i am simply at a loss as to why when it is going well she is now doing this....if he comes back she will then just break for lunch. What is she thinking now??????? They are SO CLOSE.

Her thinking may be despite all the arguing and disruption, the case has slowly proceeded thus far, so she will continue to use the same tactics to get through closing.

So is the judge letting the defendant come back into the courtroom now so he can act out and be removed so that this afternoon he will need to give his close from the other courtroom…..a little proactive strike maybe? My opinion only.

As much as I cringe at this game, I get it. Judge is giving him EVERY opportunity to be present. She has to, to preserve this trial.

Maybe she sees this as one baby step forward? Getting him back into courtroom is always a plus in her eyes? I really haven't a clue. Can't apply logic to an illogical situation.

i don't think so...she will have to give him the usual right to come back and at least start his closing.

maybe you are right but I think she has an obligation to the state and jury to get the instructions read which will be impossible with him in courtroom. I personally think he will choose to just stay over there and not come in.

IMO Judge Darow’s hands are really tied by the language of the holding in Illinois v. Allen. That court held a defendant can “reclaim the right to be present as soon as he is willing to comport himself with decorum and respect.” See: Illinois v. Allen, 397 U.S. 337 (1970)

She is simply being cautious in following that precedent.
