According to today's local paper (clarksburg), Counts 1-5 will be dropped if she admits to count 6. Consideration will also be given for acceptance of responsibility. Not sure what that means as far as a sentence but I'm guessing no jail time. Probably supervised release. I will try to find an online souce. Can't copy the article here because of copyright laws.

I usually don't drink, but please make that a double (or triple) !! It seems that the law rests with the wicked and not the innocent. :(

Under the negotiated plea, Lunsford would admit to one count of exchanging welfare benefits for cash. Five other counts would be dismissed. The charge carries a possible sentence of up to five years in prison along with fines.

Ok---from this case I have learned

In WV -it is ok for your child to vanish-and instead of calling 911 pronto-its ok to take a 2 hour tour-and during that tour stop to buy ciggies and never mention the missing little one.

IF your in WV and you run out of monies-go ahead and sell those snap benefits several times ~ even though they are really intended for your children ---(the feds will make a deal with you ) --

In WV if your caught buyin bath salts at the head shop which you are KNOWN to frequent several times monthly--your safe-as long as your co-hort swears you knew nothing about it and heck -he was the one goin to "eat em"
most you will get is DRUG COUNSELING (scratches my head on this) and the <Mod Snip> walks free....he just can't live with you (is that PUNISHMENT) :great:

And after three months-a beautiful little girl is STILL missing and seems like the FBI is no closer to finding her today as they were on day one.

As long as she tells LE where the he77 Aliayah is, I don't really care what her deal is. Hopefully it includes a free tubal ligation, though.

You are absolutely right!! Sadly, for Aliayah-this did happen in WV. And everything that LE has done would NEVER deter anyone from doing the exact same thing ---jmho of course!!

Oh I agree, and maybe being BANNED from receiving benefits -so she would actually have to get off her tail and DO something productive would be nice too! (it really is nice to dream ) ...:great:

I really hoped that they would send a message with this -but I was wrong. And yep --poor Aliayah!! Makes me so angry :(:banghead:

Let's review the federal indictment counts. I'm not a lawyer, law student, or a regular watcher of "court" tv. So, help me out.

The pdf link is the actual indictment. It takes a long time to load and is wrongly labeled in the html field as "lungford" instead of "lunsford."

Allegedly if LL admits to count 6, then counts 1 -5 will be dropped.

Count 1 is Conspiracy
Counts 2 through 5 are Aiding and Abetting (for each use of Welfare card)
Count 6 Committing Fraud in the Welfare program

Because LE and FBI were following Lena Lunsford, and also because the person using the Welfare card "sold" to them by Lena is listed in the indictment as a person "known to the grand jury", I am guessing (and this is only a guess) is that she was setup by an undercover agent.

If the person who received the benefits through fraud was not an agent, then they would be facing indictments also. No one else is. Agent Killeen made that clear in one of those interviews. So, really they have to drop counts 1 through 5 unless they want to indict an undercover agent.

Am I right?

I believe that you have the charges right. As far as the "person known to the grand jury" -that could be anyone -you, me a police officer or a confidential informant. MAYBE the FBI plans on using this person again, i would tend to think this has to be someone she knew-or she is REALLY not as smart as I have given her credit for.

This isn't written very clearly.

I was so disgusted after I read about the plea deal, so I decided not to post what was on my mind...until I had cooled off a bit. All I can say at this point is that I am praying for some divine intervention. I believe in the power of positive thinking, and I will not give up on precious Aliayah! I'm already talking to my award-winning investigative reporter friend about the possibility of producing a documentary. I will not let this case go!!! Wishing you all a happy, healthy, and prosperous New Year! Thank you all for caring so much!!!

ITA, KindredSpirits-this "plea deal" sounds like more of LL gaming the system again.:maddening: IMHO Aliayah was never really a little actual person in LL's eyes, more like a chess piece to be moved at whim when it benefited her and/or RL. I never even met Aliayah but have been captivated by her ever since Sept 24. I do NOT see the same level of concern, engagement, nurturing, etc, shown out by LL/RL as I have on this site and others for Aliayah. Hopefully the lawyer(s) bringing this case will see past LL's methods and bring about some kind of real justice.
Aliayah, you're always on my mind.:sigh:

Came across Community Pages on Facebook for Lewis County. There are two of them that actively discuss this case each day. And while one of them has the title of "Rumor Mill," at least two of Aliayah's relatives are on there speaking out (Vickie and Tina). There may be more.

I won't link it since I don't want to violate our TOS, but you can find them easily if you type in Lewis County in the search bar.

There was a recent post by family member Tina (sorry I can't remember how she is related to Baby A) that says she and others were going out a search. Maybe they are acting on a hunch or a tip.

Whatever it is, I hope they find her soon so that LE can put more pressure on the parents.

We lost Dest June 28, 2010 and I miss her more than words could ever describe. Since she was killed, I have TRIED to dream of her, and couldn't. Last night, I dreamed that Destiny and Aliayah were trying on clothes and just laughing!! I am positive that if Aliayah is in heaven today, she has a good friend to take care of her. :(

I hope everyone has a safe and very Happy New Year's. Please don't drink and drive!!

Aliayah--my thoughts are all wrapped around you today. I wish you could know how many hearts you have touched. And how many people love you.
