I saw it differently. The perp may not be a serial rapist yet, this may be his first time-but I got the impression that therefore the OP was trying to say that because he was an opportunist, maybe didn't kidnap her, that this wasn't rape. A boys will be boys defense- he was just being a hormonal teenager acting on his urges.

I agree that he would have gone if not caught. Sadly , little J, may have prevented many more victims

In the legal sense, yes, RAPE. But the perp might not posses a rapist mentality in the sense that he purposefully *raped* as opposed to a teen involved with himself and being happened upon by JW and succumbing to a biological urge that resulted in involving JW.

I am only noting that Diminished Mental Capacity is a mitigating factor in some circumstances in some jurisdictions:

LinasK, I noticed in the last thread you said Westfield murdered little Daniele Van Dam because her mother had rebuked his advances at a bar. I kept up with that case or I thought I did and I have never heard that was the motive. Do you have a link where that was brought into the trial as the motive?

I really don't think revenge makes someone a pedophile who is capable of raping a young child. They have to have those tendencies to begin with and wasn't it known that he had gone into the room of his underage niece and sexually touched her inappropriately when she was in bed before he kidnapped DVD? And didn't he have child on his computer? Imo, Westerfield was a closet pedophile until he ventured out of his comfort zone and targeted Daniele.

I read that he targeted DVD because she had come to his door selling girl scout cookies right before he kidnapped, raped, and murdered her.

I don't have link, but I did follow the case. She may have gone to his door selling GS cookies, but I know the parents were under a microscope for their swinging lifestyle and it came out that Westerfield had propositioned the mother in a bar and she rejected him. Also Danielle's parents did not check her bed and assumed she was sleeping when he kidnapped her.

I am sure the LE, FBI and Child Protective Services had their suspicions as well.

It certainly appeared that way. And he did himself no favors (IMO) when he gave the "spoiled brat" interview.

How on earth can it be posited that someone who gets sexual gratification from a child was simply finishing up a self-indulgent moment. Yes, teenagers masturbate. A lot. Sometimes they even do it outside. The don't "finish" on six year olds unless they're pedophiles and rapists. The normal teenage reaction to being interrupted during a moment of "self-reflection" is shock, embarrassment or quickly coming up with a cover story "Um… um… I was peeing!" or "I had a really bad wedgie!" not raping and killing the person who interrupted them.

Perhaps his brain works just fine but he is of the same mindset, that if a human being happens upon him when he feels a sexual urge, he has a right to act on it, because being such an overwhelming urge for him, nothing else matters?

I think you need to keep in mind that many of us here are survivors of rape, incest and sexual abuse. So some might feel offended by the way some of this has been worded. Like calling him a 'normal teen responding to normal biological urges.' It is a sensitive topic.

I included the mailbox baseball and skitching wikipedia links to show I wasn't annoyed at your request, I was just to busy/lazy to track down peer reviewed articles. It's hard to make art, sift through peer reviewed articles, watch TV and sleuth at the same time. And seriously, no one with a fully formed prefrontal cortex would think skitching was a good idea, IMO.
