Why is Adam Baker not in jail?

If people do not like the rules of this board, there are ample forums out there that maintain an anything goes policy. I, for one, enjoy the atmosphere at WS, as the policies that protect even suspects and perps are the policies that protect my right to express my opinions without being called names. I appreciate that.

I honestly don't see how Adam could not have know about it. If Elisa did the murder, got tools to dismember her body, did the cutting up, sorry this is so gross, that had to leave a mess in the house, bathtub. How could he not have know it. I am wondering if the prosecutor/grand jury are hoping that Elisa will be so angry that Adam is not being charged, she will spill all the beans IF Adam is involved. JMO

I think it is very likely they believe EB will plead guilty, and will be a quick trial (hence the second degree, which is what she has already admitted, basically), and they will use the public record from that (including her description) in future charges/trials.

Without the COD, I think this may be the best they think they can do at the moment. (All MOO, BTW.)
 
Another thing, CPS had already been involved, according to previous reports discussed, and Adam said in his interview that he had seen Zahra's black eye and asked Elisa and Zahra about it. I think it would be strange that he would not connect the dots and question that a little bit more. I know I would...
 
I think AB is morally reprehensible. I think he knew what was going on in that home and didn't stop it because he didn't want to lose EB or get deported. I think he worries more about himself than anyone else. Unfortunately, no one can be arrested on moral grounds.

It's possible that he had virtually no role in her death and can't be prosecuted legally, which is extremely frustrating to no end. I can understand how hard it is to view him as a victim in this tragedy, and I know Tricia's decision wasn't an easy one to make, but I know if I get too emotional, I will have to step back for a bit.

Besides, AB will pay when he meets his maker if not legally. What's more important is making sure that EB can't ever walk the streets again. I hate to say it, but she is far more dangerous than AB is to me.

So yes, he knew, and I hope that he is at least charged with neglect. I really hope that he didn't have a hand in ZB's death. I hope he's learned his lesson about his judgment concerning women and that it makes him a better person and even father in the future. If he did have a hand in either her death or dismemberment, then I sincerely hope he doesn't get away with it. My biggest hope is that he doesn't walk away from this thinking he did absolutely nothing wrong, and another child in the future doesn't have to pay for him not learning any lesson at all.

In any event, both CPS and AB failed poor Zahra. There's no way he didn't know what was going on with her. I just think he chosed to close his eyes and ears and ignore it.

I'm bumping this to give some people some options for discussing AB in light of these recent developments.

If these threads do not cover things, feel free to consider opening another thread, as long as it is civil in nature. If you are uncertain, PM a mod and we can guide and advise on starting your new thread.

No one is saying you have to give AB a big hug, and none of us can be certain his non-suspect status won't change, but, for now, he is not a suspect, and we have to roll with that.

I do appreciate the effort I am seeing people put into being adult about their opinions. Thanks, everyone.

I am just holding out hope that the investigation is ongoing and the rug will eventually be pulled out from under his 'vindicated' feet. I completely believe he knew everything and is skating at this time only due to lack of direct evidence. Dig, dig, dig LE, please keep digging.
 
Wouldn't the fact that Adam lied in the 911 call about when he saw his daughter and that he knew the randsom note was phony make him SOME sort of accessory, either to the murder or to a cover-up??

I am so disillusioned by the 2nd degree murder charge and the lack of ANY charges against AB!

EB is very manipulative and abusive but could also portray herself as the doting SM, wife etc as per BB's mom in the radio interview etc.

That has been proven with the bigamy amoung other things. AB found out AFTER the fact that they might not be married.

EB would of found a way to do this no matter how many reports were filed with DSS
EB would of found a way to do this just to a different child at a different time

It was my understanding that AB was in the process of leaving EB and I believe that EB made this process very difficult and that truly was the only solution for Zahra's safety...

ZB was let down at every step that could be imaginable here except for the DETERMINATION of this particular LE. I have the utmost respect for what LE did in this case under impossible odds

If you look on the SW's EB stated to look in the PLUMBING and this I now believe was in respect to brain matter as well as other tissue (I apologize for the graphic nature)

When i posted that prosthetic legs can be lethal weapons i REALLY REALLY meant it. I know this as my daughter's prosthetic leg has broken bones in my foot, not intentionally, just by stepping on it. If someone swung that leg at a persons skull it would probably do an incredible amount of damage. It it was swung repeatedly, I can easily see how there would be very little need for a shredder

They found the gel liner which is NOT the prosthetic at one search site. It has never been disclosed how they did get it but it is my belief that this is what in fact LD's retrieved without realizing this might be the MURDER weapon (to bash her head in) but i have thought this for along time now. That is why the DA was so upset with her. How many cases do you hear that a prosthetic leg might be a murder weapon?

I have oft stated that this was not going to get any prettier and dreaded how ugly this was going to truly get and I believe we have not heard all of what happened at this time. LE has disclosed information in a methodic way and time. An example would be when LE stated that AB's cell phone pings were not in that area only EB's

The time he sent his mother an email that simply said I AM SORRY is very telling IMO

This was a crime committed out of pure hatred, and was done with extreme malice, by a very evil person

We can play the blame game all we want. In the end what matters most is that Zahra does get justice and it is my opinion that they felt it was going to be extremely hard to get a first degree conviction and would prefer to make sure she is found guilty. I believe more charges will be filed against her and the combination of these sentences will insure that she will not leave prison in her lifetime

I believe that deals were necessary in order to find her and AB may well have struck a deal i truly do not know. I would rather a deal be struck in order to bring closure than having another child missing as COD and TOD are going to probably be very difficult to prove in this case

Thoughts:

AB was NOT involved - Perhaps EB used a renovation on the house as her excuse to EB on why Zahra wasn't around (remember, LE said she was sometimes hidden from family) - IE, she was sent to stay with friends/family. EB, if she was the queen of the household, could have been "relaying" messages to Zahra for Adam and giving him fake responses. She could have cleaned up and nothing would be visible to the naked eye, AB being none the wiser. Couple this with him maybe being gone for work for a few days or just long days in general, believing her lies ("She's turning into a teenager Adam, she is in her room and if I were you I would stay out she is moody") and add in a dash of gullible and desperation for a marriage with EB. The last part especially sounds ridiculous I know - but recently I have seen first hand a person ruin their family's life in a desperate attempt to keep someone in their life. So I think it is 100% possible that AB forced denial or ignorance on himself. Plus, if EB was abusive to Zahra, I'll bet she was abusive to AB as well and, as the saying goes, had him wrapped around her finger. He was probably too afraid to lose her to ever second guess or disagree with her. Almost like a smaller version of Stockholm Syndrome I guess. I know everyone keeps saying "how can you not see your kid for 2 weeks" but I think it is completely possible if EB is as manipulative and convincing as I imagine her to be.

AB WAS involved - Second, and this goes against the above ideas....wasn't there a hit on BOTH of their vehicles at the very beginning? Correct me if I'm wrong. I vaguely remember something about the both of their vehicles in the beginning. This would explain why portions are still missing, and why LE didn't seem to make a huge effort to go after the rest - because they know AB was the one that moved them and AB and EB made a pact to each other not to divulge where they went.

I like your take on this. It's not inconceivable to me. I can certainly see how a person could pretend that a brooding teenage daughter is hiding in her room for a few days. I have a 13 year old and he would sleep 18 hours a day if you let him. Although, regardless of how long he sleeps i usually stick my head into his room and make him at least grunt at me so I know he isn't sick. However, I bet, as you suggested, with the right coaxing and trickery, I could have my husband think he was in there if he wasn't, for at least a few days. (NOT THAT I WOULD EVER DO THAT) "Oh he came home from school and had some dinner and went straight to bed, said he had a headache. Don't bug him dear, he looks like he is getting sick, better let him sleep."

Combination of manipulation and gullible. Combine that with a volatile, violent sociopath who you DONT want to push around GOD FORBID, and it's not a stretch that he would just carry on and take her word, not upsetting her or the balance of the house.

But I would bet dollars to dough nuts that he figured out something was up eventually.
It wouldnt surprise me if AFTER he figured out something was wrong and got the truth of Zahra's death, that he had a hand in cleaning up.

Other posted have said, How does a person NOT see that kind of mess or clean up effort. Something like dismemberment is not exactly CONCEALABLE. It's not like you could clean it ALL up in one day. So one would assume that he had a hand in the clean up, turned a blind eye to it, or was TOTALLY duped by EB.

AB goes of to work one day, Zarha is killed by EB in rage, That night EB pretends Zahra is a brooding teenager 'dont bug her dear', the next day AB goes off to work and first thing in the AM EB gets up and completely dismembers a body ON HER OWN?, cleans up the mess, and disposes of all Visible evidence before AB gets home, Plays the Brooding Teenager game again for a few more nights, till finally he confronts her? ? ?


I haven't read a lot about this case yet but i am of the understanding that EB worked out a deal with the LE and told them where to find Zahra? She also told them to check the plumbing?

So with my understanding that EB told the LE to check the plumbing, it is OBVIOUS to me that the home would have been the site of the murder, dismemberment, and obviously a clean up that followed. So.. Tell me, how likely it is that YOU wouldn't notice something like that? Was she prone to house keeping? There would have been SOMETHING that made him say WTF!?

And if he DIDNT know, and was TOTALLY duped by this AWFUL PERSON, then why did he not run screaming to the police and everyone he knew the MINUTE he knew something was up with Zahra. Like all the child protective services investigations weren't a sign that something was up!
 
Claudette, To debate your first point. Adam has said he looked in on Zahra "EVERY" night. He has never said Zahra was staying at anyone else's home. Also, if Zahra died on Friday, Sept 24 and Zahra was dismembered on Sat. Sept 25 (as Elisa has told us). That means the body would have been in the house at least 8 hrs while Adam was there sleeping, considering Adam worked that Saturday.

The body is in full rigamortis about 12 hrs after death. I would think it would be easier to dismember, once the body became stiff. BUT all this time while you are waiting for rigamortis, the bowels and bladder have emptied and the bacteria has started eating away at internal organs and the odor is awful. Can Adam not smell?

I agree with you that she is manipulative, but I dont think there is any way to hide a decaying body inside a 900 sq. ft. house.

Now the question is: if Zahra died early in the morning, could Elisa have cleaned up Zahra's bedroom, purchased a new mattress, trashed the old mattress, stuffed the bed so Adam would think Zahra was there, dismembered the body, cleaned up that mess, and disposed of it in several different locations...all before Adam got home? I am probably not listing all the things that would need to be done, but I have no experience in killing someone.

Your above comment is very certain, and it's one that many people are saying and thinking, and I understand the desire for "true" and "eternal" justice. But I feel, if we believe in some higher being, God, "maker" or whatever other word we use, and believe that there is judgement at our death, then surely we also recognise how human and fallible we are ourselves in our judgement. We are all sitting here in judgement of Adam, but what if he IS innocent and we just can't see it? What will our "maker" think of OUR judgement of Adam? I'm really not trying to upset people with this comment as I realise it's a sensitive topic, I just felt I needed to express how such comments affect me, and the BIG questions this poses for me personally.

I find it seriously hard to believe that AB is innocent here. Children are precious to God, and he failed to protect his God given, innocent, beautiful daughter. He threw away a true gift from above, for what? Where is the remorse? The hurt and pain? How can he have the energy to jump up and down at hearing that EB was charged? It's like he's already moved on and just wants this over with so he can go back home with his mommy like it never happened, like Zahra never existed.

He failed to protect her, and if he can't and won't admit at least that, then yes, he will pay in the afterlife. I won't believe he's innocent until he says he's sorry for being the worthless father that he was to Zahra. So far, he's reveling in EB taking the complete fall for this whole crime, and that is just not right.

I am willing to concede that he didn't have a direct hand in the murder or dismemberment of his daughter, nor he did deserve to have that happen to him. I can't, though, with good conscience, ignore the fact that this could have been prevented if he gave more of a darn about his daughter and protected her from harm. Good parents are willing to give their lives to save their children. I believe he sacrificed Zahra's health and well being just to save himself from humiliation and deportation. Zahra deserved so much better than having AB for father.

He never knew the gift he had, and I don't think he will ever know. And that's just sad.

Well, if God is to forgive AB for his utter failure at protecting his daughter and choosing the right type of person to be around Zahra much less let her fill the capacity of a mother, then I am quite sure I am forgiven for thinking he is a guilty as EB. There is no excuse for his not seeing his own flesh and blood daughter for two weeks. LE used the date of Sept 24th as when the pings were at the disposal sites. He said in an interview he saw her 100percent on the tues then corrected to thurs. I can give no man who claims his daughter was his life to not see her for that long. He also said in one of his last interviews that he came home from work and took a shower. There is no reason to believe he was ever gone for days. I haven't seen proof that was the case with his particular job. All JMO and I say it with a clear conscience. If LE isn't going to charge him with anything, I would just wish they would clear up his charges and send him on a quick trip back to Australia.

Hickory Born, great information – answers to questions I had been asking in other posts (also answered by tlcox in another thread too).

CONTENT WARNING – Regarding the above quote, I would have agreed with you 100% until I saw a documentary on the British serial killer, Dennis Nilsen. He was sentenced to life imprisonment in 1983 for half a dozen murders (which is less than half those he is attributed with). He lured gay men and male prostitutes to his apartment, would sleep with them and during the night would strangle them. His process is known as one victim survived to tell an incredible story of repeatedly being killed (strangled, drowned) then brought back to life by Nilsen, and finally surviving. Nilsen is a bit of a Norman Bates character – he'd sit the dead victim on his couch, and watch TV with them, etc, for days after their death. Then he'd dismember them, put their remains into plastic bags and store them in his bedroom closet. He also buried some corpses under his floorboards, and stored them in trunks. For quite some time he had a boyfriend who was totally unaware of what was going on around him, and never noticed the odour! Extraordinary!

The only reason Nilson was discovered was he'd put bits of flesh down the toilet, and eventually the plumbing had an issue (this was over a ten year period). The people in the below apartment reported their drains were not working properly and had an odour, and an engineer who checked the plumbing found a piece of what turned out to be flesh in the sewerage. When the police checked Nilson's apartment he calmly led them to 3 partial bodies in bags in his cupboard, and two other partial corpses hidden around the apartment. Yes, it did smell, but the victims had been dead for many weeks and some for months.

Do you recall where in the home he dismembered the bodies and do you recall what sort of evidence of that process was found by LE when they finally tore the house up in their search for all those body parts? Mmmmm ok... this is pretty ugly, but I can see lots of "high profile serial killer inspiration" potential in this, and who can know how much EB learned from Nilsen and his ilk.

He met his first young victim in a pub on 29 December 1978, and invited him home, as he had on previous occasions. The next morning, overcome by a desire to prevent the man from leaving, he first strangled him with a tie, before drowning him in a bucket of water. Taking the corpse to his bathroom to wash it, he then placed it back in his bed, later remarking that he found the corpse beautiful. He attempted to have sex, unsuccessfully, then spent the night sleeping next to the dead man. He finally hid the corpse under his floorboards for seven months, before removing it and burning the decaying remains in his back garden.

Nilsen’s second brush with the police came in October 1979, when a young student accused Nilsen of trying to strangle him during a bondage-play session. Despite the student’s claims, no charges were laid against Nilsen.

Nilsen encountered his second victim, Canadian tourist Kenneth Ockendon, at a pub on 3 December 1979. Following a day of sightseeing and drinking, which ended at Nilsen’s flat, Nilsen again succumbed to his fears of abandonment and strangled Ockenden to death with an electrical cable, before cleaning up the corpse as before, and sharing a bed overnight. He took photos, engaged in sex and finally deposited the corpse under the floorboards, removing it frequently and engaging in conversation, as if Ockenden were still alive.

His third victim, some five months later, was Martyn Duffey, a homeless sixteen-year-old, who was invited to spend the night on 13 May 1980. As with his first victim, Nilsen strangled then drowned him, before bringing him back to bed and masturbating over the teenager’s corpse. Duffey was kept in a wardrobe for two weeks, before joining Ockenden under the floorboards.

His next victim was rent boy Billy Sutherland, aged 27, who had the misfortune of following Nilsen home one night. He too was strangled.

Malcolm Barlow, 24, was an orphan with learning difficulties, who was soon despatched by strangulation.

By 1981, Nilsen had killed twelve men in the flat, of whom only the above four could be identified which, given his penchant for preying on the homeless and the unemployed in a large city, is probably less surprising than it might be in a smaller community.

Nilsen claimed he went into a “killing trance,” and on seven occasions, actually freed the men rather than complete the act, because he was able to snap out of it. The majority of his victims weren’t so lucky.

By the time Malcolm Barlow was killed, Nilsen was forced to stuff him under the kitchen sink, as he was rapidly running out of storage space, what with half a dozen bodies secreted around the flat. He was forced to spray his rooms twice a day, to be rid of the flies that were hatched from the decomposing bodies. When neighbours complained about the smell, he convinced them they stemmed from structural problems with the building.

To get rid of the corpses, he would remove his clothing and dismember them on the stone kitchen floor with a large kitchen knife, sometimes also boiling the skulls to remove the flesh, also placing organs and viscera in plastic bags for disposal. He buried limbs in the garden and in the shed, and stuffed torsos into suitcases until he could burn the remains in a bonfire at the end of his garden. On occasions he would burn fires all day, without raising any suspicion from neighbours. He generally crushed the bones once the fire had consumed the flesh, and police found thousands of bone fragments in the garden during later forensic examinations.

In 1982, in a desperate attempt to stifle his homicidal behaviour, Nilsen moved into a top-floor flat at 23 Cranley Gardens, Muswell Hill, also in North London, which had no garden and no convenient floorboards. Still unable to quell his impulses, a further three victims were killed in this flat between his arrival and February 1983. These victims were identified as John Howlett, Archibald Graham Allan and Steven Sinclair, and presented Nilsen with much greater disposal challenges, given the flat’s lack of direct access outdoor space. He overcame these by boiling the heads, feet and hands, and dissecting the bodies into small pieces that could be flushed down the toilet, and disposed of in plastic bags.
