something and not realized it's important. Did he see Joshua getting into things ? Maybe playing near the bathroom, kitchen. I am hoping they had someone who specializes with children interview him. He may know the places Joshua played around the home, inside and out.

I have been having computer problems all day long, and am just now able to log on.
I'm in Austin, and pass through New Braunfels when I go to visit my daughter and granddaughter south of there. She probably lives 5-10 miles from where this happened.
I just can't believe this child hasn't been found yet. It's really eating at me that no answers have been forthcoming. When I finally got on line, I expected to come here, and find that he had been found. Sigh. Where can this baby be?
I just don't understand how it is that a mother turns on a movie for a child, the child goes off in another room, and the mother waits 20 minutes before she gets up? to check. If it'd been me I would've have gotten up to go find him or at least expected the mom to holler to the dad, "Is Joshua out there with you? What's he doing? I turned a movie on for him. Send him back in here."
Then I wonder what he was even doing up? I remember putting my children to bed about 7:00PM at that age, but people are different, have different schedules. It just seems like a mother with a toddler, and another baby due in three weeks would want that toddler in bed early
so she herself could get some rest or at least relax awhile before going to bed herself.

So here we are with a mom who hadn't seen her son since 7:40. What was he doing all that time until the father noticed him pulling on his hat?
This really makes no sense to me. Little children are underfoot constantly. They might occupy themselves alone for 5 minutes, but that's about it.
LE doesn't think Joshua was abducted, are thinking less and less he wandered off, but their still sticking to that while they run a criminal investigation.
Are all the people in the house sticking with the same story? Why aren't we hearing their versions of what happened that night? If the grandfather has said anything to the media, I sure haven't seen it. This is bothering me.
When Hailey Cummings disappeared the whole family had been on TV it seems within the first week, and yet it is the families or persons in those families that are likely responsible for her disappearance.
I just don't get it. I'm sure everyone here is just as frustrated that there's been no resolution. I hate to bring it up, but we have buzzards in central Texas. If that child were in a field anywhere, I'm sure the buzzards would have discovered him. They don't take time off from feeding because it's cold outside.
If he'd drowned in a pond, his little body would've floated to the top by now if he wasn't weighed down. I don't know how long a body will float before sinking again though.
An abduction seems so unlikely at night. Someone would have to see him in his yard in the dark. I don't understand though when the police say there's no evidence of an abduction.
A child out on a cold night, it's doubtful anyone else is going to be outside so if he were abducted it's entirely possible that no one saw him taken. And if that's the case, what kind of evidence would there even be?
I'm rambling, so I'll stop. I just want to see closure in this story one way or another.
I'll never forget when my second child learned how to open the front door,, and wandered off. Thank goodness I had the best dog in the world who wouldn't let my boy out of his sight. They didn't get far, but it was far enough, and scared the bejeebers out of me. From that point on, I made sure all the exterior doors had deadbolts that had to be key operated so no little busy monkey could be fiddling with the locks.

The family can make the call to TES, but TES does not seem to be actively getting on the ground unless they have LE's blessing, so effectively we are back to LE being the ones to call. Frustrating, I know, at least it is from where I sit.

I remember the craziness of Caylee - Cindy placed the call (IIRC after someone here forwarded the info to her) she asked TimM for their help, then changed her mind - TES was going to pull out, then TimM said ENOUGH! You asked for us, we're here, we're searching for Caylee. Later we found out all the rest of the BS that went on behind the scenes.
Anyway, sorry for the OT but IIRC the family has to make the request (LE has a say in there also)...

There was no "evidence" that an abduction had occurred in these cases, until an arrest was made and/or a body found.

So, whilet at a re-cert class I started jotting down thoughts. I'll spit them all out and then see what everyone thinks.
4 Scenarios
1. wandered off
2. taken by someone in house (either alive or because they hurt him somehow)
3. taken by stranger
4. hurt either by accident or on purpose by family member
I see scenario 3 as being highly unlikely.
Caution, some of this may be upsetting, please don't read if it might bother you
Scenario 1
I don't feel the area in a 1 mile area has been cleared, it would take days to do so completely. Have they done line searches and then cross gridded them (effectively doing the same line search but perpendicular to the way you did it the first time)
Have they checked every pond and small body of water in that same area? There appear to be a lot of them. Both of these things are highly time consuming.
Expanding to 2 miles=do the exact same thing all over for 2nd mile. 1 square mile is almost 28 million square feet 640 acres, it's a lot more ground to cover than most think. Especially when you are looking for an 18 month old baby who is 2 ft tall and going to be a whole lot smaller if curled into a ball.
Scenario 2 and even 4
we are looking at a 30 minute window from the time Dad last saw him to the time the 911 call was made. There has been no information out saying that these times are incorrect. If Dad said 8 and he was out in the livingroom with others, then there would be multiple people who saw him at this time. So, what could have happened in that 30 min. window? Not much time to hurt/kill a child and dispose of him. The most likely scenario would be to hide the body for future disposal. Where would that be? Shed? Car? Do neighbors leave their cars unlocked? What neighbors have sheds or something similar that would work? HRD dogs were brought out, no word as to whether they hit on anything or not. What they did not do use find Joshua. Did they check the cars of everyone who was there that night? Who would have had time/ability to do it after the 911 call was made? I'm seeing some real logistical issues here with trying to pin this on them.
As for scenario 3....
What are the odds of a stranger driving down that street at 8 at night when an 18 month old happens to wander outside? I'm going with astronomically unlikely.

I just wonder if the family called TES and TES called LE to OFFER help...
Right now it appears LE is kinda trying to cover their a$$... I wonder if they would really turn down searchers willing to search, when they have essentially quit searching?
It would make them look pretty bad when they appear to be trying to repair their image already... other recent cases where LE didn't allow TES to come in, they didn't seem to concerned about their image.

I agree, an abduction on a cold, dark night is highly unlikely.
If Joshua wandered off, he has to be in a hidden location because like I said, the buzzards would've found him by now if he were out in the open.

Another good point and one I've heard conflicting reports on, buzzards. What's the word, are they in the area or has it been too cold? We have them all year long here, but in Hailey's case I keep hearing that in some parts of Texas they are seasonal. Any resident buzzard experts? lol.
