Family Says They Are Unfairly Targeted In McCleary Search

After two days of intense searching at a home and property outside McCleary, investigators said it appears they found no significant evidence that will help find 11-year-old Lindsey Baum.
The owner of the property told KIRO 7 reporter Richard Thompson that he’s contacted a lawyer about suing the police and the media saying they had no right to put the family through the search.
Baum’s mother said she is disappointed that her nothing was found relating to her daughter who has been missing for three months.
"I was obviously really hoping something would come from the search," said Melissa Baum.
Law enforcement sources told KIRO 7 among the evidence collected during the search were condoms, pornographic magazines and a car was also seized and will undergo further forensic testing.
The homeowner at the property said his family has been unfairly targeted in the search, "They didn't find anything here because we didn't do anything to that little girl."
Relatives confirm a man at the residence was the focus of the investigation and search. One of his relatives said, "The only reason they were doing this search is he gave a wrong answer to a question by a detective on the telephone." - snipped

Hi TakeNote...Not sure what you mean by 'speaks volumes to you'. It says nada, zero, zip, to me. I believe a large portion of American households would have condoms and 🤬🤬🤬🤬 magazines...I see nothing illegal....not yet!

Although I'd have a fit if I found them in my home, I don't think condoms and 🤬🤬🤬🤬 mags are that profound. The schools teach boys to use condoms and with all the "stuff" laying around that property, who knows about the 🤬🤬🤬🤬 mags? Are they Playboy? Or are they something more sinister? If they are "extreme 🤬🤬🤬🤬" or child 🤬🤬🤬🤬, then Houston, we have a problem! JMOO

LOL Yes, I see you still have your magnifying glass front and center. ;}

I must say it did spark me when I read it and wondered why in the world they mentioned that in the article when it seemed quite out of place with the other things taken. Did they mention if a computer was taken? :waitasec: Info like that would be more appropriate I would think. IMO in fact it almost gives a journalistic slant to the article.

Red by me -

I never saw it stated anywhere they ever denied to be searched. Maybe this place was searched with consent prior, we don't know. My thought was the search warrents were issued so LE could obtain possible evidence that they could remove from the property, not because a request to search wasn't welcomed.

As for not being interested in finding Lindsey, I have seen nothing that would lead to that assumption.

I agree, we should wait and see what the forensics reports show.
If that were the case...they would not be threatening to sue LE for doing the search, imo.

I've never even heard of someone threatening to sue over a SW before. Perhaps it hasn't ever made the papers?

Relatives confirm a man at the house was the focus of the investigation and search. One of his relatives said, "the only reason they were doing this search is, he gave a wrong answer to a question by a detective on the telephone."

Detectives insisted Monday they were acting on credible evidence when they got the search warrant for the property on Friday.

Lindsey's mother said she understands the family's frustration, but her daughter's life is at stake.

"If they end up being completely innocent, I'm sorry. But at the same time, my daughter is missing," she said.

Actually, the owner was not targeted and treated unfairly if the man gave a wrong answer to LE on the phone. LE usually do not ask questions when they do not already have the answers. If the answer was not the truth and since they had obtained other evidence for Probable Cause then the owner should not have a legal basis to sue them, imo. I would bet that LE followed every letter of the law on this one.

MB is right. If this family were truly interested in helping find Lindsey, they should have welcomed the search. Opening up your property to do a search was asked of most people in McCleary early on and this is no different, imo.

LE did take the legal route in order to conduct a detailed search instead of simply asking. A little girl is missing and if LE had enough to get SWs to do the search then it wasn't over some rumor or one wrong answer. Let's wait and see what the preliminary tests show on the evidence taken into custody. It isn't over yet.

So glad to see that at least THIS board has not been manipulated and that reasonable deduction still prevails.

Okay, I admit I peeked around tonight so I didn't feel I was in the dark. I didn't see anything that gives us clues as to what happened to Lindsey, however. I'd like to see all forums continue to sleuth for answers and not worry about the gossip and stress going on in McCleary.

:praying: ~ for the community of McCleary.

Simply because nothing jumped out at LE on this search does not mean anything. The car, imo, was the most important piece of evidence they took in from this search. It is reasonable to believe Lindsey was taken away in a vehicle. She may not have been taken to the houses or that property.

I don't hear LE saying the members of this family have been cleared yet and I have to believe it is not an oversight on their part. They are not finished investigating this to a conclusion either way, imo.

LOL with all that isolated property you would think LE would have found an acre or two of marijuana growing, child 🤬🤬🤬🤬 on the internet, or something besides condoms and 🤬🤬🤬🤬 mags. Hopefully the warrant is based on probable cause and can be justified if need be. And even more hopefully, no suspicious guilt has been cast on the innocent. moo

Very true. IIRC, one of the media links said they took out bags of potential evidence.

Pssst. Don't you mean Probable Cause? LOL

I haven't either Kimster. Lindsey seems lost in all that.

I've been thinking this case might end up hinging on the small things. Something out of order or where it shouldn't have been placing the perp at the crime scene. A small easily overlooked connection tying the perp to the victim. A unique Modus Operandi used to create an opportunity.

That is when they name a POI and start putting their case together. xox

Like Kimster brought out.....a lot of homes would have things like that....in it self doesnt really mean anything....

what got my attention is why would LE think it was important to take them??

would those things be something that they would just take....or did they need them to compare to other things that may have been found some where else...

i was thinking like the time.....there were beer cans found at a scene....(older case solved) and that led LE to finding who the perp was....by finding the brand, then finding the place that sales them.....then finding tapes from the place ...that had the perp on film....with time and day the perp bought them.....

just curious.....it could of been anything....like cigarettes, beer, soda pop....anything like that.....:) ....i would still want to know why did they take that.....:)

When I was on my ride-along, the deputy said Oregon is one of the strictest states when it comes to search and seizure. I wonder how Washington is ranked?

I was pretty surprised to learn about the "scrub lady" search in the Haleigh Cummings case. Maybe they were able to obtain permission for that search because someone just dropping off a letter to a newspaper wouldn't be enough for a SW here, I don't think. I hope they had more to go on in McCleary.

Excellent point, Take! They weren't illegal so why did they take them? :waitasec: It would make sense if it was to compare as could be done in the case with the condoms, but the 🤬🤬🤬🤬 mag?! Are they looking for DNA perhaps? (Ewwww) I can't figure out a reason to take the magazine other than that one tho.

With the condoms, they can match lot and batch numbers. What can they match to a 🤬🤬🤬🤬 mag?

I fully expect the computers to have been taken into custody, but the news didn't mention them.

  • #457
oh...i wanted to add....we do not know what odd things have been found in odd place around there.....and they may need to connect the dots :)

remember its a puzzle that has a bunch of missing pieces and we do not know all that LE has and how they are putting them together :)

i was thinking about that also...unless they found a mag some where else...or they seen someone elses name on the address part of the mag....and were trying to connect someone else to the person who had the mag....

the mag could have been one of those with much younger girls as well or the more violent kind of context

NIX SS as I had almost the same thought as I finished that last post.

Maybe where they searched was an 'after the fact' location and not a crime scene. Maybe they had deduced this by whatever the probable cause was they had to secure the warrant. We know almost nothing right now.

Last night I was watching the Food Network and saw how they harvest walnuts. They have a machine that literally shakes the tree. It was almost karmaic for me as I thought of Lindsey and maybe that is how her case would unfold to reveal her and nail whoever took her.

PS: I can't spell worth diddly tonight on my 4 hours sleep. Off to bed but will see you tomoz. <<Hugs>>

Yeah, I also wonder about the type of 🤬🤬🤬🤬. The condoms could be something they always take, like vaccuum bags and dryer lint are pretty standard items that they take during a missing person SW.
