Why aren't there artist sketches from the trial?
I only saw 2 pics of ET in the Press, one photo heavily photoshopped.
i wonder this as well. and think I've only seen two pictures of TH

I actually do think he didn't know half the extent of what went on in that house

Im in agreement with your statement I bolded. I don’t think he knew half the extent and what he was told is dramatically different to what he’s now seen on CCTV.

Hmm... Im not this forgiving of him. Quite the contrary!
I would like to see the photos of the 2 of them in Court.
But maybe we will see their mugshots soon????

Yeah i am thinking more pics will be released after the trial maybe. No i think so too, i hope so anyway. Maybe he was a bit nicer to Arthur than ET let on, which is a comfort to hear

Day 29 of murder trial begins

Good morning.

Today is the 29th day of the trial.

Mary Prior, defending Tustin, resumes with the events of June 19, last year, when Hughes and Tustin travelled in a van together going to and from court.

The jury has previously been told that the defendants' conversations in the vehicle were covertly recorded.

'I've said it's all me'

As stated yesterday, the recording is muffled in places but some of the exchanges between Hughes and Tustin can be made out.

Tustin said: "Tom you okay?"

Hughes: "I've said it's all me." He added: "All the rules set in that house for Arthur were set by me."

Tustin: "What have they said to you?"

Hughes: "I basically held my hands up and said it's all me."

Further on in the conversation he added: "I expect to be charged with murder tonight. I will get charged on it. I have said you should be treated as a witness not a suspect. I begged for it.

"They said they understand they just have got a line of duty to go down in effect. I said this is all on me, no-one else. No-one else needs to suffer."

Tustin can be heard telling Hughes that social services were due to come out to her later that day because they were 'concerned about me and the baby'.

She said she had not drank much during the last few days.

Hughes asked the name of the officer that interviewed Tustin.

Tustin: "I don't know he's just a fat t***."

She added that she thought she would be 'charged with child neglect'.

'None of us are going to walk away from this'

Hughes: "They said do I believe my actions caused Arthur's death. I said 'yes'."

Tustin: "You said yes? F****** hell Tom.

Hughes: "I hit him with a slipper and he bashed his head off the door. I squeezed him."

A little later Tustin said: "None of us are going to walk away from this.

Hughes: "I think you might."

Tustin: "Nah."

She added that she was 'shouting at him and that'.

Hughes explained the CCTV camera did not pick up sound.

Tustin: "F****** horrible situation to be in."

'I have said you are not a suspect'

Much of Tustin's dialogue is harder to make out due to the speed she spoke at.

Hughes said: "I think you will get off."

Tustin: "They will put it on both of us."

Hughes: "Just put it on me Em."

Tustin in her response said 'saying I neglected him and that'.

Hughes: "They were my rules."

Tustin: "That's what I said."

Later Hughes said he had 'told them about his Blues shirts'.

He added: "Told them I took it next level. Took his things off him. I'm not walking away with anything less than a murder charge."

Tustin: "They'll stick it on us both."

Hughes: "Nah. I have said you are not a suspect. I have said there's messages on my phone telling you 'just whack him' and you have said 'no'."

The recording continues.

Tustin: "Wonder what your mom and that are saying."

She added: "Your mom is probably going to be one of the witnesses."

Later on in the exchange Tustin said: "She's going to turn on you 100 per cent."

At one point Hughes said: "They can't put a murder charge on you."

Tustin responded saying she had explained she was 'depressed, stressed' before she added: "F****** s*** ain't it."

Hughes then told Tustin 'it's in the media' and added 'the names haven't been released'.

'That judge was on his high horse'

At one point Hughes said: "They are clutching at straws with you."

Tustin asked Hughes what he had said to the officers about her.

Hughes: "I said she was the best mom ever even though she knew she was going to get s*** daily. She always made sure Arthur had breakfast, still looked after him."

Later on in the exchange Hughes said: "They asked if you was scared of me. I said 'I believe so'. I told them about the door I kicked.

"I said 'I don't think she was scared to be in the same house as me but quite wary'."

As the conversation went on Tustin said: "That judge was on his high horse."

Hughes: "Yeah he was a f****** p****."

'Tustin concludes her evidence'

The van recordings conclude.

Ms Prior asks: "During the course of the conversations that were in the van we have just heard, why were you talking to Thomas Hughes?"

Tustin: "I was asking if he was okay, I was just making sure he was okay, wanted to see how he felt. I just got into the conversations about things we were speaking about."

Judge Wall raises a number of questions from the jury. He asks Tustin if she continues to use salt as pain relief in custody.

Tustin confirms she does and that she purchases it from the canteen every two weeks.

Judge Wall now addresses the question as to whether the sandwich left in Tustin's kitchen on June 16 was checked for salt. He confirms it was not.

Tustin concludes her evidence. She returns to the dock.

'You are going to hear his side of the story'

Bernard Richmond, representing Hughes, addresses the jury.

He says: "This case is a horrible, horrible case.

"I suspect you look at that dock and you feel revulsion and disgust, and you have been battling that from the moment this case has started.

"One thing that's important is that you don't get into the mindset of 'they, they, they, they'.

"There were two people in this relationship and those two people had different things going on at different times. There are separate trials going on here.

"One thing that is not going to happen in this case is that Thomas Hughes is going to start crying for himself.

"The case we are going to present to you is not expected or intended to create any sympathy for Thomas Hughes. You are going to hear his side of the story."

Thomas Hughes takes the stand

Mr Richmond calls Hughes to the stand. He begins by asking a series of questions.

Hughes confirms he got on 'very well' with Arthur prior to summer 2019 and that he was 'well loved'.

Mr Richmond: "A year later he's dead. What on earth happened?"

Hughes: "I met Emma Tustin. Yeah. I met Emma Tustin."

He adds he has learnt 'a lot' about Tustin since then.

Mr Richmond: "How different is your view of those events compared to at the time you were interviewed?"

Hughes: "I think very different."

Mr Richmond asks another series of questions.

Hughes denies he did anything to encourage or support Tustin killing Arthur, causing him serious harm or harming him physically whatsoever.

Hughes agrees he hit Arthur as a 'punishment'

Hughes denies he salt poisoned Arthur or encouraged Tustin to do so.

He accepts he 'partly' takes responsibility for Arthur being disciplined by standing or sitting for long periods of time. Hughes also accepts his discipline went beyond what was reasonable.

Hughes accepts he isolated Arthur from the rest of his family but that it was 'sort of taken out of my hands due to the lockdown'.

He agrees he hit Arthur as a 'punishment'. Hughes states he did not hold on to Arthur when he hit him.

He denies ever hitting Arthur to the face or head and tells the court he only struck him to the legs up to the buttocks.

Mr Richmond asks if he ever caused bruises.

Hughes: "I probably did."

Agrees he intimidated Arthur

In relation to count two on the indictment Hughes accepts Arthur was subjected to prolonged periods of forced standing. He also accepts he isolated him within the family home.

Mr Richmond asked if Hughes acted towards Arthur to be 'horrible' or to discipline.

Hughes: "I thought it was disciplining him. I still think it was discipline but the wrong type of discipline for Arthur.

Hughes accepts Arthur suffered unnecessarily.

He now agrees he intimidated Arthur with the threat of violence.

Mr Richmond asks how many times he hit Arthur. Hughes says: "I couldn't answer that."

'His food was inedible with salt'

Hughes denies he deliberately starved or dehydrated Arthur. He accepts Arthur was withheld a drink 'at times'.

Mr Richmond asks if he can think of a reason now why Arthur would ask for a drink.

Hughes: "Yes, his food was inedible with salt."

Mr Richmond: "How did you feel when you learned that?"

Hughes: "Angry."

Hughes tells the court he had not watched any of the living room CCTV of Arthur's behaviour until it was shown during the trial.

He states he was 'angry' at watching it.

Hughes says his understanding of what was happening in the house is now 'completely different' to his understanding at the time.

Hughes said of Arthur: 'Loved him to pieces.'

Mr Richmond takes Hughes through some background information.

Hughes confirms he left school without any GCSE qualifications but went on to study football coaching at Solihull College.

He tells the court he then went on to do plumbing and plastering. Hughes states he was 'quite an unconfident person' and adds: "I couldn't see things other people could and how effortlessly they made it look."

Mr Richmond asks about his relationship to Olivia Labinjo-Halcrow.

Hughes: "At the start I loved the woman to pieces. I was confident we would get married and have children together and live happily ever after."

Hughes believes Olivia started suffering postnatal depression which made her 'withdrawn'.

He accepts they 'grew apart' and suspects she was 'unfaithful' to him at the end of their relationship.

Hughes states he was 'heartbroken' when they split up. Asked how he felt about Arthur at the time he says: "Loved him to pieces."

Hughes met Tustin on Plenty of Fish

Hughes confirms he did not have any problem with Olivia's parenting of Arthur. He also confirms he took custody of Arthur when she was arrested for killing her new boyfriend.

Asked how Arthur was before Emma Tusin came on the scene Hughes says: "Happy. He was very big on routine. Made him feel comfortable."

Hughes confirms he met Tustin on Plenty of Fish and had his first date with her in a pub in Solihull.

Mr Richmond asks what he found attractive about her.

Hughes: "I told Emma about Arthur's mom and I thought she would run a million miles. When she didn't I thought she obviously cares and she wants to help."

Relationship developed 'too fast'

He accepts their relationship developed 'too fast'.

Asked how he felt he was coping as a parent in September 2019 Hughes says: "Still struggling a bit. But I was comfortable."

He tells the court Tustin seemed 'very confident' as a parent.

Mr Richmond asks if it was easy to disagree with Tustin. Hughes says 'no' because he was not confrontational.

Hughes says Tustin started telling him he was 'being too soft' on Arthur.

Mr Richmond asks if he felt he was 'under pressure' in relation to looking after Arthur.

Hughes: "I felt under a lot of pressure. Mainly from Emma."

He adds he felt his 'parenting was alright' at the time but he started 'doubting himself' because of the things Tustin would say to him.

Mr Richmond: "Why not just tell her to get lost?"

Hughes: "I didn't want the confrontation. I didn't want to be accused of being a liar."

'She didn't like it. Became aggressive'

He confirms on occasion he would say 'mind your own business, he's my son I'll do it my way'.

Hughes adds: "She didn't like it. Became aggressive. I was told she would go and find someone else, she doesn't need to put up with it."

Mr Richmond: "Why didn't you just let her?"

Hughes: "Because at that point I thought Arthur was quite close to her from what she had said. I didn't want Arthur feeling another person has left him in his life."

Couple argued when Hughes bought Arthur Subway sandwich

Mr Richmond asks how Tustin felt about Arthur getting treats in September 2019.

Hughes recalls an argument over the fact he bought Arthur a Subway sandwich which Tustin classed as a treat.

He states his own mother Joanne Hughes was 'standoffish' with Tustin adding: "I don't think she particularly liked her."

Hughes tells the court he never witnessed a lot of Arthur's apparent misbehaviour in the beginning and that Tustin would report it to him.

He says: "Looking back, the way it was put to me, the way it was said, I don't think Arthur would use those expressions or words."

Hughes admits he did not question things as much as he should have done.

'I was threatened if I challenged her'

Hughes confirms he would see Tustin every weekend, have a date night on Tuesdays as well as do something with the children on Wednesdays.

He says: "Emma became quite confrontational if I spoke to my parents. She would accuse my parents of not liking her. Made me choose a side, her side or my parents' side."

Hughes states that was a 'big feature' of their relationship and Tustin 'won' that particular battle.

He confirms Arthur would see his grandparents less frequently and says: "Because of his attitude she said he shouldn't be allowed to have fun."

Hughes says Arthur was 'cut off' from the 'maternal side' of his family - Olivia Labinjo-Halcrow's parents - because 'she said it was not good for Arthur to be told different things'.

Asked if he 'loved' Tustin at that point Hughes replies: "More besotted."

He accepts it affected his judgement and adds: "I took her word as why would she lie to me? I took her word as the truth.

"I was threatened if I challenged her about anything, I was threatened 'I don't need to put up with this I will leave and find someone else I can be with'. It just went from there."

Tustin trying to 'separate me and Arthur from family unit'

Mr Richmond asks about the argument Hughes had with his father around New Year's Eve 2019.

He admits he does not feel good about the row now and accepts he was 'picking on Arthur for the littlest things'.

Hughes tells the court if he tried to speak to Arthur that Tustin would 'constantly butt in' and say: "Why are you asking him about that I have already told you."

He states he believes Tustin was trying to 'separate me and Arthur from the family unit' at the end of 2019. He agrees that it 'worked'.

Mr Richmond asks how often he saw his friends in December 2019. Hughes: "I wasn't. If I went to arrange something Emma would say 'I've give up my weekend I'm not spending it alone here, I'm going home'.

"I was constantly told I didn't love her or fancy her as much as the start of the relationship."

Mr Richmond asks what Tustin was saying about the relationship in December 2019.

Hughes: "She was talking about marriage, moving in. I didn't want to get engaged."

He confirms they did get engaged after the argument he had with his father and adds: "I told Emma my fears that I didn't want to get engaged. It was met with 'I will find someone who wants the same life I do'."

Pink chair was 'Emma's idea'

Hughes confirms he took Arthur to see the GP in early 2020 because he was concerned he was having nightmares and expressing fears about being killed.

He states he was not physically abusive towards Arthur and did not threaten to kill him at that time.

Asked about the pink chair Hughes says it was 'Emma's idea'. He adds: "I had my reservations about it. We was experiencing Arthur's behaviour more and more.

"I didn't know which way to turn and she suggested she has a thinking step for her children, maybe I should try and use it as a 'timeout step'."

Hughes denies he purchased a pink chair intentionally to embarrass Arthur.

He states he was not expecting to use it at all and hoped 'the threat of it might change something'.

Mr Richmond asks if he felt there was a big problem with Arthur in early 2020.

Hughes: "Not as big as it was made out to be. A bit withdrawn but nothing out of the ordinary."

He adds that Tustin insisted Arthur was treated the same as her two children so they all 'got the same message'.

'She can become quite aggressive'

Hughes admits the pink chair was used 'more than it should have been' in and around March 2020 by both he and Tustin.

Asked if he ever contradicted Tustin he says: "Not while she was there. Again it comes back to confrontation. She can become quite aggressive."

He tells the court when she was not around he would let Arthur come off the pink chair and sit on the sofa with him.

Mr Richmond says Tustin recorded Arthur calling for his nan in March 2020. Hughes states he was not aware Tustin was recording him at that time.

Tustin said she 'doesn't want anything from Arthur'

Mr Richmond asks if Arthur 'ruined' Mother's Day.

Hughes: "I don't think ruined it. Arthur wanted to make beans on toast and a cup of tea for Emma. Arthur woke up about 7am and from that minute it was 'can we go and make breakfast?'.

"It got to the point I went 'yeah alright then'. Because Arthur's alleged behaviour before, Emma turned around and said she doesn't want it, doesn't want anything from Arthur. That upset him, quite a lot in fact and it went from there.

"It caused an argument saying 'my son ruined her Mother's Day, she didn't have to put up with it'."
