In the legal sense, I would agree. But Psychology and Pathology are much more complex than simple definitions might imply, and one-off'ers would likely be defined differently.

Im wondering if there is going to be a plea deal. It sounds like LE has DNA...open and shut. Anyone think they will let him plead guilty to 2d degree murder as a juvenile?
This early in the game, before the investigation is complete...no and def not as a juvie. jmo

Per my hubby...and this is just his opinion, I showed him the pic of the vehicle (he knows nothing of this case!) and he says it looks like a Dodge truck that is 4x4...there's a 4x4 shifter to the bottom right of the steering wheel (we had a Dodge 4x4 :) )

What I noticed is that he is charged with 2nd degree murder not first. I have to wonder if that means he did not mean to kill her and she dies accidentally? Even if he killed her after assaulting her and was afraid of discovery, If he then planned to kill her that still could be 1st degree.

17 yrs old. It is just so sad and disturbing. Breaks my heart. Not for him and what he faces but what led him here. He deserves his punishment and his time but still when I see kids that ruin theirs and other people lives when they are just starting to live, it breaks my heart.

Im glad they have him and I am glad that her family can have some closure and have the spotlight off them.

But there was a charge of RAPE. So why do you lean towards not a rapist?

ETA I don't even understand what you mean. Are you saying that a boy who gives into his urge and has sex with ANYONE , but does not kidnap them is not raping them? Or I feel you must have left out a portion of your thought, because I can't ...... I'm perplexed at this statement.

I don't understand that thread or logic either? What am I missing?

Can someone with knowledge of the subject address whether the killer is more likely to be a sociopath or psychopath? What are the differences? Specifically, I am curious to know whether one or the other never smiles.

If anyone thinks the TOS are unfair, this is actually a perfect case to look at . Initial reports about dad had many trying, convicting and sentencing him. But things are not always as they appear.
They also sleuthed and posted his criminal activity which is absolutely against TOS. He was never named as a suspect or person of interest by LE.

No! That post wasn't about HIS mother. It was a member sharing a personal story that happened in their life and that perp had a mother that ran a daycare out of the home.

That is a rapist. Comments like that drive me crazy and are insulting to men and teenage boys. They are completely in control of their actions. Yes, at that age, it pops up and says howdy at inopportune times, but 99.9% of men and boys manage to control their "hormonal urges" as you call them. Those aren't hormonal urges, they're the thoughts of a rapist.

^^^ THIS. Rape is rape is rape. Spur of the moment or premeditated, it makes you a rapist. There is enough talk about this in the media in general right now that this really shouldn't even need to be stated here.

Now, for him to be charged with rape, I would imagine that would mean that he forced himself on her and penetrated, wherever. That is rape. That isn't an accident or "boys will be boys".

I think the crime happened Saturday night and she was left in the woods Saturday night. I don't think anyone saw her alive Sunday. JMO and hunch, not reported facts.

Generally speaking, people tend to use the terms interchangeably, but a sociopath has emotions that vary wildly, a psychopath basically has no emotions. Sociopathy is believed to be influenced more by nurture whereas psychopathy is believed to be nature. (Sociopathy-environment, psychopathy-genetics)

ETA: Oops, didn't answer your specific question. A sociopath would be less likely to smile than a psychopath, but the psychopath would be using it to manipulate people while the sociopath would be happy when s/he smiled.

I know! It reminds me of recent political discussions by politicians that claim there are "degrees" of rape! GRRRR!!!

Has anyone thought of the idea that JW might have wandered out of her home and happened upon the perp in the woods or in a vehicle while he was involved with doing what teen boys do (self) and that the perp gave in to a sexual urge and he is not what would be considered a 'rapist' but simply a teen who gave in to a hormonal urge and fear of reprisal or punishment?

My thoughts lean in that direction because there was no charge of kidnapping.

I would but I am too lazy right now to type the differences. You can google it and I believe we had this discussion earlier in the threads. (I think it was this case). If this is the accused first crime and dependant on other factors, which are quite numerous, I or anyone else here are not qualified to make any such diagnosis. The assessments for such are quite lengthy.

I personally would prefer the word accused as opposed to killer. The case has not been tried yet.

Exactly! Even if she went willingly with him, or was not kidnapped (which charges might still be added), it is still rape no matter where it took place. It could've been in her own bedroom, his place, or the dump site. It's still rape no matter what, even if he used an object.

I wonder what makes a person voluntarily do this? Did he think somehow they wouldn't match? Did he just assume they would catch him anyway, so he might as well not attempt to hide the fact? Did he think that by not refusing the test he would eliminate suspicion? I guess it's just another part of the criminal mind us regular folks can't fathom.
A teen imo easily believes they are smarter than everyone else and will never get caught.
There is no way around DNA, but to a teen, I am sure he had some wild idea in his head to explain it away... :dunno: Maybe he thought the mud would make his dna disappear in a day or two?

His past was reported on every news channels that reported the story. Not much sleuthing if you ask me.
