So prior to Eric's death Kouri paid back all her lenders with interest except for one where she lost $28k. The witness also agreed that if the lender took over the property and sold it and recouped their money, they wouldn't go after Kouri.

Interested to see where the defense goes with this. They can’t argue KR took a draw from the CE acct bc she wasn’t on the account.

That would be fraud.

I guess they’re going to argue ER was aware of all this and was fine with it.

And she moved away from that line of questioning real quick before Karrington could argue that wouldn’t be coming out of his business account. That doesn’t make sense. His partner would have to agree.

Karrington is doing great! Every line of questioning, so far, is a dead end.

last couple of questions by Nester elicits objections due to the questions asking Karrington to speculate. Nester is trying to suggest because ER knea bout the HELOC in 2020 and never attempted to pay any of it off must mean he was fine with it. MY belief is that he told her in no uncertain terms he would not be paying it off and that debt was her problem to solve.

Lenders at banks can be greedy also.
IME when dealing with hundreds of thousands of loans lenders will continue to throw good money after bad simply to try to secure their investment in the long run. I've watched it happen with people my husband and I refer to as "rich on paper" but cash poor.

ER IMO was well off. KR was rich on paper but had zero liquidity and was upside down on her loans.

This is silly. Who cares if ER knew about all this debt or not? Even if he did, and had $20k in his personal account, and still didn’t pay - wouldn’t that give KR even more motive? And support that he refused the Midway Mansion purchase?

3:29 p.m. Nester asking about taxes and Kouri inflating the numbers. Nester says she “way overreported her taxes and paid too much taxes.” Karrington says whether or not she paid them is a question, but she did have high numbers. Karrington doesn’t know if Kouri’s 2019 taxes were ever filed.


3:25 p.m. Nester asks about the HELOC loans and references the graph. There is no evidence that Eric ever made a payment on the HELOC, Karrington says. Nester says Eric could have looked at the HELOC statement and paid it any time.

3:22 p.m. Nester following up with questions about Kouri shopping all these loans. The $45,000 from Chelsea was given to Kouri. Nester asks if Kouri was arrested before the closing of Chelsea Barney’s house. Chelsea gave Kouri the money in January 2022. Eric died in March 2022. Kouri was arrested in May 2023 coming out of the title company in which she borrowed $95,000 using the Barney home as collateral.


3:17 p.m. Nester back to questioning. The balance on the C&E account was routinely in the six figures. Nester asks about the Barney house and the $45,000 down payment Chelsea sent Kouri for the down payment on the house. Kouri Richin Realty had already purchased the home and was trying to refinance for better terms.

Nester asks Karrington if the money always came back in to these accounts... basically it ended with an 'agree to disagree' based on how things are worded.

Karrington talks about Eric's account where most of the 'everyday life' money was moving through (this wasn't mentioned during the entire direct examination from prosecution).

Cross examination has been met with a few sidebars...
