I think you're exactly right on this. I'm thinking the attorney told them he would file a Writ. They would either have to charge him or let him go. This opinion is based on info from attorney and family that said they were denied access to Bigsby. JMO
I’ll bet the attorney was hoping for “let him go.” I don’t think he saw this coming.

Warrant: Father of missing Hampton boy admits to leaving kids alone (wtkr.com)
[...]

News 3 obtained the arrest warrant for him and it stated that he left his children that were younger than five home alone on multiple instances.

“Bigsby confessed to leaving the children alone for over 3 hours on December 13th, 2021; so he could go buy a vehicle in Norfolk. The three youngest children were left home alone during this transaction. The children were left without a means or ability to communicate emergency services,” as stated on the arrest warrant.

Bigsby informed Detective Smith that the children were too much of a burden to take out with him when he leaves his home.

A similar situation occurred on January 25, 2022, just days before Codi was reported missing.

We just picked up court documents. It shows police charged Cory Bigsby for leaving his children, a 5 y/o, 4 y/o and twin 2 y/o, to run errands twice over the last two months. These charges aren’t related to Codi’s disappearance.

I tend to hone in on comments such as these "A similar situation occurred on January 25, 2022, just days before Codi was reported missing."

It appears to me that the kids may have been left alone on the 25th. Hmmmmmm.

A different picture is emerging here. At first I believed there was a situation where Codi was somehow "odd man out" and was picked on by a new girlfriend.

This new info is a different window on this situation. It seems this man was completely overwhelmed, and completely unprepared to single parent his 4 children, the oldest being 5. When this happens to a woman, I always ask "where is the dad? Why isn't he being charged with neglect too?" It would be interesting to investigate the mother's culpability in their neglect.

. To much of a burden for goodness sakes what’s wrong with him he’s like his sister saying the last time she saw codi didn’t matter . They are so disgusting just my opinion

This does lend a little more detail into why Cory's family is so angry at the children's mother. If what is appearing to be true is actually true, he was overwhelmed and unprepared to take care of ALL these children by himself. Also, this explains the expressions on this sweet child's face. God help the motherless child. Sad sad story.

I have a day care in my home...it is unfathomable to me how someone would leave 3-4 toddlers in a house or apartment totally alone. In 5 seconds, one toddler can completely destroy a room, burn himself, run out the door, turn something over on himself, get hold of a knife, break a glass and cut himself horribly, and on and on. Not to mention a GROUP of toddlers. I full well know how hard it is to transport little ones from place to place but OMG, the alternative is ... well, like I said, unfathomable. Yet here on WS, it seems to be a regular occurrence in families.

I think you're right, that it's a regular occurrence in many families. When I had littles, going out to get the mail in my front yard is the longest I'd leave them, because yes, even while you're THERE, and watching, stuff still happens in the blink of an eye. I have seen fathers parent this way, though, and some mothers. Not aware. Overwhelmed.

So this makes me wonder if something happened the last time the kids were left alone. Maybe dad came home to find Codi had been injured/died in an accident and he panicked and hid the body. Either way, he’s still responsible for whatever happened.

I suspected he left them home alone, or with a very young sitter. Four kids, 4 car seats, you need vehicle with two back rows, kids can NOT be in front seat. Nope, he was use to being gone without the kids. Moo

Moo..something triggered dad to report him in Monday.

Could a neighbor complained to DSS, heard kids crying knowing dad wasn't home? Was DDS involved with the dad previously? Did the dad leave them frequently? moo....yes to all the above.

I think the plot will thicken. Dad will continue to deny knowledge of what happened. I am seeing more "lost" children and parents hold out, I don't know what happened. Dad is smart, 30 yo military and a sergeant, no less. He's smart enough to figure out, no body, no conviction.

It could go that way, or it could come out today what happened. The dad seems to be open to telling LE he was leaving the kids alone frequently.

I see parents hold out on information when they've beaten a child to death. It seems in this case, if he was overwhelmed and left the kids alone and discovered the child dead, courts might go a little easier. Especially if there are witnesses who say he was doing the best he could and was otherwise loving, just completely incapable.

Father of missing child Codi Bigsby admitted to leaving kids at home alone, court records show | WAVY.com
[...]

In a criminal complaint, Hampton police said that Cory Bigsby confessed to leaving the children at home alone as he visited several locations over the span of two hours on January 25, from 5:09 p.m. to 7:09 p.m.

Cory Bigsby said the children were too much of a burden to take out with him when he leaves the home, according to the complaint.

Bigsby was charged on Thursday with 7 counts of child neglect, after previously being named a person of interest in the case when Hampton police said his timeline for Codi’s disappearance didn’t match evidence collected. He was arraigned on the charges Friday morning and has not yet entered a plea. A bond hearing is set for next Tuesday, as the prosecuting attorney wasn’t available Friday.

BBM - This tells me that these are just two incidents he fessed up to when LE confronted him with specific evidence (leads from the tips they requested about Cory's activities and whereabouts with or without children) he had been leaving the children unsupervised. It seems clear to me this was a regular occurrence. Is he employed? If so who watched the children during his working hours? Was it in the apartment or did he have to load up four kids under five and transport them to and from a daycare provider? I am thinking these two incidents he admits to are just the tip of the iceberg of info that is soon to come. He's talking. So it's a matter of time MOO

Dad had no family, friends or neighbors that could watch the kids while he was out? Couldn't afford a babysitter?
It seems like Dad is talking. Now whether or not he's telling the truth remains to be seen.
He's either setting it up to look like he left them alone and Codi was gone when he got home, or one of the other kids harmed Codi while he was gone. I would bet what the kids are saying happened is not lining up with what Dad is saying.
All MOO

Are we assuming Dad volunteered this information? Could it be, the interviews with friends, neighbors, videos, social media posts, GPS tracking, cell records, the HPD approached Dad for an explanation for particular instances.

I'm bettin, forensics prove the father was not home. It was an either or, confess to leaving the kids or clam up.

I have 200% confidence in HPD and the FBI. I've seen our Virginia LE with FBI assistance pull a rabbit out of the hat, more times than not. Virginia has very strong ties and relationships with the FBI ( Quantico, Virginia) Many VA LE go on to work for the FBI/SS/HS many attend schools/training together, they are our comrades in arms. I'm confident they will turn this case inside looking for CB.

100% agree, he didn't volunteer this information. They cornered him with proof.

If this information had been disclosed on day one, even day two, I might believe he fessed up. Nope didn't hear this til day 4. I'm sure FBI/HPD have a treasure trove of exact information, video, tracking, forensics and more.

I've said on many threads, if you are ever in the DC/NVA area, take the FBI and Quantico tours. The tour is mind blowing the technology, forensic, surveillance tools, surveillance planes, surveillance tracking its scary and a comfort at the same time, their capabilities are beyond the imagination. I wonder what caused dad to have custody of all these children under 5? Do they all share the same mother? Where is she and why is she not being named in the press? While I have all these questions, I am letting LE guide who I blame for what in this mess.

I am mindful of those assault charges against Cory that were dropped back in 2019 for a physical altercation with Codi's mom when she was pregnant. There is more to the story that we may not be provided but I am pretty sure it exists.

When did he get custody for each of these 4 children? Where is the mother?
How did he end up in Hampton with no family around to possibly help with these children?
And he has 4 more? For a total of 8? How is he supporting all these children?

Respectfully, It might go either way in another state or city but not Hampton Viginia, not another Buckroe kid.

HPD have extensive experience and success. HPD was able to locate the body of Noah Tonkin, one of the most horrific murders in Virginia. He lived in Buckroe, as well. He was cut up, dumped found at the Hampton Steam Plant, the one just searched.

I, as many on the thread actually threw up and ill, when the autopsy report was released. He was reported to have "walked off", by his heroin addicted mother. The community has still not recovered and it will be years before we forget. Sentencing March 2022.

GUILTY - VA - Noah Tomlin, 2, autistic, brutally murdered, Hampton, 24 June 2019 *ARREST* #2

Virginia mom pleads guilty to murdering two-year-old son who has autism

"Imagine a baby with missing limbs, missing body parts, and a skull with just a few hair strings," said Commonwealth Attorney Anton Bell.

On June 24, Julia reported Noah missing from their Buckroe Beach mobile home.

Authorities searched for him for over a week.
.....

"This two-year-old died horrifically at the hands of the mother, who had given a story that the child had drowned and we were looking for this child," Bell said.

However, when investigators entered her home, they made a disturbing discovery.

"There was blood on a wall, there was blood on his sheets, there was blood on T-shirts," said Bell.

Julia was arrested for murder, even though Noah's body was still missing at the time.

Days later, the little boy's body was found in stuffed in a diaper box and triple bagged, decomposing at the Hampton Steam Plant.
....
But Bell says the truth is clear -- he was beaten to death, stuffed in a box, and dumped out like trash.

"I don't call this case justice, I call this accountability," he said. "This community mourns and is still mourning the loss of Noah."

No, he won't find a sympathetic judge or jury in our state. Nope, ain't happening...

All my opinion and I will never get over NT, such a beautiful, sweet angel.
