Why is Adam Baker not in jail?

Just listened to the show. That was the first I heard of blood splatter being all over the walls. Not that I'm surprised at all.

i've mostly been following the case by lurking here and may have missed any discussion of blood on the wall.

IMO

I think the 'blood splatter on the walls' was an exaggeration or assumption which does happen on these shows from time to time, I am not aware that we know that to be the case. They took portions of the walls from the home, this could be for a number of reasons IMO.

Love you Levi, but not sure about this one.

Yes, it was widely reported that it was not just blood, but human tissue, and hearing aid parts were found in the house. Plus a blood splatter expert was used.

Additionally, Zahra Baker's stepmother, Elisa Baker directed police to the bathtub drain located in the family home, where they would find bone fragments and tissue. Law enforcement related that after entering the home on October 27, 2010, the massive amount of blood and tissue found in the home necessitated their request for a blood splatter expert on October 27, 2010.

Sorry Levi, wasn't denying the blood evidence found in the home, just that the line 'the home was covered in blood, the walls were covered in blood spatter, he had to know' at 7:45 sounded like blood was on the walls themselves. ITA that there was extensive blood found in the home, just that we are not SURE where exactly or of what type and where.

This is the first that I have heard that EB was being held on child neglect charges! Is that accurate??

The step-mother, Elisa Baker has been formally named as suspect and is currently being held for child neglect; however, neither Elisa Baker nor Adam Baker have been charged in connection with Zahra's murder at this time.

Not sure what Suite101 is, perhaps another site like Associated Content where people just submit stories that they write?

I read all of the unsealed search warrants and I don't get most of the information in this article from them, in fact there are glaring inaccuracies all the way through the article, so I don't take this to be a credible source for information.

Didn't really know where to ask this, just picked this thread....

Any update by a local or from MSM as to whether or not KB is still in NC, staying with AB? I guess he is still around town and hasn't flown the coop? Is he working?

"Adam Baker was arrested on Oct. 25 on unrelated charges of writing bad checks and communicating threats. He was released two days later after posting bond.

Catawba County Sheriff’s Capt. Mark Shook told the Observer that immigration authorities contacted the jail hours after Adam Baker was released and informed them Baker was in the country illegally and should be detained.
Immigration authorities declined to discuss the case but said they typically don’t get involved with immigrants who are involved in U.S. criminal investigations until those cases are resolved.

Both Elisa and Adam Baker deny any wrongdoing in Zahra’s death."

I do not understand why he was not picked back up then, and detained under immigration law until he is either charged or cleared of involvement in his daughter's death.

educated guess

one being logistics
the other being i would think the investigation would overrule the immigration issue

I do not think NC or the US wants him facing immigration issues at the moment. By charging that we say to Australia, that is what we are charging him with. It invites an argument about who charges him and puts the immigration/extradition thing on the table when Australia made it known that they have deterrmined he was here fraudulently. we don't want him facing immigration charges. Australia was letting the US know that if we want to charge him then we should get moving on doing so. and BTW if NC does not charge him or is unable to incarcerate him on crimes for Zahra, tor if he is incarcerated for a bit on the more non violent charges like checks that they want him when we are done. My own interpretation of what that was all about.

OK, kind of get. I was just not understanding why if by law he is here illegally how he can still be free under any circumstance, KWIM, kinda? lol

It says within the article that you linked:

(That would be US immigration authorities, as they are the ones concerned with whether someone is in the country illegally.)

Authorities confirmed for the Observer that Zahra's father is in the country illegally. He moved to the United States with his daughter in 2008 from their native Australia, where Adam and Elisa Baker had married after an online romance.
The Bakers might have stayed away from medical authorities and other officials because they feared Adam and Zahra could be deported if their immigration status were discovered, according to one of the relatives who spoke on the condition of anonymity.
Search warrant documents released Tuesday say Elisa had not yet divorced her prior husband at the time she married Adam. So it's unclear whether their Australian marriage is legitimate.
In general, marriages that are legally performed and valid abroad are also valid in the United States.
Family members say Adam Baker and his daughter came to the U.S. on a visa, possibly a tourist visa, that later expired. Relatives weren't sure what steps the couple might have taken toward obtaining a green card that would make Adam and Zahra permanent U.S. residents.

That makes me see red.............

I wonder if this means Adam's boss could be charged with employing an illegal?

Me too Teh, just further's my opinion that AB cared much more about saving his own butt then giving his daughter the care she needed. Gross negligence IMO.

I still cannot understand where his money is coming from then.
Who is paying the rent, utilities, food, lawyer here in US.
His mother cannot stay forever, she is on a Visa, right?
Did she give up her home, etc in AU for him now???
