He is disgusting. Surely the Jury can't buy his ridiculous defence ?!

  • #982
I'm baffled at how he thought he would get away with this though. Maybe he didn't. Maybe he just didn't care.
Let’s be honest, for anyone who could commit these atrocities there would be absolutely NOTHING off limits and that includes attempting to frame someone else. No conscience, soulless and evil.

When asked if it was possible the accused DNA could have been planted on Alesha’s body, the forensic scientist says “scientifically, it could be possible”

The forensic scientist tells the court: “In our opinion an explanation of these findings could be that (the accused) had vaginal intercourse with Alesha MacPhail”

I feel sick
That poor, sweetheart. Imagine her terror - it’s the stuff of nightmares. Horrific beast.

I think this is just a standard response though? That even though it's technically possible I doubt it's likely, right?

Indeed. The scientist has to be scrupulously truthful but the Jury can make up their minds on that one

I don't trust myself to post something that won't be deleted.
But am reading along. Thanks to all who are posting the court updates.

Edit -sorry for the poor grammar in that first sentence. Disgust and fury.

Maybe he thought using a condom would ensure no traces

True. But do we know if he even used a condom? Sorry, don't mean to get too graphic.

Correct. They can't say with absolute certainty. That's what beyond a reasonable doubt is though - not 100% conclusive but beyond logic. Like for accused story to measure up SO many things have to be thought of in the most unlikely scenario. So implausible.

Everything taken together points to a guilty verdict now.

Please correct me if wrong BUT we do not know if a condom even existed in actuality.

I do not believe the accused even used a condom while assaulting Alesha.

Reference of a condom is strictly by the defense when they lie about Accused and Toni having had sex earlier using a condom and then apparently Toni carrying the condom away and later using contents, semen, to contaminate the crime seen and implicate the accused. MOO

IF he used a condom himself to commit the crime ... it could be that the 'traces' were from him getting seminal fluid on his hands whilst putting on a condom which was then transferred in trace amounts to the victim ...

The report also found traces of DNA from the accused on Alesha MacPhail’s face and neck - he says it is again a billion times more likely to have come from the 16-year-old than from another contributor

We don't. So if he didn't then possibly some level of clean up afterwards

Apologies for being graphic but if the accused had ejaculated during penetration it would be scientifically impossible for seman to have been planted.
All the jury needs is a reasonable doubt and they can't find the accused guilty.
They don't need to have 100% proof that it was planted, just a doubt that it wasn't planted if that makes sense.
