On Friday, Nov. 3, Judge Richard Mrazik will hear a motion from state prosecutors to keep Kouri Richins from contacting her mother and brother while held in custody. Mrazik will also hear a motion from the defense to hold the state in contempt of court for allegedly violating a court gag order.

Since Sept. 15, state prosecutors and Richins’ lawyer, Skye Lazaro, have been in a contentious back and forth over a “Walk the Dog” letter correctional officers allegedly found in Richins’ cell.

“It was an extrajudicial statement made for the apparent purpose of influencing the court of public opinion,” Lazaro said in a motion for contempt. “Such behavior constitutes a blatant violation of the Gag Order, which the State requested in the first instance. The State’s intention was to improperly file the letter to taint the media, the jury pool, the public narrative, and has the added consequence of potentially tainting expected witnesses in this matter.”

The State argued the purpose of submitting and releasing the Walk the Dog letter was as an exhibit for its request for a no-contact order between Kouri Richins and her mother and brother, saying the State has an obligation to protect proceedings from witness tampering.

Judge Mrazik will hear the arguments from both sides in person when Kouri Richins appears in court again in Park City at 1:30 p.m. on Friday, Nov. 3.

In criminal court, wouldn't the next step be to seek a change of venue for a defendant who the defense alleges can't receive a fair trial, versus a Motion for a Dismissal?

Even though KR is yet to have a preliminary hearing and the Court bound her case over for trial, granting a Motion for Dismissal without prejudice would essentially be a wash where she'd get back in line for a preliminary hearing! It's not like she's going to be allowed bail release. Not sure what KR's defense is trying to achieve here.... o_O

I was thinking same. She hasn’t even been given bail. Yet her defense is kicking and screaming. Ok then. “Whatever you say” .

I read it. It appears as though KR has that family of hers wrapped around her finger.

I am curious about her question to her brother on page 17. She asked him about that thing that he was looking for the other day. And how it did not get done. They are being intentionally vague IMO.

I also find it interesting how the brother tells her that their mom was tuning KR out when she tried to tell her that the authorities only found an excerpt of a novel she was writing. Mom sure must get tired of the lies....

She’s so full of malarkey, and she doesn’t even know it. Her “story” is as ridiculous as that old one to the teacher, “my dog ate my homework “.

I'm thinking she's not allowed contact with her mom, and we don't know about it yet.

This whole notion that "she's just writing a novel" undercuts her need to manufacture evidence from Mexico. If she offers "evidence from Mexico", it's just a novel, right? And if her brother testifies to "evidence from Mexico", what's he gonna do when the prosecutor cross examines on Mexico? He'd have to testify that KR was making it up for a "novel".

KR wants to pretend that she's basing the novel on "reality" at the same time as she's saying "it's just a novel". She can't have it both ways. Hilarious that she thinks she can.

The entire Mexico angle inarguably flew out the window.

Seriously. Her attorney should tell her to stay off the phone . All she does is incriminate herself more with each passing day.

SALT LAKE CITY (ABC4) — Prosecutors say Kouri Richins’ was writing instructions to her family on how to testify in court. Richins’ lawyers say she’s writing a “fictional book.” Either way, the prosecutors say they now want the whole manuscript — all 65 pages’ worth.

Richins, a Summit County woman behind bars for the alleged murder of her husband, Eric, through fentanyl poisoning, is currently in jail awaiting trial. Last month, jail officials found a paper that appeared to prosecutors to be telling her family members how they should testify in court.

This week, prosecutors asked the court to compel Richins and her attorneys to turn over the rest of the so-called “Walk the Dog” document, which may contain another 60 to 65 pages. However, new court documents this week include a transcript of a phone call Richins made in jail to a family member explaining the controversy.

Transcript of call to brother​

Court documents also include a transcript of a phone call between Richins and her brother, Ronald Darden, from Sept. 19.

In that transcript, Richins complains of unfair treatment both in how deputies obtained the Walk the Dog letter, and also in penalties for having it in her cell in the first place. She claims in the call she has had her phone calls limited to “voice only and only handwritten letters out, 90 days.”

She also said she was on 30 days of “lockdown 23 hours a day, no commissary.”

“Well, and they keep saying it’s a letter,” stated Richins. “It was never a letter. Like, it was part of a freakin’ book. Like, it was never a letter.”

PARK CITY, Utah (ABC4) — Attorneys for Kouri Richins, the Summit County woman accused of poisoning her husband to death with fentanyl, have asked the judge to dismiss her case, citing her inability to have a fair trial.

The petition, which can be read below in its entirety, claims the court has “engaged in prosecutorial misconduct such that a fair trial … is no longer possible.” The petition asks that:

  • The Summit County Attorney’s Office should be removed from the case
  • The venue be moved to Salt Lake County
  • Evidence regarding the so-called “Walk the Dog Letter” should be suppressed
  • Any jury should be instructed to ignore the state’s claim that Richins engaged in witness tampering.
Some of those claims are related to a document found in Richins’ cell in September that appears to instruct family members on how to testify in court. State lawyers claim the letter speaks for itself as evidence of witness tampering. Richins and her attorneys claim the letter was actually an outline for a fictional novel she was writing.

The incident has led to the court considering a “no contact order” to prevent Richins from talking to her family, an issue that will be taken up in November.
