The Megan Boswell murder case will stay in Sullivan County for now, with jury selection in December and a Feb. 3, 2025 trial date.

Criminal Court Judge James Goodwin ruled that jury selection in the four-year-old case involving the 2020 death of Evelyn Boswell will begin Dec. 16. He declined to grant a defense motion for a change of venue because of publicity around the case.

Goodwin told both parties on Thursday that before a change in venire is considered, an attempt must be made to find an impartial jury in Sullivan County first.

“I think that the process that we’re required to do is we have to attempt to pick a jury in Sullivan County before we make a ruling on whether or not we go to another county,” Goodwin said.

The court has prepared a questionnaire and handed it out to a random jury panel to gauge the level of publicity. Both the state and defense have seen the results.

Boswell's next court date is November 1 at 1:30 p.m.

6/20/24 Update: Thursday's court date was an arraignment instead of the originally planned change of venue hearing. That's because the state opted to pursue a new murder charge on top of Boswell's previous two felony murder charges. "All I can tell you is it was based on additional evidence that we had that we obtained after the initial presentment – so we decided we would add an additional charge of first-degree murder premeditated," Sullivan County District Attorney General Barry Staubus said. The change of venue hearing has been reset for 8/15/24 & it will determine if Boswell's trial will be moved out of Sullivan County. Prosecutors said they believed a Sullivan County jury could still be impartial despite the notoriety surrounding the case. Prior to the hearing, Boswell was served with a new indictment charging her with first-degree murder. The new charge alleges Evelyn’s death was premeditated & intentional. The new count is in addition to her two previous felony murder charges. Boswell plead not guilty to the new charge at this arraignment.

The defense previously filed a change of venue motion, due to the publicity surrounding the case. If a non-biased jury is unable to be found, the court will work on finding a similar-sized county outside of the area to pick a jury from. Criminal Court Judge James Goodwin declined to grant a defense motion for a change of venue because of publicity around the case. Sullivan County Deputy DA William Harper said he is confident they will be able to find a jury in Sullivan County. "We have deliberately not released a lot of information to you guys, to the general public & the goal was to be able to hopefully pick a jury in Sullivan County." The court will bring in 1,200 potential jurors for questioning in December. If chosen, the jurors could be sequestered for the trial which is expected to last a month. Boswell's next court date is 11/1/24 @ 1:30pm for status hearing. Her trial scheduled for 2/3/25.

They previously told us the court will bring in 1,200 potential jurors for questioning in December. If chosen, the jurors could be sequestered for the trial which is expected to last a month.

Her trial is scheduled for Feb. 3rd, 2025.

I caught the tail end of this, just as she stood up and walked out in shackles, but the sound was terrible. Must have been a pretty quick hearing.

December 4 is when the first panel of potential jurors is scheduled to be brought in. Another panel is scheduled for December 9. There are about 1,200 total potential jurors.

Thank you for this. So do "we" all think the final potential jurors from these 2 hearings will come back on 12/16/24 - the day I have when jury selection is supposed to begin? Plus the court site says 12/16 also.

That's what it sounds like but I didn't hear those dates. The sound is awful, or is for me anyway. Linking the YouTube version and hoping someone else will have better luck.

The defense attorney also brought up a subpoena for someone who is out of state and in jail. I'm curious who that is but I don't think he mentioned the person's name.


The questions will be given out at jury orientation in December.

It's great to finally see some progress with this case. It's hard to believe it's been almost five years since little Evelyn went missing and was found murdered on family property.
