Yeah. Maybe it FINALLY hit her that her life is on the line here. CM certainly isn't the greatest orator, but she has a better shot with him than JB. Surely, even she can see that at this point.

her and jb seem to be in a bit of a tiff today....but I still don't think she gets the real totality of the situaiton....:twocents:
 
Jumping ahead here to make a point:

There is a concurrent "Tampering" investigation going on. The one involving Laura Buchanan. Cindy Anthony is perhaps, perhaps not, involved in this alleged "tampering" due to her alleged relationship with LB.

Part of the evidence may or may not include many statements Cindy has make during statements, depos, phone calls and emails to LE.

If Cindy would ultimately be charged with tampering, could her attorney attempt to have all these previous statements, depos, phone calls and emails to LE thrown out as Cindy, as far as we know, has never been Mirandized during this investigation?

I guess not.

I don't see the difference. LE has to start investigating somewhere. If during the investigation, they decide there is enough evidence to warrant an arrest, THEN, I could see Mirandizing someone.

IMO they had to wait until they thought they had enough evidence, or statements to indicate 1) a crime and 2) a suspect before they placed ICA under arrest and Mirandized her.

Cindy was never "in custody," so she would not need to be read her Miranda rights. Whether or not there is enough evidence or someone is "under arrest" is not the relevant question. Also, I don't think she's ever made any statements to LE about the LB situation anyway.

Would that arrest be considered "undone" if Deputy Eberlin's supervisor, Hosey, said to him, withing ICA's hearing" to take the cuffs off, that this was about a missing child case, and the other issue was not a priority?

If so, did anyone testify that Hosey said that in ICA's earshot? I don't recall it.

IMO that would probably be enough. I don't think anyone testified to that though. :(

Is it usual for one of the parties to the action not to listen at all to the other side's argument? Defense team is so busy with staff, papers, electronic devices, they seem to have moved on to more pressing matters....but what could be more important than preparing to do some damage control of their own case?

I'm sure they're listening. Frenetic activity is what it normally looks like at counsel's table when counsel is preparing to give a rebuttal argument.
 
LDB knocked that out of the park. Jurors are going to be regular people. They will be capable of following her lines of thinking, even when it comes to the case law. Delivery is soooo key!! You can make all the points in the world but if you lose the jury's attention or they do not understand you, it really doesnt matter, does it?

YES YES YES!

Her arguments are linear, cohesive, logical. The jury will respond to that.
 
Umm can some one refresh my memory. Isn't Joy Wray kinda "special?" Like in....shouldn't be out in society special?

:laugh: She's been held against her will before but that kind of thing comes and goes. (meds usually help keep you out but it seems she doesn't like them too much)
 
STATE:YM arrived at A residence at 3:51 am reviewed ICA's written statemnt then met with her

In spare bedroom, CA says took place in spare bedroom and could hear exchange, intimidating tone from YM but this all can be heard on audio tape of interview
 
LDB pointing out that GA may have his facts confused about where Yuri spoke to ICA...lol

I know -- what about listening to what Linda is saying -- or is that all moot to the defense. We know CM can't hear, so if he responds, it won't be anything to do with what she's saying. Even if he is reading the teleprompter.MOO

LDb talks about the interview with YM in teh Anthony house.
LDB says CA/GA recollection of where the interview took place differed, CA version agreed with YM's in that it took place in a spare bedroom with the door open. She comments that CA says YM used 'an intimidating tone' but LDB goes on to say that the REAL tenor of his voice will be heard on the audiotape recording of the interview.
Nice turn of the knife there LDB, CA did not like that at all!
