So glad he is getting the love, care and support that he needs and deserves after all he went through.
I cried when I read this because I have a special needs son, and I can't imagine him going through what this poor boy did. I'll never understand why parents do this to their children, when there's nothing out there that says if they're overwhelmed and can't deal, that they can't give up their parental rights so someone else can raise the child.
 
I'm glad she plead guilty. Hope she'll get a stiff penalty.

Father of emaciated boy now faces child abuse charge - February

Deputy Washington County attorney Angie Reddish-Day on Tuesday said Brandy Jaynes "is very much the primary defendant in this case."

"She is far, far and away more culpable than Russell in this whole situation according to the evidence, the victim statements, every witnesses statement. She is the one who held him the victim in captivity, did not feed him appropriately, did not provide him nourishment, kept him in the conditions he was in, and actively kept everybody else away from him — people that were inquiring about him, whether it was family members, whether it was Russell."

As for Russell Jaynes' alleged involvement, prosecutors say he was reckless for not acting sooner or seeking medical attention. After getting his son out of the bathroom, Jaynes allegedly drove around for hours, checking into a hotel and bathing his son, and then went to his father's house in Cedar City asking what he should do before taking the boy to the hospital, Reddish-Day said.

But Russell Jaynes has been cooperative during the investigation and has shown extreme remorse, according to Reddish-Day. He was allowed to visit his son in the hospital and started developing a bond with him that they hadn't had before, she said.

serious injury, all second-degree felonies, with no deal offered from prosecutors and no reduction
to the charges. Jaynes appeared resolute Tuesday (July 11, 2017) as she firmly told the judge
"guilty" three times. Each charge carries a potential sentence of one to 15 years in prison.

re the boy: Since being taken from the home seven months ago, the boy has
shown dramatic improvement, including regaining his strength and putting on weight, the
prosecutor said. "After being taken out of that horrible environment, he started to progress very
well almost immediately," Reddish-Day said. "With proper nutrition, proper medical care, proper
love and affection, he has really been very resilient and is really bouncing back quite remarkably."

I had mixed feelings about this after reading the mothers letter... and claims of remorse.

A 12-year-old Toquerville boy, whose abuse case sparked worldwide outrage after he was found lying on a filthy bathroom floor, severely malnourished and unable to move because his legs weren't strong enough, doesn't remember exactly how long he was kept in his "torture chamber," as prosecutors called it.

But the boy remembers hearing his siblings and parents open Christmas presents. Twice.

"What really puts this case in a different category is that she had a live feed camera watching him suffer every single day. That level of criminal knowledge and criminal intent is just, it’s hard to put words to it. That you could do that to your child; that you could witness that happen to your child. She can’t say she didn’t know what was happening because she watched it happening,” she said.

On the day Jaynes was arrested, the live feed from the bathroom was still connected to her phone.

As for his alleged conditions prior to being abused, she said multiple doctors have concluded there were none.

Since being removed from the small bathroom, the boy has quickly grown and gained weight. And he can eat anything without throwing-up or having any digestive problems, as Jaynes had previously suggested.
 
Oh my gawd - MsFacetious - did not realize that she watched him suffer.... no words for this "woman"....

I found out that the father will have a resolution hearing on Sept. 19th. Now I can't find the article - trust me! :D
 
ST. GEORGE — A Toquerville woman convicted in a high-profile child abuse case is appealing her sentence.

Jaynes pleaded guilty to each of the counts, apparently hoping the judge would have some leniency if she took responsibility for what she did.

But 5th District Judge Eric Ludlow essentially threw the book at Jaynes, sentencing her to three consecutive terms of one to 15 years in the Utah State Prison, the maximum possible penalty.

Ludlow called the abuse "deplorable" and "appalling," and told Jaynes at sentencing, "I’ve never seen anything like this. It's unbelievable, quite frankly."

Jaynes' attorney, however, argued at sentencing that what his client did should have been considered as one continuous criminal event, and not three separate charges or three different acts of abuse.

The case of Russell Orin Jaynes, 40, Brandy Jaynes' estranged husband, was still ongoing as of Tuesday. He is charged with child abuse, a third-degree felony.

Prosecutors have called the father's actions "reckless" but have contended that Brandy Jaynes was the primary culprit.

After speaking with Jaynes over the weekend, Flint said that rather than malicious abuse, he believes this is a case of a "family in crisis" that desperately needed help and never got it.
"There are a lot of questions we have as well, but I think it's safe to say that she wasn't trying to hurt this child out of any kind of malice or hatred, that she cares about all of her children, but she was really lost with a very difficult special needs child and didn't know what to do," Flint said.

Jaynes had set up a video camera so she could monitor the boy on her cellphone, police said, and a baby monitor was placed so she could give the boy instructions but he could not reply.

After hearing Jaynes' description of the problems she claims to have had with her son since birth, Flint shared his opinion that the boy sounds much like his own now adult son, who has autism. He also noted that, where he and his wife were provided medical, psychological and educational support for their son from an early age, Jaynes received none.
"At some point in life he should have been examined for an autism spectrum disorder, but he hasn't been," Flint said.
Jaynes confirmed to Flint that the boy hasn't been to school since third grade; he is now old enough to be in the sixth grade. At one point Jaynes said she was approached by school representatives about additional testing for her son, but that never happened.
 
So nothing updated on the "father's Resolution Hearing back on Tuesday the 19th? I'm guessing since it says "Resolution" he's is going to take a plea of some kind?

ST. GEORGE – A lingering chapter in a child abuse case out of Toquerville that grabbed international headlines came to a close in court Tuesday with the guilty plea and sentencing of the victim’s father. The father of the victim, a 12-year-old child, is also the one who saved him from over a year of abuse at the hand of his mother.

Russell Jaynes, 41, appeared in 5th District Court and pleaded guilty to third-degree felony child abuse that caused injury through negligence and recklessness. He followed the plea with a request to be sentenced the same day rather than wait on a pre-sentencing report that would make sentencing recommendations to the judge.

.....Judge Eric Ludlow went by the sentencing recommendations agreed upon between the state and defense. Jaynes is to serve 364 days in the Washington County Purgatory Correction Facility. He may be released earlier if credited for good behavior while in jail.

Jail time will be followed by 36 months of supervised probation.

The boy has since been recovering in state care, and despite having to deal with lingering leg and ankle issues, he appears to be thriving, Reddish-Day said.

“Physically, intellectually and academically he’s progressing,” she said. “I believe he’s happy now.”
..... Russell Jaynes will have the opportunity to argue having his felony conviction reduced to a misdemeanor in 2021 following the end of his probation.
