Absolutely. If James was in the casino that night LE almost certainly has a full list by now of every single person on property including lots of pics of anyone not identified. But I have no reason to believe he was in the casino, seems like out of control speculation to me.

What's your take on why LE contacted the casino at 4.30 on the morning of the 15th. To get CCTV footage of the highway or possibly to check to see if James was at the casino the previous evening?

Where has it been said there was shooting through the door?

I'm sorry. The breaking in of the door and the shooting of the parents.

Does anyone know whether the investigators have given a specific reason for excluding Kyle T. Jaenke-Annis as a suspect? If not, I can't believe this board isn't focusing more (if not exclusively) on this guy.

I mean, he broke into the house, knew exactly where Jayme's room was located, took clothing (possibly including underwear, depending on your source), and when asked why he took the clothes and whatever other odds and ends answered that he didn't think anyone would miss the object and that he was interested in what size Jayme was/is. Combine that with the fact that he works at the Turkey factory and I think we have to be nuts not to view him as the prime suspect, regardless of what the police say.

But why, then, would they charge him only for the burglary/theft/trespass, you may ask. My guess is that the police felt that, if Jayme were being held somewhere, their best bet at locating her in time to help rested with tracking Jaenke-Annis once he bonded out. Again, maybe he was at work or something when the crime occurred, but he definitely could have been helping someone out by collecting the clothes from the house.

Am I way off base here?

LE has stated that he is not a suspect.

This man, though disturbed, has a criminal history of performing other similar acts. There is little doubt that he is disturbed and needs help. However, IMO there's no connection between him and the murders. It is my belief that he has a fetish for the undergarments of teenage girls. He's been caught stealing undergarments in the past. I think this time he learned about the crime, knew a teenage girl had lived in the house, and knew the house was empty because of the area news coverage. He probably thought it was "safe" to go there and rifle through her things. It is not uncommon for crime scenes to be looted or burglarized. In this instance, however, the items that were stolen are just disturbing.

Sorry but you have totally confused me now? A couple of pages ago (40, post#797) i quoted from usnews.com dated 16 October that Robert Naiberg, Denise's father, had confirmed that James was working that Sunday instead of going to the family gathering. I asked if we knew that was correct and you replied yes we did, it had been known for a couple of weeks - fair enough. Yet now you say that you wondered if James had stayed at home that day instead of going to the party to watch football that day & night - i don't follow? Apologies if i've missed something!
I should have made myself clearer. The Grandfather was told that James was at work while the kid party was going on. So far, no one has been able to find out if James was really at work and his work shift hours for that day..... I have wondered if he just did not want to attend the family kid party, and stayed home and watched the NFL football games instead. ........ I think he was probably at work as the Grandfather was told and said.

No two vehicles means two cars in the area. If they were parked and no one from them was involved that’s all they have. Two random
Unrelated cars in the area. One or both could be related or not. We don’t know. I hope LE knows.
When reading about crime regarding the casinos in that area it appears that many incidents and arrests occur in the parking lots of these casinos. There was just one case where a couple was found passed out from drugs with guns and a bullet proof vest. Why would they have that stuff sitting in a casino parking lot? Looking for an opportunity to commit a crime? Follow someone? Crazy stuff. Wonder how attentive the casino people are to parking lot activity and vehicles that come and go?
Just curious if anyone knows how local LE and Tribal LE interact? Does county LE have jurisdiction to conduct investigations on reservation casinos/land?

I doubt it. The immediate review would certainly be to check for any suspicious activity or suspicious vehicles over the previous several hours. Then over time that review would expand to include anything that might be relevant.

Thanks for your reply Cody! This is one of the frustrating parts of this case, not knowing what James was doing on that Sunday. Maybe he should of been at work but skipped it to watch the football instead?

JC and DC left the party at 4 o'clock.
DC spoke with sister at 8:30
Gunshots heard by neighbor at 12:31 or later. This is a soft fact.
Either JC or more likely DC and JC were randomly targeted and followed home sometime between 8:30 and 12:30. Most likely earlier.
JC came to the door as it was battered in with a foot or with an axe etc. and immediately knocked out ( no gun shots yet) then DC comes out to see what is going on and is also knocked unconscious ( still no shots) Perp leaves with JC after he finds where she is hiding.
Perp shoots both parents on the way out at whatever time the gun shots are heard by the neighbors to be sure they are dead.
DC's last act is to place the 911 call. JC was home during the murders but not the phone call.
The whole crime is over well before we have been thinking it even started ( with the gunshots)
I think it was all done without a motive other than the thrill of it, done by a bored young man or two, on a Sunday night with nothing else to do. And, so far he has gotten away with it.
This is just and only my take on the crime.

If a perp hung it up he’d probably pocket it and take that phone with him. Why would he willingly leave it as evidence? If a commotion was in the background, the call wasn’t near the perp so I’m not thinking he hung it up. I wonder though if Denise knew she’d made the call successfully and was aware of someone heading towards her if she hung it up hoping to conceal the fact the call had been made and help was hopefully on the way? If a perp hung it up, I wonder why they didn’t take it with them?
Because it would ping their where abouts.

Did James have another job also?

Agree. Once they figured out there was a multiple killing, the first thought in my mind would be to find who did it.

People are asking about the Dad's where abouts....

I was taken back by the radio interview with the Sheriff when asked was the dad at the casino the night of the murder. The Sheriff said he doesn't have an answer to that.

What? Was he at work? At home watching football? At the casino?

By now I’d certain LE is aware of every time James or Denise stepped foot on casino property. They have most likely also compiled a list of every license plate on property for who knows how long. Cars driving past probably can’t be positively identified by license plate, but they surely have every make/model that drove past. That casino is going to be a wealth of information, it’s just a matter of figuring out whether any of it is relevant.
I agree about the casino. We also have to remember that there is a family friendly restaurant in there too . This means Jayme could have be seen in there with her parents at some time.

The neighbors said they heard gunshots roughly a few seconds apart. But looking at the 911 dispatch log it appears that it took LE a few minutes to locate Denise. Makes me think the two shots the neighbors heard were not the fatal shots but maybe "test" shots to see if anyone would notice and call LE.

Thanks for this SN. So would they incorporate the 12.30 - 1.30 timeframe in this or would they review much more footage from the casino's cameras?

Not really, because I haven't had a landline for over a decade. LOL. What does the phone company do to get that message to play?
I think it's enacted as soon as you cancel your service or you haven't paid the bill and they shut the service off. Imo

Totally agree, James' whereabouts that Sunday is confusing the hell out of me. And why didn't the Sheriff just say 'no comment' instead of the 'i don't have an answer to that' in answer to that particular question ?

That is good sleuthing. Thank you for sharing it.

I wish I remember who to give the credit to ;) I saw it on WS, someone pointed it out a few weeks ago.

It's time for LE to get that one tip, so they can solve the Closs family crimes. Since the last 2300 or so have not been ...... Just fill in the blank.

and it may have been. we wont be told either way.
If someone did holler perp’s name
And police know it, announcing this fact sure would put Jayme in bigger danger!
