I missed out on a lot of this yesterday afternoon because I was out sitting on a riding mower, sweating like hell and drinking large quantities of beer (it's a medical condition :happydance: )

Is there any good reason discussed so far why this would have been only a second degree murder ? And why the manslaughter charge as well ? That usually infers that it was some kind of accidental thing, not necessarily planned out.

I don't understand why this isn't first degree murder all the way down the line.

Somebody educate me.

I think he "only" intended to rape her and she died because she was face down in the mud. Thus the in intended death. Not that that does anything to lessen the heinousness of his crimes.

I think i have fixed the issue with my WS account

Yes there is another person with the same name and also star athlete.

I wonder what it was that got him nabbed. I don't think the DNA would have come in that fast after finding Jenise. The apparel clue and the mud info....did someone phone that tip in? Did he ditch his shoes? There is something up with the vehicles too. Did he take his clothes and ditch them elsewhere? What about her clothes? Did he ditch those because he left DNA on those too? Did he drive with his muddy shoes?

It was the DNA evidence that got him nabbed. Then LE went there with a search warrant, took more evidence out, towed three vehicles looking for more to connect him to this child's murder..

My guess would be he did not plan beforehand to take her life. I think he planned to 'assault' her ( im sick of the other word and cannot use it in regards to this baby, i'm sorry ) Then at some point during /after committing that crime , the murder became necessary and/ or was not intended but a consequence of the previous crime. We will see . I'm more curious by two crimes causing death. That one has me scratching my head. 2nd murder AND manslaughter. I don't understand.

And they are basing that on what, his word, his statement ?? I would think he would try and paint himself in the best light possible. I don't think they ought to be trusting anything he has to say about anything. I'm sure his version of events is going to be the real gentle one.

:moo: iirc on another recent case this was discussed. That LE may do such as 2nd degree during the commission of a felony ups the bail and the time etc. (or impetus to charge him as an adult?) It may be too soon for LE to have alllllllllllll their ducks in a row, and can prove all of these for the bail hearing. Charges could be upped later once investigation continues. :moo:

ETA: Glad I had all the mooooooos as it appears that others are more in the know

LE stated at Friday's presser that they would get results out in 24 hours, correct? I am fairly sure that is how they found their suspect.

It's alleged that he is a friend to the family. I don't believe that was his intent, to rape her and let her go knowing she would tell on him..SMH

I think this might not be his first time doing this.

I think LE might have seized some cellphone footage from Saturday night

Right and in most states , maybe all, Murder ONE requires " pre meditation'' meaning they intended to do so before meeting or encountering the victim.
Not if it happens during the commission of a felony...such as a rape.

If the Prosecutor takes it to The Grand Jury that is the only way charged can be increased. A Grand Jury must return a true bill for indictment...

That's really fast. She was found Thursday morning and DNA was done the same day and he was arrested 2 days later! JMO

If he was grooming her for some time, which is highly possible, he very well could have thought she would not tell. If he planned it I think he would have done things differently. I think he was in total panic mode and tried to hide her as fast as possible.

No clue, dude. I'm speculating with everyone else. Often the charges someone is arrested on can change and morph and grow as more evidence and statements are collected. Arraignment on Monday morning should tell us more, assuming that's how it goes in WA state.

Authorities put a rush on the results. They had to find this beast who murdered/raped this precious child..

Do we know when Jenise's big brother went out of town, where he went or why? Just curious.

  • #738
I still don't understand why they wouldn't have hit this guy with both barrels and then maybe pled it down later on. Start with First degree and work down.

No doubt. I guess LE had other info that was not released at all and they processed only the samples of their flagged people i.e. male teens. JMO

1st degree murder has to be brought to The Grand Jury...They are the only ones who can issue an indictment, based on evidence for a 1st degree premeditated murder charge. It might come later...
