GUILTY Yoselyn Ortega charged with 2 counts ea-1st and 2nd Degree Murder of Krim Children

  • #541
YO killed this couple's two children.

Did she have a psychotic break? IMO, she may have.

Did she murder these children out of jealousy and revenge and rage? I don't lean that way: at least, not yet.

I am leaning toward the rage/revenge theory. Has anyone heard if she is under psychiatric care at the hospital? If she were, I don't think a shrink would have let LE interview her without an attorney.

I am not sure how the law works in NY but here in Ga if someone is taken to the emergency room for a suicide attempt they do a 5150 hold which means they take them straight to a psych hospital for a 72 hour observation. And it can be longer depending on how unstable for severe the patients issues are.

I was hoping this woman was going to be arraigned this weekend. I guess her attorney asked for more time.

I am too. My guess is she was angry at a lot of things.

1. The Krims wealth, while she struggled.
2. Having to work for extra money doing housework.
3. The threat of being fired.
4. Being told what to do all the time.

This is a woman who should have sought other employment some time ago when the resentment started to build. Resentment for an employer rarely reverses itself once it takes hold; it usually just grows deeper.

I wonder if Valerie Van Leer-Greenberg, the attorney who recently took YO's case, requested "some time" before the arraignment occurs ... to be able to communicate with YO somewhat (to get some details directly from her, to hear her story etc)?

Or it doesn't work that way? (meaning arraignment just occurs whenever .. and attorneys can not request to postpone one...)

I didn't see your post and pretty much posted the same thing. LOL

I have a feeling YO isn't going to plead guilty. I hope I am wrong. I have a feeling that attorney will try to get all her statements she made to the police thrown out because of her condition at the time of questioning. She just might get it too. :furious:

I can't imagine what the defense would be, but leave it to a defense attorney to come up with some nonsense. She snapped and was out of her mind when she killed the kids, or some crap like that.

I am wondering if YO is still in the hospital. Even with major surgery, 18 days seems like a long time.

Or blame it on mystery person who snuck in bldg.
She was victim, too.
Something to that effect.

Sure is. My dad had a triple bypass and was out in less than a week.

Maybe, as it was mentioned above, in NY is like in GA...

Maybe they took her "straight to a psych hospital for a 72 hour observation." (or something like that) ... and she "qualified" for a somewhat more prolonged stay there, LOL :D

She was "planning to see a shrink" (as was reported in the media) ... well if the above mentioned scenario is more or less correct -- she can see one for FREE now, i guess.

But don't forget that your dad wasn't charged with 1st and 2nd degree murders (times two), at the same time. ;)

Like (say, if she isn't in psycho ward currently), maybe they figured that considering everything (her wounds included), maybe it's best "to keep her put" exactly where she is now (in a hospital ward, that is).

The more I think about it the more I think she is likely in a psych facility right now. I am currently looking for the NY code that addresses suicide attempts.

You are probably right especially if the jail psych ward is not equipped or the atmosphere is volatile toward her. jmo

I know there has to be a law in NY about being a danger to yourself or others but someone a little more legally astout will need to find it cause I am having no luck!

Ok, maybe this is what I was looking for.....

http://law.justia.com/codes/new-york/2006/mental-hygiene/mhy09.27_9.27.html

The director of a hospital may receive and retain therein as a
patient any person alleged to be mentally ill and in need of involuntary
care and treatment upon the certificates of two examining physicians,
accompanied by an application for the admission of such person. The
examination may be conducted jointly but each examining physician shall
execute a separate certificate.

Has there been anything said about her injuries other than the vertebrae they operated on? I know someone who had a damaged vertebrae in her neck from a gun shot, and she was in the hospital for months because of it. Although her spinal cord wasn't severed, it was damaged, and she is paralyzed from the chest down. Even if there wasn't any permanent damage from the broken vertebrae, swelling could still be causing problems. That could account for her being in the hospital so long.

Could you imagine being of the the nurses assigned to take care of her? :furious:

since she's in police custody, who pays for her care? YO or the state?

when karla homolka was in a montreal hospital to give birth several years ago nurses recognized her and some refused to treat her. no idea if there were any consequences...
