I've never seen such an embarrassing display of "um...." (exception to hearsay? what's that? Um...) Evidence 101, every WRITING must overcome a hearsay objection!

You may have noticed that in this trial ...the hearsay rules are often disregarded, particularly by the defense. But these prior statements being used to impeach the witness are permissible, despite the general hearsay rule.

It's also not the case that every writing is hearsay. It has to be a statement usually (not a question) and it has to be used to prove the truth of whatever is contained in the writing. Then there are a bunch of exceptions to hearsay and certain items defined as "not hearsay" -- like the statements of a party opponent.

I think this guy's co-counsel is better. Where is he going with all this? He's just confusing the listeners. He does not follow up on the answers to get for the record a straight yes or no.

yes, they are admissible but it's absolutely unacceptable that the prosecution can't think fast enough on their feet to come up with a hearsay exception when trying to introduce documents into evidence.

They really should have been prepared for that.

I read that too in some Federal Pen where I assume MacNeill was housed. I think a news article stated this.
