IIRC- the fifth amendment protects a person from incriminating themselves in a crime they committed, or have involvement with, even after the fact knowledge of a crime that -say- they chose to keep quiet about for instance.

If the A's are called to testify at the GJ and take the fifth, that is an admission by omission of their guilt/involvement in SOME way in the alleged crime.


But they are also shielded from providing testimony which might be self-incriminating relative to a whole other ballgame.......for instance a crime not alleged to have been committed by the target of the Grand Jury's investigation.

The 5th offers broad protections...:blowkiss:

So...the Grand Jury Hearing....Well Baez get to go and hear the whole thing and see what LE has against his client? If that is the case, will the most important info be given to the GJ? If Baez can listen in on the whole thing, how can LE hold their cards close to their vests?

yeah, you are right - Nejame has been quiet, hasn't he? In fact, the whole family has been quiet and out of the public eye as much as possible. the hunkering down has begun, because the evidence is piling up. There is no way they can deny or refute the check charges, that's a given, so perhaps they are regrouping to come out stronger on any other charges. I read somehwere on the forum that C & G were at OCSO Tuesday and Lee was there on Wednesday. I wonder if OCSO was giving them a preview of what they will present to the GJ. I also wonder why Nejame didn't accompany C & G there?

OK, I have no Life. I read The Globe, Enquirer, etc. but I put my foot down at the Examiner (snicker) The Globe article was per an interview with a psychologist that just stated that Casey has confessed due to her lies, actions, etc. Not that she has come right out and confessed. She stated, as we all knew, that Casey is a sociopath and most likely killed little Casey and has no remorse. They showed her party pics and that was about it.

Actually, the Enquirer got some very reputable award for journalistic excellence, during the OJ debacle. I think it was about the Bruno Maglis.

I read the Enquirer. The Globe and Star are a rung down, but still fairly credible.

Any other 'loid is crap.

Regarding the Anthony's testimony and the Anthony's invoking the 5th amendment to keep silent....

I just wanted to toss this into the mix as I haven't seen it mentioned regarding this scenario but if it has been just ignore me puhleeeze.

Anyway, I believe the prosecuting attorney might consider the option of offering limited or transactional immunity to the witness in question, in order to compel testimony from the A's.

The immunity would be that the testimony will not be used by the state against the witness or the crime to which it relates will not be charged.

Okay then, that's all, just wanted to mention this.:blowkiss:

Fox Orlando did a piece on the evidence.

Fox contacted Baez's media guy who says there won't be any comment until there is an indictment.

Meanwhile, Baez is on the Today show issuing pre-indictment comments.

Media rep cannot control Baez who cannot control Casey.

It is a fascinating chain chain chain.....reminds me of that old song.:rolleyes:

ETA: I *think* he was downplaying as the injured party, the LE have villified my client in the media through leaks of 'incorrect' and unfounded evidence, i.e., sorta/kinda falling on his sword to seek some public sympathy.

The whole point of a GJ is for the prosecution to float their case and determine its validity and nature of charges NOT to be fair and balanced!

JB should run his own 'GJ' workshops to test the defense and watch it bomb.

Rumors that law office staff have been told to refuse CA's calls are unconfirmed.

So I wonder what Cindy threatens him with? Divorce him...or not divorce him? Call him bad names? Cut him off? I personally don't find her all that scary. People treat you the way you let them treat you. The thing about handing your control over to someone else is you can always take it back. The problem with that is you can't blame them anymore. :crazy:

Grand jury proceedings are secret. No one can listen in or attend other than those presenting evidence and the jurors. The only part that will be public is, once they have finished, any true bills or not true bills of indictment will be read in open court unless the judge agrees to seal any of those indictments. Those will then be part of the public court records.

It is double secret by law. Lawyers are generally not allowed in.
