The article has more detail about evidence found at McClain's apartment. The judge and DA are also talking about capital murder charges and the death penalty.

"The burden on us is to put forth evidence, that we believe that she would be found guilty of capital murder, but not only would she be found guilty of capital murder but that a jury, if given the task, would in fact come back with a penalty of death. We believe that we met that burden," Ligon said.

The KHOU article above mentioned that McClain spent most of the hearing rocking back and forth, fidgeting, etc. Is it possible she's abusing drugs?

I still don't understand how someone who already had several children of her own would then attempt to kidnap another?

This is actually not uncommon in this type of case. The three kids are with other men, but it's the new man that a woman in this type of case is trying to please/keep. For instance see case in the link. That woman also had three kids and a new boyfriend.

I didn't think the Judge would allow Ms. McClain to bond out of jail. Verna McClain's attorneys argued VMcC should be released to attend to her 3 children but they also told the Judge they will have experts evaluate McClain’s mental state so she should remain behind bars if they plan to use insanity as their defense strategy imo. Defense attorneys noted that, so far, police have no witnesses who actually saw McClain in the getaway car.

I think she may have rocked back and forth during today's hearing because she knows Texas is a death penalty state.

McLain's grandmother, who refused to disclose her name to reporters, said her granddaughter had several miscarriages over the last couple of years and wanted to take in foster children.

The grandmother of Verna McClain said McClain recently bought a gun, a .380 caliber Taurus semi-automatic pistol which matched the caliber shell-casings found at the shooting scene.

McClain’s grandmother, who did not want KHOU 11 News to use her name, said the 31-year-old nurse recently had her home and car broken into, so she bought a gun for protection.

The grandmother learned of the gun after the shooting.

Det. John Schmitt testified how he first met McClain at the apartment complex where the getaway car, a powder blue Lexus registered to McClain’s sister was found so I guess her sister owns the vehicle and she allowed Verna to drive it.

Witnesses at the medical clinic wrote down the Lexus's license plate and that led LE to Verna's sister's home. It doesn't sound like the two sisters lived together. Schmitt said the Lexus had blood on the driver’s side door where Golden had fought for her baby. Detectives also said they found a bloody pair of pants at the apartments, along with a blood-covered cell phone and a .380caliber Taurus semi-automatic pistol matching the caliber shell-casings found at the shooting scene.

According to Verna's grandmother, on Tuesday morning VMcC left her home to take her children to school and told her younger sister she was going to pick up her foster child.

The grandmother said she went with McClain to the younger sister’s home and saw the SWAT team outside so I guess McClain dropped Keegan off at her younger sister's home before she picked up her grandmother.

At first, McClain, who had diapers in the back of the car, didn’t let on she knew anything about why detectives might be outside the apartment.

According to testimony, just hours after she allegedly shot 28-year-old Kala Golden and abducted then-3-day-old Keegan Schuchardt, McClain approached detectives and told them that she’d found the baby on the front steps of her sister's apartment complex and had taken him to another home in Houston for safekeeping.

Her grandmother said she later admitted to police what happened.

Apparently she doesn't. Lexus was registered to her sister. I am really amazed at the defense lawyer who thinks she should go home so she can raise her kids. Whereas the father with the murdered wife still doesn't even have custody of his own kids.

There is her fiancee. He looks to be bi-racial to me. I guess that could explain why she thought she could pass up a white baby as hers and his. Apparently she told him she had the child on April 3rd. Even though he has not seen that child apparently he believed her. So I guess she could have convinced him that baby was actually theirs.

I can see why she thought she could convince this guy the baby was his and hers. First she managed to convince him she carried pregnancy to term (and was she ever even pregnant to begin with?). Then that she had a baby even though he didn't see this baby for 2 weeks. I guess he was easily convinced.

As much as I do not want this woman to get off on some insanity claim, she must have been absolutely insane to think she was going to get away with something like this. After seeing that interview with the fiance, it appears more and more that this crime was motivated by her desperation to keep her man and she had to make a move like this, rather than get caught up in her big lie about having his child. Makes me so sick to my stomach to think that all the Schuchardt and Golden families are going through right now is because of some sick woman's desperate attempt to keep a man.

Yes Jenny, that crossed my mind as well. This guy must me as crazy as she is thinking that 1)she had his baby at the beginning of the month and he still hadn't seen it (although that also tells me he didn't care too much about the supposed child) and 2) is still wanting to be with her.

Kala Marie Golden-Schuchardt, age 28 of Spring, Texas passed away on Tuesday, April 17, 2012 in the Woodlands. Kala was born on March 3, 1984 to Donnie and Linda Golden at Conroe Regional Hospital, Conroe, Texas.

She attended school in Oak Ridge and went on to get her Cosmetology license and then became a full time Mom. She grew up in Montgomery County area and was loved by all. Kala loved her children and loved being a mother. Her children were her life.

Lying to her fiance and telling him she had already given birth to their child means she stole the baby because she felt trapped and pressured by her lies and she was desperate for a solution.

VMcL wilfully decided to steal a baby in broad daylight because she lied to her boyfriend so I don't think a psychiatric evaluation which determines her mental status will find her insane.

Verna's gm said her granddaughter has had several miscarriages over the last couple of years but she didn't say whether she miscarried her fiance's baby in 2012, so until it's proven otherwise, I suspect the defendant wasn't pregnant and she lied to her fiance about being pregnant with his child. If she didn't miscarry her finace's baby, then if will be even more difficult for her attorney to claim she was mentally unstable because his client recently suffered a miscarriage and was under emotional duress.

Investigators said McClain possibly had a miscarriage and I think a physical examination by a doctor would determine whether she did or not.

I’m not sure if women who miscarry require medical attention but I think they do.

Kevin Carter, Verna’s fiancé, has a school-aged daughter. He said he found out what happened when he turned on the news the following day.

Barbara Fisher, Kevin Carter’s mother, said Verna called her the day of the shooting and asked her for a ride because the battery in her sister’s car had died and she needed to go pick up her children at school.

Ms. Fisher, who believed Verna had given birth, said Verna came down the stairs carrying what appeared to be a comforter or large bundle of clothing and she thought the baby was in there; but Verna told her the baby had messed up her sister’s things and car seat so it appears Verna was attempting to dispose of evidence (ie. her bloody clothing, gun and cell phone).

It depends on when you miscarry. In theory you should see a doctor, but plenty of people don't if it's early on. In fact, some women don't know they miscarry if it is early enough in the pregnancy.
