This is going on records, and this will be the basis for their appeal. As much as I love HHJP, he has to know that the way he went about this left the door wide open for an appeal.
 
She said the DT feels like they are fishing in the dark...they love to go fishing don't they?
 
I don't get it, why didn't they just use their backstrikes more responsibly? I wish I understood this better.
 
This judge is an encyclopedia of law knowledge,she can't stump him :great:

your honour, we think you should allow us to choose 12 jurors and 8 alternates who say they think ICA is innocent and they are totally anti-DP, and we will need unlimited peremptory strikes and an eternal pool of jurors to do this!
 
Fryer sounds very nervous, IMO
She is very green. She was just admitted to the bar (passed it) in April of this year!!! :eek:

But I do give her a lot of credit being so green. She is very confident considering the circumstances.

I respectfully disagree.. he is using the law.. an appeal is the last thing he wants

Sound came on just as I heard the comment about abusing their powers....Is she accusing HHJP of this?
 
She might as well say "Your honor, we also don't have a defense and we don't know what else to do at this juncture!"

Its like none of the other DT wanted to go up there so they send her!! She must have drawn the short stick!
 
We need to chose the entire jury not simply piece meal . . . .
 
Casey in black looks a little more somber. DT definitely setting up an appeal stance.........man I hate hearing them with this motion on their strikes.

there is no rule that says the 12 cannot be sworn before the alternates hhjp

They don't like the rules that HHJP has set for this process. I read the FL case law on this and the judge has a LOT of discretion about this.

It is kinda complicated and confusing though. Especially considering the alternates.

They're arguing that normally they would get to a higher number of PJ's and then be able to exercise backstrikes. However, HHJP was only letting them get to 12, so, if they wanted to hear from more PJ's, they would be forced to use a backstrike. In other words, as the SA & JB mentioned yesterday, the judge was making them burn backstrikes in order to seat the jury quicker.

I'm still confused as to why HHJP doesn't want to take his time with this, in order to avoid this type of challenge later on.
 
I love that the way the jury is being picked is finally being addressed. So far HHJP is handing the DT their hineys on a plate, lol.
