I was under the impression that judge sherry decides between LWOP and payroll after 25 years. I certainly could be wrong.

That is correct. And would take additional time etc... I think most people are ready for this to just be done.

Thank you for your honest replies and posts tonight. You sure have made me do some serious thinking.

I think we are all such good thinkers here. I love talking about this with Y'all and stretching my brain! Dh happened to hit the Hay early because of all the dang snow he has been dealing with and I have had the night to just chill and think.

I have never sat and thought about what I would do when it comes to the DP if I really had to. Only hypothetically. Today I just decided to really ponder it as I am in that room with them. It is tough. It is not cut and dry at all. At least not for me. It is something you don't want to get wrong.
I know in the end my thoughts on it don't really mean anything, but it is interesting to work out in my head.

I've finally accepted the fact that this trial will never end now.

I was watching online and the local news was on in front of the courthouse unbeknownst to them (they were getting set up) and the female reporter was told the same thing by a male that she was going to interview. I, too, hope that's wrong. I was under the impression that the judge made a ruling very quickly as she should have already made up her mind.

Not to be a butt ... However, reports (by bloggers who lack 'journalistic credentials') lead to "telephone tag" rumors spread by a swarms of gossip mongers. THIS is the state of today's online journalism.

Uncle Walt ... Please stop rolling in your grave.

I'm sure JA would be happy with a payroll, but I'm sure even that will dry up when her easily distracted supporters, are.

Oh I totally agree. I was just sharing what I heard.

I don't want the jury deciding anyone's fate by who sits where. They should be looking at the mitigating factors. I can not fathom they could think one of them outweighs this horrendous crime.

What would make me give her the DP is ZERO remorse. None.

You're so right about the zero remorse -- and if she lives to be 100, she won't have it then, either, IMO.

The remorse, yes, and that I have no doubt that she would not hesitate to do this to someone else. If I were one of her family members, I wouldn't sleep too well if she ever were free again. Seriously.

The pictures are of a decomposing, mutilated body. The eww factor of decomposition is something I would have to factor out. She killed him, but she didn't decompose him.

She deserves the DP. I could vote for it because:

  • He was defenseless in the shower (those shower pictures would be facts for me) and died a horrific death - the photos of blood and the medical examiner's testimony would be enough for me.

  • She clearly premeditated it.
  • She was in no danger.
  • She never reported it.
  • She lied to cover it up
  • She never told the truth about what happened.

The only mitigating factor for me would be that she has no identity, no self. There is no "real" Jodi Arias. She knows right from wrong, but she doesn't know the value of right or truth or goodness. The only thing going on inside is a twisted urge to morph into everyone she meets.

I could accept a LWOP verdict because she seems so empty and dead already, but she deserves death.

She was real enough to Travis.

Well....looks like a hung jury is a big possibility. So, lets eat chocolate cake and celebrate!!

Please, can I have a huge slice? I had a very bad week and Choc cake is my downfall, with fudge icing.

Sorry, I wasn't asking for anyone to be emotional while looking at the pictures. What I was asking is to see what the pain and cruelty must have felt like to the victim and if the law is applied it would be clear to me.

Yes, I understand. The autopsy pictures are so overwhelming and unsettling. I have only seen them briefly and accidentally, I try not to see them. I feel like I don't know as much as other people about this case because I have read the books and read on WS but I don't go to very many websites since the autopsy pictures are potentially on them.

I don't know that I could be a juror. When Juan put up those pictures, I might not even be able to concentrate on what he said for the next hour, and he is a wonderful speaker.

I think you are basically right but it is rather complex really because the judge will first have to "schedule" her sentencing. So I'm guessing JSS will schedule it a month if not more later.

Then, my understanding is the reason it gets even more complex is the law was different back when the murder happened. And the judge has to sentence her according to those guidelines so if she says Life with possibility of parole, then that is what she could decide.

We know the state does not currently have a parole option and some say she can never get out BUT that is wrong if JSS gives her the LWP option. Because things COULD change. So lets say 10 years from now, the state of AZ reinstitutes parole possibles. And if JSS gave her the parole option, then BINGO, now JA is eligible because of the sentence she gave.

Her other option is LWOP and that one should stick if she decides on that.

Which is why if JSS gets this case, it complicates things tremendously. It is not just an "automatic" thing as some think. I predict at least a month delay or more if JSS gets the case.

And if others are right that the DT gets to bring on witness statements, OMG. I dont think I could take anymore of them. LOL

Yes the death penalty is something I waffle on for most defendants. But those men I'd have no problem whatsoever.

The only person I ever truly, truly wished death on besides Casey Anthony was Joshua Komisarjevsky. After watching this trial the first time, I added Jodi to the list.

No, that is the thing, she wasn't who he thought she was she was just mimicking other people. She doesn't have a personality, only a persona.

She certainly deserves death.

Isn't it truly heartbreaking how awful and evil some humans are?! I just can not understand it. I don't think I ever will.
