Smart characterized his one-time handyman as calculating, saying ``I don't think there's any question he knows what's going on'' and ``he's already chosen to be the way he's been.''

``My satisfaction will be seeing him behind bars, not back out on the street to hurt anyone again,'' Smart said. ``If he wants to be the way he is so be it, and let him waste away in a mental hospital.''

Kidnapping Suspect Ruled Incompetent

The man charged in the kidnapping of Utah teenager Elizabeth Smart is mentally incapable of standing trial, a judge determined Tuesday.

The decision by 3rd District Judge Judith Atherton will send Brian David Mitchell to a state hospital until he's deemed able to withstand the rigors of trial.

Attorneys for accused Elizabeth Smart kidnapper Wanda Eileen Barzee on Friday asked that she be released into the community.
Third District Judge Judith Atherton replied with an emphatic "No!"
"That's out of the question," Atherton said. "Under no circumstances would I permit her release while all these serious felonies are pending."
Meanwhile, Salt Lake County prosecutors said they will initiate proceedings that could force Barzee to take anti-psychotic medications.

Noting that not all treatment alternatives have been explored, a judge ordered Friday a hearing to determine if Wanda Barzee, accused of kidnapping Elizabeth Smart, meets the criteria to be forcibly medicated in an attempt to restore her competency.

Attorneys believe the so-called "Sell" hearing will be the first of its kind in Utah. An exact date was not set Friday, but the court is looking at Nov. 22 as a possibility.

What makes the case unique is that Barzee is not considered a danger to the community. The only reason to restore her competency is so she can stand trial.

I'm confused. Aren't a lot of cases taken before the grand jury and the grand jury decide if the person/people should go on to trial or are indicted? Doesn't this just mean that they will go to trial....when they are sane enough? How does that keep Elizabeth from testifying?

How can they be "compenent" enough to refuse medical treatment, but not to stand trial?

Does anyone know where they are in the investigation of these two for the Jaycee Lee Dugard kidnapping in South Lake Tahoe 17 years ago? She bears a striking resemblence to Elizabeth and she was taken by a man and a woman.
 
I too am glad she came home safe and sound. I have to say though that something about this story never really sat right with me.

Nope, I think her family was very loving and supportive.

It has to do more with her disappearance, the investigation and "insanity" of her abductors.
