Victim named as further five charged with murder​

A man who sustained a fatal stab wound after being attacked in Hull City Centre on Friday, 24 March, has been named by his family as Kamil Milczarczyk.

Officers were called to reports of an altercation at around 11.20pm on Princes Dock Street, Hull, and upon attending it was discovered that Kamil, 24, had been stabbed.
He was taken to hospital for treatment but died from his injuries shortly afterwards.
Kamil’s family continue to be supported by specially trained officers and have asked for their privacy at this extremely difficult time.
A further five people have now also been charged in connection with Kamil’s death after Tyler Ridley, 18, of Lisset Grove Hull and Bradley Moyo, 18, of Whisperwood Way, Hull were charged yesterday (Tuesday, 28 March).
Brandon Thompson, 21, of Clanthorpe, Hull, Corey Burrows, 18, of 1st Avenue, Hull, and three teenage boys who cannot be named for legal reasons, two 17-year-olds and a 16-year-old, have all been charged with murder and appeared at Hull Magistrates’ Court today (Wednesday, 29 March). They will all appear at Hull Crown Court tomorrow,

Thursday, 30 March.
Seven people have now been charged with murder and additional arrests have also been made.
Six men have been arrested and are currently in police custody in connection with the incident and are being questioned by detectives as the investigation continues.

An additional three men have been charged in connection with the fatal stabbing of Kamil Milczarczyk, aged 24 on Friday, 24 March in Hull City Centre.

Jack Briggs, aged 21 and Henri Hairsine, aged 22 of Milldane, Hull and Mason Opie-Palmer, aged 19 of Dawnay Drive, Hull have all been charged with murder and will appear at Hull Magistrates’ Court today (Thursday, 30 March).

A total of ten people have now been charged with Kamil’s murder and three people remain in our custody and are currently being questioned by detectives in connection with the incident.

Opie-Palmer and his co-defendants all appeared before Hull Crown Court, seven of them, including him, in custody from the cells. Two others, aged 17, appeared via a video link from Wetherby young offenders' institution and another, aged 16, was not in custody but in the care of the local authority.

I’m guessing that after many (if not all) ‘no comment’ interviews, it won’t be long before they’re all going to start blaming one another.

Andrew Smith, aged 22, of Everthorpe Lane, North Cave, Harvey Rimmington, aged 20, of Aston Hall Drive, North Ferriby and Loui Taylor, aged 20 of Main Street, Bromfleet have all been charged with murder and are due to appear at Hull Magistrates Court today (Friday 31 March).
Since the incident Friday, 24 March all of those charged with Murder include:
  • Tyler Ridley, aged 18 of Lisset Grove, Hull

How are 13 people charged with murder in a stabbing of one person? Did they all jump him?
There must have been some damning cctv. This explains why they were all charged What is Joint Enterprise? - Life Or Knife - The choice is yours. I can’t see them all getting a life sentence though.


If somebody has been fatally stabbed you can be found guilty of that person’s murder even if you were not the person who actually stabbed them.
It’s under a law called ‘joint enterprise’.

It means you’re seen as guilty for someone else’s death, because you were part of the situation that could have encouraged the incident, or were part of it without trying to stop it from happening.


Examples of how you could be charged for murder under ‘joint enterprise’ are if:

  • You were part of a group and someone in that group kills someone with a knife. This isthe same for any other weapon or physical attack.
  • You were supporting the attacker’s actions in some way. This could be verbally by encouraging them or physically if you acted as a supportive presence.
  • You knew that the person who made the attack was going to start violence against the victim, and you did nothing to stop it.

We have kind of a similar law in the US concerning 'felony acts' where someone dies.

If two or more people take part in a felony, like armed robbery or home invasion, and someone dies in the act, then all of the perpetrators will be charged with the murder.

Even if the murder victim is one of the robbers, killed by a homeowner or a cop, the others who took part in the crime can be held responsible for that death.

This Joint Enterprise law is very similar.

Further description of joint enterprise, also known as "common purpose":
 
“Kamil, 24, and his friends were involved in a verbal altercation with another group and were later “ran at” by the gang of men and teens in Princes Dock Street. Humberside Police are still trying to establish who delivered the fatal blow but a total of 13 people have been arrested for murder. (…) Mr Milczarczyk was fatally stabbed. The post-mortem confirmed he died of a single stab wound to the heart.”

 
Two separate trials will have to be held in the case of 13 people – including 10 men and three youths – accused of murdering 24-year-old Kamil Milczarczyk in Princes Dock Street, Hull.

The sheer number of defendants and the likely length of a major trial involving so many people meant that it was originally decided that the case could not possibly be accommodated at Hull Crown Court.

 
Incident in toilets 'could have been catalyst for violence that led to death'

The trial has finally started. Unsurprisingly there’s just one man on trial for murder (13 were charged initially - all 17-23 years of age). Plus 6 are on trial for manslaughter but deny it, although one of them and a minor have pleaded guilty to violent disorder, whilst 5 have pleaded guilty to violent disorder and are not on trial I believe.

Sad to think at least one of the defendents lives could potentially have been very different-
Opie-Palmer pleaded guilty to violent disorder. It isn’t clear if those who admitted to violent disorder and aren’t on trial for manslaughter have been sentenced and how long for

From the prosecution’s opening speech:

"The fact that none of those charged with manslaughter were responsible for the fatal injuries does not matter for the purposes of this offence," said Mr Wood.

"It is the fact that they were encouraging or assisting Thompson to use violence by their own acts which implicates these defendants and makes them criminally responsible too for the death of Kamil Milczarczyk." Mr Wood said that the 13 males were thought to have been staying at a "holiday let" flat in Grimston Street, Hull, at the time.
