BBM Will you be providing condiments, counselor? Thanks for the legal take on the "journal" issue -- goodness knows few of us believe that it accurately reflects events as they occurred at the time.

You know, I think about what my journal would look like -- if I had either the time or inclination to keep one -- and I know very well it would be useless if at some point in the future I was accused of a crime. Sample entries would look something like this:

Monday: Well today I thought I had a dental appt but I guess it's tomorrow maybe. Probably mow the lawn if it stops raining. I had an idea I wanted to write down but I can't remember it. Oh,
Tuesday: Guess I never finished yesterday, I'm tired, thinking about lunch. What was I supposed to do after lecture? I need to get that book from the library
Wednesday: Missed my dental appt. yesterday. Rescheduled it but I don't remember when. Forgot to mow the lawn. Need to remember to buy something. Where is my
Thursday: Finally found my pen.
Friday: DW reminded me about some appt. and I need to write it down. It's on Monday, but I don't remember what month.

I have to agree. I really, really want to like him but this prosecution team, to me, seems just all over the place. As you say, the evidence is there, the facts are there, hammer those home and let's get done with this!

Between battering the witnesses for no real apparent reason (I can understand getting angry here and there, but not constantly), long, involved questioning of the 'specialists' (only one question to ask here, of either of them: "Are all of these speculations you have given us based on the story Jodi Arias told to you?" Answer: "Yes". "Prosecution rests.") and the cane-signing and picture taking I'm having real trouble understanding the point of any of it. And that was before we even got to Snow White.

I think he's just doing what he gets paid to do but I will say this:

To someone who doesn't know him and doesn't follow these things all the time, he does come off as arrogant and belittling to the witnesses at times. Going by history, we know that anytime a lawyer does that, state or defense, it doesn't play well with the public and it certainly doesn't play well with a jury. Now in this case it may be a moot point because IMO it's a pretty open and shut case.

Here's an example. I followed the Nancy Cooper case. There was this one witness for the defense that was adamant that she saw the deceased after the state claims she died. But when she got up on the stand, the prosecutor didn't nail her to the wall during cross examination or belittle her. He just talked with her, as if they were both sitting on the porch watching the birds. After awhile you can tell she never did see Nancy. And that information came out in a way that the jury could appreciate without making the witness look like a fool.

All prosecutors have their style. JM's style is what you see and you either accept it or not. If he has a long track record of convictions, then obviously it works for him.

Hope I'm putting this in the right place. First time caller, long time "listener" to WS. Really enjoy the insight!

I just have a few minutes, so I'll have to come back to see if there are any replies, but I have two questions/observations:

1. If LaViolette had a talk entitled "Was Snow White Abused?" and it wasn't really about Snow White being abused, then that is misleading. And misleading is what this lady has been from day one.

2. I haven't heard/seen any comments on how coerced Travis looks in the shower photos. He looks cowed and afraid. In one, I think he seems to have the beginning of tears in his eyes. Wouldn't this be an important part of the trial? Maybe someone has covered it, and I didn't see, since I've only been watching since Arias came to the stand. I knew that was crazy in and of itself, given the circumstances, so it was like a car wreck - you want to look away, but your curiousity gets the better of you.

So, what are we saying, that the prosecution should stay home? It's the State's right to challenge the witness on points that they know are incorrect and bring that into evidence for the jury to consider. Once outside the courtroom the prosecutor is entitled to the same rights as anyone else. He just can't talk about the case. The defense, however, can talk all they want. Problem is no one from the press wants to talk to the defense. What really surprises me is that JM never asks the judge to treat the witnesses as hostile because is certainly how they are behaving. jmo

Something about her being there doesn't feel right to me. I can't quite put my finger on it but it makes me nervous.

Hopefully I'm wrong and she's there to support Travis's family.

I feel the same way. I'm concerned.

We don't know what she's up to, IF anything. Apparently, she and Travis' family believe she didn't do anything wrong, and yes, she has the freedom to be there.

So! Maybe she will mind her p's and q's and not create a problem..................but we must also remember that OTHERS can create a problem around her (a statement, yelling, even inappropriate looks) and if it's in front of the jury, it might create a problem for the Court. I'm sorry, after watching Donovan and the laughing ladies' row yesterday, I can absolutely see someone trying to cause a problem. Doesn't anyone else????

Also, we know that more than one juror (supposedly) told the court of something this ex-juror did, that caused her to be dismissed. Wonder how that made the sitting jurors feel, with ex-juror now watching them? If it were me, I'd feel awkward, maybe a little guilty, I don't know.

So, IMO only, why is it worth the risk? I wish she'd stay away so that the DT has NOTHING to complain about. It's my hope that yesterday was her first and last day of attending trial, at least until the verdict. JMO

I am so happy right out of the box JM got that straight with ALV. He wants answers to his questions She has spent all her time shaking her head yes or no in accordance with JW. Now she will earn her 300.00 per hr. This is what she should have been doing all along. Go JM:)

I'd be prepared to bet that all her diaries were seized in the beginning and photocopies made so you would be able to compare to the originals in any event. However that's not to say she didn't spend three weeks doctoring them knowing full well they would be brought into evidence. That JA even mentions the diaries in her interview with Det Fl makes me think she really wanted them read.

I hope video of her pointedly directing Flores' attention to her journals appears during rebuttal. She tells him they're in "my bedroom safe" iirc. Guess Gramps and Meemaw were snoopers too.

Wow! It's amazing how it just so happens she mentions all the pertinent points of her testiphoney in the 5/22 journal entry. Phone stolen - check. Mimi - check. "Scandalous text message - check. Recorded phone calls - check. She even says she never figured out how to play back the phone calls for him and goes on and on about how she doesn't want those calls and messages to come to light - yeah right.

And she called him bi-polar - suuuuuurrrreeeee, he's the bi-polar one!

I'm sure she doctored those journals before she was arrested. Maybe she even made the whole dang things up. I put nothing past her.

Has the jury seen the journal entries from June 10, 2008 and later? I'm pretty sure they were presented in the Prosecution CIC to further demonstrate her cover up tactics, but I'm not entirely sure. If someone can confirm that would be great. I'm trying to keep straight what the jury knows vs. what we know.

If the jury sees that she fabricated her journal after the murder than they clearly can make the leap that the rest of the journals pre-murder also contain fiction/cover-up.
