Kouri Richins appeared stoic as the judge delivered the news that a jury would soon decide her fate. She has been adamant in maintaining she is innocent and entered pleas of “not guilty” to all 11 counts on Tuesday. Her trial is set to begin on April 28.

Almost immediately after everyone was seated, Mrazik ruled in favor of the state’s request to drop the drug distribution charges — count three and four — before moving on to the motions that required greater discussion.

Richins’ attorneys then discussed their request to sever the aggravated murder and attempted criminal homicide charges, arguing that they should be tried in separate trials to avoid jury prejudice. They also argued that the mortgage fraud and forgery charges were “wholly unrelated” to the death of Eric Richins.

After much discussion on the issue, Mrazik denied the motion to sever the murder charge from the attempted criminal homicide charge saying there is an argument that the two are connected under “a common scheme or plan.”

Live Blog: Kouri Richins asks to be released before 2025 murder trial​

Kouri Richins will remain in custody before her May 2025 trial.

Third District Judge Richard Mrazik says that, although she does not face death, she still faces the possibility of dying in prison. Because of that, he believes she may be a danger to herself or others.

He’s not granting Richins bail, though he agrees that circumstances changed and it was her right to ask for it again.

Summit County prosecutors waived their oral arguments, and Mrazik is expected to rule from the bench.

Earlier Tuesday, Judge Mzarik also denied a motion from Richins' defense team to split her attempted murder charge from an aggravated murder charge that would have forced her to face justice in separate trials. The defense team was also denied the opportunity to seat 12 jurors for trial, with Mzarik sticking to eight.
 
A newly-revealed witness claims Kouri Richins asked them if they could get her fentanyl and propofol weeks before Eric Richins' death.





SUMMIT COUNTY, Utah (Scripps News Salt Lake City) — There’s a new person allegedly involved in the case of Kouri Richins, a Utah woman accused in the overdose death of her husband.

But this witness won’t be called to the stand, as he died in a motorcycle accident just two months ago.

Richins’ next hearing is Jan. 23, when the court is expected to decide which evidence will be admissible during the murder trial.

Hearings are also scheduled for March and April to make other pretrial decisions.

As many as 20 witnesses may testify at the trial, according to defense attorney Kathy Nester.

The questioning also looked into the details of the traffic stop itself, whether or not the seizure of the cell phone was lawful, and if Richins’ actions and statements during that time were made voluntarily. Detectives were pressed on these points to clarify the chain of events and the adherence to legal protocol.

At one point, the courtroom was looking at security videos from jail in which correctional officers are seen in a cell. An officer was questioned on what they are doing with an envelop and papers.
