But guilty of what? The jury instructions include about 7 different possible charges.
Murder 1- premeditated
Murder 1- felony not premeditated
Murder 2- out of passion
Murder 2- in defense
Manslaughter
Conspiracy to commit murder
Burglary while armed in a dwelling
Burglary while armed in a structure
Burglary unarmed in a dwelling
Burglary unarmed in a structure
Trespassing in a dwelling
Trespassing in a structure

It’s a long list for jurors to navigate, so I think it will take all day, and tomorrow maybe too.

Yes. Basically 11 separate deliberations.

Not a quick process usually.

I have no clue how i'd fill out all those different charges. I missed it possibly. Is it burglary or trespassing if Mark gave them the code to get in? I'm torn on Murder 1 and murder 2/passion. Part of my thinks JR was a targeted hitman and was fine with it.. but then i think he was there as a helper and in the 'heat of the moment' lost control... thus the passion. I'd prefer to go with Murder 1, but i would need to read those instructions again.

Random impression -

This jury is working hard. They listened to that long readback and took a later lunch. Lunch was fast because wasn't long before they were asking for the copies of instructions.

Sounds like they elected a good foreman who is keeping them focused and on task.

Yep I agree. It seemed to me that they worked right through their lunch. Tells me they all care about the result of the trial. None of them are sleeping through this.

Mark didn’t give jimmy Rodgers permission to be in the house. Only CWW. So if the state proved he was in the home, the state proved trespassing. If the state proved he took items from the home, then the state proved burglary. If the state proved he had a weapon then he was armed.

Murder 1 and conspiracy for sure. I'm on the fence about burglary, but guilty of trespassing too.

Nothing really matters past murder 1 and conspiracy, IMO.

Say they are unanimous about the murder charge, conspiracy, and one of the others - burglary or trespassing, whatever, but hung on all others.....the judge wouldn't send them back to work on it, would he??

Re the burglary charge - are you positive something had to be taken from the home? Asking bc you would think so, but I swear I thought I heard Kyle say nothing had to be taken. I remember it because I did a double-take. I'm gonna see if I can locate it quickly on the video you posted.

No you have to choose between murder 1, 2 or maslaughter. Then choose between burglary, and lesser charges.
Unanimous on those would be choosing everything.

The way the judge said it this morning is that nothing had to be taken for you to decide JRs intent to go there to be considered a burglary, not a murder. That was my understanding. But it’s in the instructions, I’ll listen again.

Instructions on burglary begins around the 12:00 mark. "Theft OR Murder" I think that is the key phrase. OR - tiny two letter word but means a lot right here

Yes I think they just have to prove he has been in the house, and had the intent to commit a crime, either crime, doesn’t matter which.

The jury was sent back for deliberations about six hours ago in the #RodgersTrial. No verdict yet.

They either HAVE a verdict and just want to make sure paperwork is correct.... or are debating between 2. I think its a good sign.
I hope so. I am worried that there are divisive elements within. o_O
