What next? Trial? Date set?

Looks like we will have to wait to find out, there has been nothing further on twitter as of yet.

ETA: Was looking at the wrong tab, sorry!

Both prosecution and defense say he's competent "at this point" in this article. Doesn't that seem like an odd phrase, like they're expecting him to not be competent in the future?

Trial is set for December 22 but is likely going to be pushed back. Happy Birthday,GG!

Trial date set to begin the day before he turns 18. Can you imagine? So many of us look forward to the day we turn 18 as the "day we become an adult". GG gets to look forward to the day he turns 18 as the day after his entire adult life is underway to be utterly wiped of any hope of any of the things we enjoy as adults, due to his perverted, brutal choices as a 17 yr old.

EXACTLY as it should be. Say what you want about that whole "teenagers brains aren't fully developed" and blah, stinking I don't even care blah, even 5 year olds know it's wrong to kill someone. May GG rot in jail for the rest of his natural life.

Is pleading Not Guilty the only way his lawyer can even attempt to get a lesser sentence?
It just seems like a lawyer technique. He's obviously guilty. It's a slam dunk.

they almost always plead not guilty IME, even when they confess to police. Its strategic. No chance to attempt to insert reasonable doubt if you plea out. And reasonable doubt is all it takes. Most would rather take their shot with a jury than plea out, seems like.

Trying to put myself in his parents shoes, and I just don't think I would want my son to go through a trial! Can you imagine seeing and hearing all those awful things your son has done to someone else's child!! What a horrible time for Jenise's family. Why do these scum get the choice to try get lower sentences. It sickens me almost as much as the crime. Why do they get any chance whatsoever! Jenise has no more chances, why should he. Gah it makes me mad.

bbm: ITA --- I would have thought it better if he was encouraged to ""man up"" --- less pain for everyone. Time to pay the piper and anything seems just like pampering/enabling to me. JMHO

this is what confuses me

""Mr. Gaeta meets that criteria at this time and we stipulate to his competency," wrote Gaeta's attorney, Roger Hunko.

"If forced to go through a competency evaluation I as lead counsel would advise him not to answer any questions at this time and to rely on his Fifth Amendment rights," Hunko said"

http://www.kitsapsun.com/news/gaeta-competent-to-stand-trial-for-jenises-murder_47517084

so it is HIS right not to comply with court ordered mental eval.......those very same evals that were difficult to schedule and created scheduling constipation????

ultimate gamesmanship -- shame on everyone MOO

If Jenise were an adult, he could explain his DNA by a consensual act. Since she is not, we'll see how that goes. I'm sorry honey :(
I loathe using terms like dna in cases of tiny ones . It is just not fair at all. But I'm confident now that the ball is rolling, he will never
see the outside of a prison again.

I hear ya SHCMAE :( I try to look at the legal maneuvering as just that. As described above, gamesmanship. Distasteful yes, but not unexpected. There will be no explaining away the physical evidence. But won't stop the defense from trying to or from trying to muddy the waters with distractions and untruths. Caylee's case taught me much.

To me, "competent at this time" leaves open whether he was competent at the time of the offense (crime).

And it IS a game. Perhaps he is hoping to be able to do a little plea bargaining. The DA's motivation would be to save the cost and time of a trial.

First time I've seen him in court without the jacket over his head.

He put his big boy undies on. Time to "man" up. The prison boys will love him.

Yes, but who would encourage him to man up? Remember, Mama turned the police away when they came for a DNA swab (after her underwear was found but BEFORE her body was found), because sonny boy was just so upset about his MISSING (but, as far as they allegedly knew, not dead) 'friend'.

What a empathetic young man his is. So upset for his six year old friend. So upset about a little missing girl he couldn't even open his mouth for a cheek swab.
