At least we won't have to wait long to see how the Judge handles this!
Knowing Americans and their zest for hunting criminals, I already know the answer :)

R Polański comes to mind - he is still hiding in Europe after all these years!
But it was a criminal case, not a lawsuit.

Regardless of how the judge handles it, PA won't sweat it.

He might testify
Giuffre called him as a witness for her case against Maxwell and Dershowitz

thank you :) i was just curious given other comments that he has made :)

Ok so from the link 2. It is an undisputed fact that Tony Figueroa testified that Defendant would call him to bring over underage girls and that Defendant and Epstein would have threesomes with Ms. Giuffre................

and yet he doesnt mention that in the articles...go and figure

The Telegraph is normally behind a paywall but this live blog seems to be free to access.

Who will we hear from today?
The proceedings, overseen by Judge Lewis Kaplan, are due to begin in New York.

Andrew Brettler, the Duke’s LA-based lead counsel, will present his motion to dismiss the suit. Mr Brettler will argue that by including a reference to "royalty" in her original lawsuit against Jeffrey Epstein, Virginia Roberts Giuffre had made Prince Andrew a potential co-conspirator.

Mr Brettler is expected to argue before Judge Kaplan today that as Ms Giuffre's 2009 agreement with Epstein was made in direct response to the lawsuit, the claim against Prince Andrew - the only member of the royal family to whom it could refer - is invalid.

David Boies, Ms Giuffre’s lawyer, has described the settlement as “irrelevant” to the case.

The Duke is thought unlikely to dial in to the hearing, which is expected to last around an hour.

Judge Kaplan will either make his decision known at the end of the hearing or hand down a written ruling within days, it is thought.

(The call-in line was not operative for the first 15 minutes of the hearing. It is working now.)

Judge Kaplan interrogated the prince's lawyer about the language of the 2009 settlement agreement with Epstein, which had a release clause as to "other potential defendants." "What is a 'potential defendant' as distinguished from a 'defendant'?" Judge Kaplan asked.

Will any sort of decision actually be made today?

Judge Kaplan pointedly remarked of "other potential defendants": "It is a word that neither you or I can find any meaning at all." The prince's lawyer Andrew Brettler defined the phrase as "someone who could have been named as a defendant but was not."

I wonder if Alan D wrote this agreement.

I wonder if Alan D wrote this agreement.

I was just wondering if he took money from Prince Andrew, etc and just told them he’d put their names in the agreement.

Prince Andrew lawyer: Ms. Giuffre needs to lock herself into a story today. She needs to give a date, a month, a year as to when she was abused. We don't know when this was. She doesn't articulate what happened to her

Judge: With all due respect, Mr. Brettler, that's a dog that is not going to hunt here. Brettler says she needs to outline in the complaint - not after she receives discovery. Judge understands point but it's not the law

I wonder if Prince Andrew is listening in on the hearing. Or, the Queen's staff. Andrew is said to be "her favorite son."

Brettler has long argued that this agreement shielded Alan Dershowitz, who allegedly invoked it in his litigation with Giuffre. Judge Kaplan replied there's not evidence in the record about that and noted that the release specifically exempted Epstein's lawyers.

Brettler cast Giuffre's allegations as vague: "I'd like even a date, a month. I would even settle for a year. We don't even have a date, a time, a location, and even an apartment." [...] "In conclusory fashion, she doesn't allege what this abuse was."

Judge reading a portion of the complaint in which Giuffre wrote that she was sexually abused at Ghislaine Maxwell's apartment by Prince Andrew at the behest of Epstein and Maxwell. Prince's lawyer says she doesn't allege harm. Judge: we need to move to next point@LawCrimeNetwork
