The defense attorney points out minor memory lapses. At fist I thought he was making points that the witnesses were changing their testimony but it isn't that IMO the minor differences is due to time and how busy the police and EMT people are. If I was the State I would ask each LE and EMT person approximately how many calls have they responded to since this one. The written statements from these people should dispel any lapses in memory.
If Michele was half in half out of the tub, initially, wouldn't she have slid back out? Lower portion of my (female) anatomy is heavier than the top. Michele's six year old daughter drew a picture of her mom in the tub. Lying in the bottom of the tub, face up at the faucet's end.
This doesn't add up to an accidental death.
