With a retrial, could the evidence about the change in beneficiary of Jason's insurance policy be admitted? As far as I recall it couldn't be used in the original trial because of the way it was obtained by the police.
I know, I get confused with all the initials too. Happily, I have hit upon a solution that alleviates the problem a little. From now on, I am going to refer to TM as T643182, and MM as 1551729. That should make things simpler.

A couple of problems with TM testimony here. TM says he is going 'upstairs to calm them down'. If this is true it means (a) SM was awake and (b) TM knew it was not a burglary - so why bring a bat upstairs to 'calm them down'?
If TM testimony is true and I dont believe it is IMO, then TM and MM had an opportunity to flee just before TM allegedly charged JC. So self defence is out the window IMO.

My theory is that they changed their clothes and cleaned themselves up, before calling 911. The blood on TM could have been from turning the body over and the blood on MM hair could have dripped from the paving stone as she lifted it over her head to administer more blows. JMO.

The allegation of 'concealment and destruction of evidence ' is really interesting, and assuming there is substance to the allegation, it begs the question 'why would anyone conceal and destroy evidence in a case where self defence is argued?'
