Okay Niner! So sorry I flaked out! Work has had me going waaaaaaay too many hours. So many that I finally resigned. Now, I have some time. I will try to hit the courthouse today during my errands. I don't have access to the records without going in to the courthouse.

Checked the docket this morning. 2 developments since the last post: 1) Defense counsel filed a motion seeking in-person (contact) visits with their client, their investigator, and a computer. County jail policy apparently won't allow contact visits by investigators, and the use of computers is restricted. Defense counsel argues that the prosecutor's discovery is provided electronically and must be reviewed electronically, and that the defendant is hearing impaired and can't communicate effectively except in person. 2) The State filed a motion to conduct DNA testing that will consume entire samples. Defense counsel wants the testing to be done by a neutral testing facility, with both parties to split the costs, and want their own expert to be present.

These motions are both contested, and are set to be heard July 11.

Judge orders independent lab testing for DNA in 1988 Spanish Fork cold case

The suspect, Michael Kufrin, 61, was present at the Tuesday hearing in the Fourth District Court. He was arrested in July 2017 in Illinois and was extradited to Utah a few months later, according to a statement from the Spanish Fork Police Department.


Case was last seen with Kufrin, her boyfriend at the time of her disappearance. Her remains were found buried at a Spanish Fork home where she and Kufrin lived together.

Now, three decades after the disappearance, investigators found six items to test for DNA in her court case.

The items include possible blood stains found on khaki pants and additional swabs from the pants, an envelope, a knotted blanket and a machete.

But due to the nature of DNA testing and the sparse remains of evidence, the items being tested will be destroyed in the process.

On Tuesday, Judge Kraig Powell ordered the DNA testing take place at an independent lab rather than the Utah State Crime Lab.

Wednesday, July 11th:
*Motions Hearing (@ PT) - UT - Peggy Sue Ellsworth Case (28) (disappeared July 8, 1988; found May 22, 2017 buried where they used to live) - Michael Ignatius Kufrin (62/32 @ time of crime) - arrested & charged (7/17/17) with 1st degree felony murder.
11/6/17 hearing – Kufrin refused to be transported to court.

Just saw this case today. Thank you, Niner, for all the research you do for so many of our WS cases.

A question: Even buried 18" down, wouldn't Peggy's decomposing body have emitted odors at the time?

No matter what, I am very glad her family has answers (or maybe confirmation of their suspicions is more correct), and her remains.

I am very glad too. I do hope Kiplyn's family gets that closure soon. The area she went missing has been on fire and I'm so afraid that her body might be further damaged during it. She's been on my mind a lot since the fire started.

I'll try and keep an eye on the docket. Niner, feel free to tag me or message me once a week or so if I forget. I don't work in that county so I don't normally check it daily.
