Note being read by Wendy Lewis - Carmen Lauber violated drug court and disclosed text messages between Lauber and Detective Maynard.

Defense put in to the sheriff about CL's supervision. Apparently two years ago CL was seen with an alcoholic beverage, and the State emailed the Defense about the incident. Defense says they've never seen that email.

Judge requires a written motion.

Moving on.

Nester says she has received reports from people that the prosecution is making faces at the jury while the defense is questioning witnesses. Judge says he has a better view than the cameras and he hasn't seen any faces. Nester says she is going to check timestamps on the livestream.

10:45 a.m. We are back in the courtroom. Jury is not. Wendy Lewis says this morning, Nester received a text message from the state that Carmen Lauber violated drug court. The defense did not know about this. Lewis asks for a mistrial. Bloodworth says he’s not aware of a text message sent this morning. Bloodworth says about ten days ago, the defense submitted a GRAMA request to the sheriff’s office asking for information about Carmen Lauber. Judge says he needs a written motion and the state can respond. Trial will proceed.

I'm watching Lashawnda Rodgers testimony right now and I have to say that her resting face when being questioned is what I aspire to in daily life. Calm, cool, and collected! What is her secret?? 😄

Like many attorneys, the Prosecution has a practice of thanking their witnesses and then adding, "the Defense may have some questions for you."

'Nuther thing the Defense whined to the judge about. 'Make them stop doing that.'

Judge (my paraphrase): yeah, not going to do that.

I'm sad that the Defense is hitting poor CL so hard.

They're desperate to dismantle her credibility.

But last I checked, it's KR's credibility that's on trial.

When I was watching The Lawyer You Know’s recap yesterday, he said that anything that wasn’t objected to and/or brought up by defense can’t be used in an appeal.

So defense will often object to crazy things and/or put silly things (like all that earlier) on the record just in case there’s ever an appeal.

Makes it clear they are VERY worried about her testimony and (I’m assuming) how they think jurors felt about the direct vs. the cross, IMO

Judge asks for defense to put this in writing.

"We're not going to do this on oral representations in the moment," Judge Mrazik.

ALSO - Kathy Nester says they're getting reports from individuals who are watching this manner on television but particularly; members of the prosecution team are making faces of the jury during our cross-examination. Judge says he hasn't seen any of that.

"The only faces I've seen are counsel at me; I think we're well within the proper bounds from what I can see from here," Judge Mrazik.

I can't be surprised that KR and her Defense team would happily destroy CL but it's still disappointing.
