    Closing Arguments- thread #172

So JM's description that a stabbing occuring in somebody's home would always constitute felony murder isn't accurate. A burglary is one of the crimes listed in the Arizona criminal statute, but not a stabbing. See http://en.wikipedia.org/wiki/Felony_murder_rule_(Arizona), reproduced below...

    Closing Arguments- thread #172

Ugh, I think JM bungled the explanation for how JA committed felony murder. I don't think the stabbing itself can be the felony, can it? Doesn't the felony have to be another felony other than the murder itself?

    Closing Arguments- thread #172

Finally Juan makes the argument that the sequence of events (gunshot first or stabbing first) doesn't matter. Wow, it took him long enough to say it.

    Closing Arguments- thread #171

JA is acting like she is reading these instructions for the first time. Maybe she should've reviewed the likely instructions before her trial started and taken them into consideration when preparing her strategy and testimony.

State rests rebuttal case - thread #170

Wouldn't it have been great if the prosecution argued its case that way?

State rests rebuttal case - thread #170

Wishful thinking on your part. He actually testified that the gunshot wound was almost certainly _not_ immediately incapacitating, directly contradicting the ME's testimony.

State rests rebuttal case - thread #170

I believe that question shows that at least one juror/alternate is not buying the ME's testimony that the gunshot wound was necessarily immediately incapacitating.

    trial day 51: REBUTTAL; #156

Sorry, but it's "SKU" (stock-keeping unit), not "skew." LOL.

trial day 41: the defense continues its case in chief #121

They're showing juror #5 on WAT live feed. She's still in the courtroom even though almost all of the other spectators have left. I think the camera is supposed to be off?

trial day 41: the defense continues its case in chief #121

Why is ALV so reluctant to apply her continuum to Snow White? Her continuum obviously could be applied to a character in a fictional story.

trial day 41: the defense continues its case in chief #120

I can totally understand TA's frustration with JA's lie that someone at the restaurant had told her that he was seeing someone. JA got that information by accessing TA's email account, right? And then she lied about having gotten the information from a coworker. TA caught her in the lie...

Jodi Arias; the sequence of events

Not to give the knife firsters any more ammunition, but there is one thing in particular that bothers me about the gun-first theory (and, no, I'm not talking about the ME's testimony): When the jury asked JA why she just didn't fire another shot, JA answered that she didn't know where the gun...

Jodi Arias; the sequence of events

I don't think JA dropped the camera in the bathroom during or after the ceiling shot. That's just a story that JA concocted after seeing the photographic evidence and trying to provide a justification for self defense. I believe detective Flores testified that the bathroom ceiling shot was...

Jodi Arias; the sequence of events

Exactly. She positively identified the photo as having TA's right foot oriented toward the bathroom.

Jodi Arias; the sequence of events

I think it can be done the way I depicted, at least on a tile floor covered in water and blood. She is just using his body weight to create the leverage to drag him. I don't think she could easily turn him around because of the hallway being too narrow. And for some reason, at least in the...

Jodi Arias; the sequence of events

When detective Flores showed the photo to JA during the interrogation, JA immediately recognized the bathroom in the background.

Jodi Arias; the sequence of events

Keep in mind that my depiction only represents a split second in time. Do you agree with my depiction for that split second? Who knows what happened afterwards. Maybe she was just wrestling with his body and didn't actually drag him that way. I'm still thinking she drags him that way...

Jodi Arias; the sequence of events

Hey Dave, isn't it possible that TA's neck was already slashed on the carpet area before the first bleeding photo? I think the last two bleeding photos may simply show JA starting to drag TA back to the bathroom after having already cut his neck.
