Monday, December 2
Justice John Cavanagh resumed his summing up, taking the jury through a selection of the thousands of WhatsApp messages between Beinash Batool, Sara’s stepmother, and her sisters from 2019 toFebruary 2023
The trial continues at 10am tomorrow (December 3), when Justice Cavanagh will finish his summing up and the jury will be sent out for deliberation.
I noticed in the article it gives the data for telecommunications for bienash and urfan but not for malik I wonder why not ?
Good summary of the story so foar
All these points struck me too. I'm hoping that the jurors are all in fine fettle today and sound of mind so this destructive trio can be locked away. Also sparing a thought for the correctional services staff who have to interface with them long after we've forgotten about them. And of course hoping the siblings get all the emotional rehab, support and love they need to reverse the generational trauma.I noticed in the article it gives the data for telecommunications for bienash and urfan but not for malik I wonder why not ?
And in the judges summary urfan replies when asked how do you know malik wasn't home . I knew he wasn't there as no sign of him having being . But yet on day he states Sara died . He says he wasn't aware malik was in the house until bienash went down stairs to get him .this is a bit of a contradiction imo .
I really hope the jury take note of the finer details when considering the verdict .
I'm glad the judge introduced causing or allowing the death of a child as it means malik can be sentenced with this at least .urfans testimony states Sara died after he got home and by stating malik was in the house it gives weight to the fact he had to have known Sara was dying prior to this and didn't get help .
What is the grey stuff urfan describes coming from Sara's nose and is this an occurrence minutes after or before death or is it part of decomposition of a body .I would have thought this process happens after death and hours after the fact as the dead body starts leaking fluid .
I think urfan is definitely going down for murder even if its only based on the fact he hit her with the pole while she was dying .this is a sickening act in the minds of most law abiding citizens
Bienash, I'm not sure if it will be murder .I think prehaps manslaughter and malik possibly allowing the death of a child.
2 of the 3 will get their just desserts as in a long sentence possibly without parole but malik might get off what I would consider lightly as I feel he will only be given between 5 and 8 years if even that .
Urfan says malik didn't spend time around Sara because of cultural reasons . For this to be true Sara would have had to begun her period. I wonder was this checked . As it seems to me urfan is only trying to create distance to save his brother
No, I'm not worried yet. I am expecting these deliberations to take some while. They've not had the chance to discuss their thoughts before yesterday lunchtime, and this is quite a complex case in respect of the various charges available and all the parties, and coming to unanimous agreement. IMOAs much as I hope the jury reaches the best possible verdict, I’m concerned about how long it’s taking. Could it be that they’re not unanimous and are still working to reach a consensus?
Which could mean some/all of the members of the Jury are not convinced of some/all of the trio's involvement in Sara's death. JMO
Is anyone else thinking the same - or is it just me?
They have not been out very long!! They only went out yesterday lunch time.I never expected a verdict yesterday. As much as I hope the jury reaches the best possible verdict, I’m concerned about how long it’s taking. Could it be that they’re not unanimous and are still working to reach a consensus?

I’m not worried yet. They’ve not had much time to deliberate yet. They’ve heard a lot of evidence and there are several different charges to consider against 3 different individuals. As much as I hope the jury reaches the best possible verdict, I’m concerned about how long it’s taking. Could it be that they’re not unanimous and are still working to reach a consensus?

Looking at the sentencing remarks in that case, Angharad Williamson was found guilty of murder because she knew the violence was happening, didn't do anything to stop it, didn't call an ambulance, and took an active part in the attempted cover up. Sound familiar? It's possible Beinash might get murder like Logan Mwangi's mother. I got the impression the step dad and his son inflicted the fatal injuries, but the mother still got murder.
As others have said, they really haven't been gone out for very long yet. The days when juries came back with unanimous guilty verdicts after a couple of hours in murder cases seem to be a thing of the past. It's probably not unconnected with the fact that we no longer sequestrate the jury in a hotel with no contact with the outside world until they reach their verdicts. Juries nowadays take their time.As much as I hope the jury reaches the best possible verdict, I’m concerned about how long it’s taking. Could it be that they’re not unanimous and are still working to reach a consensus?

On that basis surely all 3 are guilty of murder in this case?
