Okay finally an article on what is going on here!

Trial starts for Belfair man accused of murdering intruder found in shower

SHELTON — The trial of a Belfair man charged in 2017 with murder for shooting an intruder he found showering in his bathroom started Thursday [(10/31)], with his attorney arguing both that he could not form the “criminal intent” to commit murder and also that he had acted in self-defense.

Fanning’s attorney, Richard Woodrow of Olympia, told the Mason County Superior Court jury that Fanning would testify in his own defense and elaborated on Fanning’s mental state, including a below-average IQ and an anxiety disorder that leads him to live a solitary, nervous life.

Experts who interviewed Fanning reached opposing opinions on whether Fanning could have formed the intent to commit murder.

David M. Dixon, a psychologist hired by Fanning’s lawyer to evaluate him, wrote that at the time of the shooting Fanning was “petrified, startled and in shock” and “did not have the ability to premeditate or form an intent to kill.”

Psychologist Cynthia A. Mundt, who works for the state Office of Forensic Mental Health Services, also evaluated Fanning and found that he “likely experienced impairments in functioning due to anxiety and panic,” but that there was no evidence to suggest he was unable to form the “mental state of intent.”

Jurors are expected to hear testimony from both experts.

The fate of Bruce Fanning, a man who admitted to shooting an intruder in a shower on his Belfair property in 2017, is now in the hands of a Mason County Superior Court jury.

Attorneys presented closing arguments Tuesday to the jury that will now determine whether Fanning is guilty of first-degree murder.

A first-degree murder conviction would require the jury to find Fanning had intended to cause Rosa’s death and that he had premeditated that intent. Fanning’s defense lawyer, Richard Woodrow, argued that Fanning couldn’t form the intent to kill due to an anxiety disorder and was acting in self-defense.

If the jurors can’t agree that Fanning committed first-degree murder, they’ll consider whether he’s guilty of second-degree murder or manslaughter in the first or second degree.

According to state law, the maximum sentence for first-degree murder is life in prison and/or a $50,000 fine. In this case, Fanning also would owe restitution, according to court documents.
