Re-Charged & indicted (8/19/20) & arraigned (8/28/20) with 2 counts of 1st degree felony murder, 2 counts of aggravated child abuse & neglect, 1 count of tampering with evidence, 12 counts of false reporting, 1 count of abuse of a corpse & 1 count of failure to report a death suspicious, unusual, or unnatural circumstances. Plead not guilty. $1M bond. Bond reduction denied (12/3/21).
Trial set to begin on 2/3/25. (expected to last 3 to 4 weeks).

8/4/23 Update: Boswell made a brief court appearance in Sullivan County Friday morning. No motions were heard at Friday’s status hearing. Next status hearing on 11/3/23 @ 1:30pm.
11/3/23 Update: Status hearing continuance-granted. "We are in the process of getting motions ready to file soon," said Gene Scott, the attorney representing Boswell. "Substantive motions that will, I think, shed light on new issues in the case & kind of have it in better posture to go to trial." Scott says he plans to file those motions in January. Next motions hearing on 3/28/24 @ 1:30pm.

One big takeaway from the hearing on Thursday -- Judge Jim Goodwin denied a request from the defense to sever some of Boswell's charges.

The defense originally wanted to have separate trials, and have a trial for her false reporting charges, and a trial for her bigger charges, like murder.

After the hearing, Scott told members of the media that he was concerned about the amount of coverage since the case began four years ago. He said reporters and cameras have been present for every hearing in the Boswell case.

Scott said his client is ready and wants to go to trial. Boswell has been unable to make bail since her original arrest, Scott said.

Scott said he has reviewed all of the discovery evidence in the case and is prepared for trial.

The State of Tennessee has filed its response to Megan Boswell’s attorney’s motion for a change of venue, and prosecutors don’t think doing so is necessary.

Staubus argued that Boswell is not entitled to a change of venue and cited two primary reasons, which can be read as they were written in the response below:

1) Prejudice should not be presumed merely because of the extent and nature of the pretrial publicity; and
2) The parties are likely to be able to seat an impartial jury in Sullivan County after a careful and thorough selection process.

Staubus argued that the existence of media coverage surrounding a case does not equate to the belief that potential jurors have already made up their minds and would be incapable of being impartial. He wrote that jurors do not necessarily go into a trial without any preconceived notions, but their ability to set those aside and reach a verdict based on evidence is what makes them impartial.

3/28/24 Update: Judge Jim Goodwin denied a request from the defense to sever some of Boswell's charges. The defense attorney Gene Scott originally wanted to have separate trials & have a trial for her false reporting charges & a trial for her bigger charges, like murder. The defense previously said that having those tried at the same time could create a situation where a juror could find her guilty for some of the lesser charges & eventually decide she must be guilty of murder. Another topic during the hearing-possibly moving the trial to a new location in Tennessee or bringing in a pool of jurors from elsewhere. The hearing focused on a possible change of venue has been set for 6/20/24 @ 1:30pm. State prosecutors have also said they plan to seek life in prison for Boswell.

The mother pleaded not guilty to the charge. Thursday's court date was an arraignment instead of the originally planned change of venue hearing. That's because the state opted to pursue a new murder charge on top of Megan Boswell's previous two felony murder charges.

"All I can tell you is it was based on additional evidence that we had that we obtained after the initial presentment – so we decided we would add an additional charge of first-degree murder premeditated," Sullivan County District Attorney General Barry Staubus said.

The change of venue hearing has been reset for Aug. 15, and it will determine if Boswell's trial will be moved out of Sullivan County. WCYB News 5 in the Tri-Cities reported prosecutors said they believed a Sullivan County jury could still be impartial despite the notoriety surrounding the case.

Prior to the hearing, Boswell was served with a new indictment charging her with first-degree murder. The new charge alleges Evelyn’s death was premeditated and intentional. The new count is in addition to her two previous felony murder charges.

The new charge brings the total number of counts against Boswell to 20. In August 2020, Boswell was indicted on 19 other charges, including two counts of felony murder in Evelyn’s death. Other counts include aggravated child abuse, aggravated child neglect, false reports and failure to report a death under suspicious, unusual or unnatural circumstances.

I'm curious how she's getting on with her attorney.

I'm thinking of the Florida defendant who trapped her boyfriend inside a suitcase, and recently expressed dissatisfaction with her 8th attorney! I can see this happening with MB too. MOO
