This guy will be charged as an adult imo.

Interesting topic. I hope he is charged as an adult. As a parent of a 20 yr old male, I wonder if I would feel the same had my son been charged with something like that at 17. At 17, he was still such a boy and in many ways still is at 20.
So, has anyone here worked in or with a DA? OR does anyone here know what the criteria is for this? Say you have two 17 yr olds accused of same crime. One stays charged as a minor and one as an adult. What elements of the crime OR elements of the person would elevate it to adult status? I've never once thought of it before but now I wonder. The nature of the crime? The ability to attempt to cover the crime? Perhaps they do psyche testing to determine maturity o f the person? Just how does that work ? Any thoughts welcome.

I knew in my heart this was the motive but it never gets any easier when reading the charges.

I don't understand the second degree though or the manslaughter charges. If he was in the commission of felony rape and she was killed then why isn't he charged with first degree? I don't know anything about the law works in that state though.

I just hope he is being held in juvie until the Judge rules this will be in the adult court system, hopefully.

I do believe he is in juvie. I do not understand the other charges, either. I can only assume LE is charging what they know they can at this point and may up the charges after all evidence has been processed. MOO

IMO, the type and severity of the crime is a major consideration. I will be stunned (and outraged) if the 17-year old is not charged as an adult. At 17, there is no way he wasn't aware that it is wrong to rape and kill a 6-year old .

I'm usually totally against charging juveniles as adults but in extreme cases I can see the need to do so.

This "minor" got charged as an adult.
It only carries a 27-35 yr sentence. Jenises killer won't get locked up for life it seems.

The most serious offenses in Washington, especially where there are aggravating circumstances, are Class A Felonies and they do carry life terms. Rape alone is a class A (Unless committed against the physically/mentally handicaped, then it is a class B with a lesser sentence. Makes no sense) and carries a life term. I'm sure there will be a few aggravating charges to this.

Ha! I'm still working with my daughter on what to do if a stranger tried to grab her. She wholeheartedly believed she is a horse, so of course she will just rear up and hit the person with her front hooves and begin really loudly. Sigh. She does neigh extremely loudly...

The first time I asked her what she would do if a stranger offered to let her play with some cute puppies and she said, "I would say no thanks, I have the cutest dogs in the world already." We got the Bearenstein Bears book about stranger danger after that!

The sad thing is though children are in far more danger of being raped or horrifically abused by someone they know and trust. Strangers only count for 5% of kidnapping, rapes, or murder of young children. 95% of the children who have been raped and abused are victims most often of their own family members... either their mothers or fathers or some extended family member. These type of victims are the least likely to tell anyone that the enemy in their lives dwells in the very same home they do.

When that happens the child is controlled by fear, intimidation, and threatened by their familiar pedophile they are to never tell a soul about what is happening to them. This is also done if the pedo is a trusted friend of the family.

So how do we get the children who are so fearful inside their own homes to come forth and tell what is happening to them?

A child is more likely to drown in water every year than they are likely to be nabbed and raped by a stranger pedophile.

Ehh, I mean the guy they arrested was probably allover the complex trying to get info. If he happens to be the same person as the driver, then yes. I think that may be the mother, but how many boys does she have? If that is not the 17 yo, then no, none of it applies.

Just found it interesting that on a day when pretty much everyone (other than people in business attire) was running around in tanks, no sleeves, and short sleeves, the driver in the video was wearing sleeves down to his wrists...with shorts, no less.

With a DNA match, innocent until proven guilty is a done deal. IMO
Judge should sign papers and gulity party should head straight to prison. there is no innocent explanation. The only reason they don't imo is because the public want a trial to try and give the DP.
It's a waste of tax payers money imo.

Off-topic, but in the Yogurt Shop murders, 4 girls were murdered and sexually assaulted. The sperm of one guy was found in two of the girls, and it matched one of the girl's boyfriend. That sure seems damning. But in fact, sperm can be transferred from one girl to another by a perp who rapes multiple victims. Trials and investigations are good. ;D

IMO This is going to turn into a very sad case, I don't think we are going to have a Tyler Holder here.

I think Jenise's parents felt a "false sense of security". Living in a small MHP and trusting of all the kids (and adults) residing there. I am sure they all went to school together and hung out during the summer, after school and on weekend. What is so sad, how many people really know their neighbors? Do people at the MHP sit outside, take walks through the park?

This is going to turn out to be one of those cases - IMHO - where everyone did "really know him" and still this happened. I think this case will challenge us to realize no one ever really can predict who might kill a child, no matter how well you know a person. Sometimes you just have to say that perps can't always be predicted, and go on and live your life the way you are because there's nothing you can do besides live in complete isolation to keep from being assaulted.

Well, after reading all day so far I've finally caught up with the thread! Like many others, I'm sadly not surprised that it's a young male who has been arrested. Gut feelings were spot on with that one. I think he'll almost certainly be tried as an adult.

We are not but it seems murky talking so much about outed on fb or twitter. So I don't know. When a boss shows up , we'll get the scoop.

I think we're going to get a lot of smacks when the bosses show up . I'm about to edit some posts and I suggest others may need to do the same re: minor charged. I don't know if we've broken a rule but it seems pretty close to.

I've tried hard not to say too much but it's really hard NOT to when we all know someone has been arrested and it was directly due to a forensic evidence match. Not to mention, the brutality of what was done to this poor little girl, and the rage it brings out in everyone. I suspect it's pretty common for those who know the arrested (not just in this case but in general) to be in complete denial and shock because the person THEY know, could never in a million years do something so horrific. Tragically, Jenise saw the side of that person no one else knew was there. :(

I really do hope this person is charged as an adult, and named publicly. I've read that he's scheduled to appear in KC district court tomorrow at 3pm, so I'm assuming we might learn more then? Not really sure how that works but as of right now he's being held in the KC juvenile jail. His case isn't on the court docket for Monday http://www.kitsapgov.com/sc/docket_page.htm but maybe that's because he's a juvenile. Either way, I'm sure there will be plenty of media (KING, KIRO, KOMO, FOX) in the courthouse building tomorrow afternoon to let us all know what happened in that courtroom.

I think so too . If there older children had many friends in the nieghborhood that were older teens and male, then they probably thought Jenise was much safer with them and that no one would try to grab her if she was in the company of one of these big , strong male family friends. A horror story :(
