This may sound dumb, but why would incest not be considered rape? Family members assault family all the time.

When a family member rapes another family member, it is rape. There are incestuous relationships that do not involve coersion, as psychologically traumatizing as they may be. Jmo

No. I've looked through several FBs over the last week and made a few assumptions. Now based on reports of "neighbor" and "family friend", I have a hunch. I'm not able to verify his age yet.

Well, I think that the fact that her remains were found on a path in the woods from the trailer park pretty much made it clear that it was a young person.

For me it was a gut feeling and the knowledge that the thing that was different that weekend was that her brother was out of town. I just kept thinking about that and decided that normally the brother would be in a position to protect her. (eta because maybe it's a friend of his / theirs was the thinking)/ The more I thought about where her poor little body was found and why a perp would leave her so close - it was the only thing that made any sense. When the police said a "favorite article of clothing" I really felt justified in thinking it was a teen. Who else prizes clothing in that manner?

I don't think there is any comparison between adults who rape adults and those who prey on children.
Occasionally there are the ones who prey on anyone, but mostly it's one or the other.

There's a really interesting passage on page 5 of this paper that says further studies are finding this belief isn't necessarily as solid or defined as past thought (which I also found surprising, because I'd always assumed that child rapists were pedophiles and targeted distinctly different victims than adult rapists), but they're finding crossovers exist in predators to a much larger degree than previously thought:

"The reality turns out to be far murkier. There is now substantial evidence for considerable “crossover” among these categories. So much so, in fact, that it is questionable whether it is advisable to apply specific victim-category labels to an offender. Multiple studies have now documented that between 33% and 66% of rapists have also sexually attacked children; that up to 82% of child molesters have also sexually attacked adults; and that between 50% and 66% of incest offenders have also sexually attacked children outside their families. "16-17, 20-21

It's not dumb. It can be confusing. The crime of incest, where it is a crime, is separate from the crime of rape. Of course both crimes can occur. But sometimes, the crime of incest is not the same as incest as we think of it.

In other words, what the law criminalizes when it comes to incest can be two consenting adults who are related, having sex with one another. That's different from child molestation. But one can also be charged with child molestation/sexual assault of a child AND incest if the victim is their relation.

Also, not all sexual assault is rape. Rape involves forcible penetration with an object or one's penis. Sexual assault can be forcing someone to perform oral sex, or doing the same to another, or fondling, etc.

Um. Just wanted to point out that there is a dead child involved in this thread. There are also two families who have lost a child, one to death and one to jail. How about we concentrate on that and stop arguing about the semantics involved in rape.

I don't think it has to do anything with being smart. In some cases, they had to test everybody from A to Z. That usually takes many months.

This has got to be devastating for the 16 yr old big brother. He probably played little league or soccer with this rapist/killer in the past. Maybe hung out together with other friends. I hope he gets some great support and counseling.

I am sure someone has said it, but this 17 yo probably did what he did becuase he KNEW her big brother was out of the county. We all speculated as much.

No blame on the parents whatsoever. IMO, there were clearly issues of neglect that need to be addressed, but this moment is not the time.

That said, I wanted to say that my discussions with my own children about personal boundaries and safety ALWAYS include the very real possibility that any potential perpetrator could be an older child as well as an adult-male or female.

Most violent crimes are commit ed by family members or close family friends so I can't see it as being any better. Children need to learn to be independent and how to problem solve and being sheltered from the world doesn't help.

Of course a little more supervision would have been desired in this case, it is hard for me to judge the parents without knowing other details. As I mentioned earlier, I grew up in a similar way. I lived on a dead end street and almost every house had kids and we all played in each other's yards, went into each other's houses unannounced, had snacks and meals together. Every summer we blocked off the street and had a block party. In the summer I woke up and went outside to play and I only came inside for lunch and dinner and when the street lights came on.

This is how I imagine the mobile home park in this case but again that is JMO. People like to assume there is more crime these days vs 40 years ago but that is just completely false.

I'm sorry. I respectfully disagree.
These, are not new parents, nor our they young parents.
They've both been around the block [so to say]. This little girl should have been tucked safely in her bed by 11pm at the latest, and checked upon by at least one of her parents by 10am the next morning.
We're discussing a 6 year old child! Not, a teenager! Even if Jenise was a teenager, I would still be appalled by the lack of supervision by her parents.

One more thing, while I'm on my soapbox here.
I personally would not care if her killer was 12 years old or 70 years old.
The end result is the same.
Innocent, unmonitored CHILD is abducted, subjected to horrors, then murdered.
Should the guardian's of a 6 year old murdered little girl get a pass? Imo. Not in this case.

I get what you are saying Kali, and I don't completely disagree with anything you said. But kicking someone when they are down, is just fundamentally wrong, period.

In yesterdays press conference they said they would be getting results in 24 hours, I believe. The did. So be it.

• Will not release his name at this time
• At 2:50 pm made contact at his residence and arrested him without incident.
• Crime lab made positive confirmation through forensic evidence.
• Suspect was a resident of park
• Suspect is currently being interviewed.
• Resided with parents, at least one parent was at home.
