CROSS EXAMINATION OF CINDY ANTHONY BY JB - continued

She agreed that after the first search warrant their house was turned upside down and they did not put anything back. They took items and at some point Caylee's bedding set had been taken. She was not exactly sure what they were looking for.

(Cindy sniffling and wiping her nose - ICA staring intently at the monitor in front of her)

CA was shown her prior depo - lines 10 - 15 regarding duct tape.

What question was asked of you?

OBJECTION BY LDB - improper impeachment, hearsay as to page - out of court statement. OVERRULED.

Were you asked by LDB if ICA removed any duct tape from the house when she was out of jail? She did not remember and the depo did not refresh her recollection. JB began to read...

OBJECTION BY LDB - improper impeachment as JB was reading her response. HHJBP - establish predicate for past recollection in court.

JB needs a minute to confer with CM, then the other young male defense attorney. JB then takes the deposition to CA with the page marked.

She read her answer as to whether ICA removed any duct tape while out of jail - she read - as far as I remember, no, because I believe we only had one roll of duct tape (black) and GA was using that to repair the signs in front of their house.

She was asked if GA was the only one using the roll of duct tape, but said that she would have been using it also. She agreed she said in her depo that GA was the only one using it.

CA showed Exhibit 314 - a photo of ICA and Caylee.

They have owned the Pontiac Sunfire since 2000 - eight years prior to it being confiscated. Her hair length, ICA's and Caylee's hair length has changed during that time. Her mother's hair length has never gone past her shoulder - 5". Lee's hair is usually very short.

Back to Exhibit 314. Photo was taken in early 2007. Caylee was younger than 2 years old in the photo - 18 months - the shorts in the photo were 24 months. In June of 2008 she no longer fit into those shorts. She was wearing 3Ts.

Whoever put those shorts on her were not familiar with her size?

OBJECTION BY LDB - SUSTAINED.

No more questions by JB.

Witness told to stand down.

So Roy Kronk placed the shorts at the Suburban site?? George would have surely knew the size of Caylee's shorts??

One very simple thing to remember :

If you tell the TRUTH, the WHOLE TRUTH, and NOTHING BUT THE TRUTH in the BEGINNING ... and ALL THE TIME ... you will always be CONSISTENT with your responses !

There is no need to say : :innocent: "I don't know" ... :innocent:"I don't remember" ....

(a big shrug of shoulders ... a big facial gesture ... look up ... look down ... "make signals" ...)

Bravo!!!!! You are so right!!!!!

This in so ridiculous how JB is trying to throw GA under the bus. It won't fly no how no way.

Actually, I put my kids in shorts that are a size smaller than what they wear sometimes, because they sometimes run big or have the function inside of them to make them looser or tighter. My son is 22 months and can fit in his 18 months shorts and he's HUGE for his age (34 lbs)

Oh goodness, my kids always wore smaller bottoms than tops. Not to mention, depending on designer one 24mos could be larger/smaller than another. This means nothing despite what JB was trying to get CA to imply.

At the bottom of the laundry drawer? Back of the clothes drawer?
If Caylee had a lot of clothes one set might go forgotten.

I agree to a point...... but it just seemed like CA was being deceptive when questioned about the shirt......but that is just my opinion.....I would hate to be in her shoes at this moment and can imagine this would have to be the hardest thing for any parent or grandparent to have to go through.....but we have to remember we need to get JUSTICE FOR CAYLEE!

With all the talk about hair length, color, etc., would Cindy's hair sample show that her hair had been color treated? Also, Casey's hair? Or does that grow out?

yes, and the sample in the trunk was not treated (unlike ICAs or CAs) FBI person discussed it

Ummm, yes, a thin 34 month old can CERTAINLY still wear shorts that a 24 month old wore. Any juror that has a child or has ever been near kids will know that.

My kids could always wear a size smaller in shorts -- it was the length of the pants that they outgrew.

I seem to recall other witnesses saying I don't know, don't recall etc. Does that make them liars? Or do we accept that memory is not always as perfect as we would like it to be?
JMO

She was in the same shorts the day before. Sitting on her great grandfather's lap.

Yet JB says that whoever put her in those shorts didn't know she wore 3Ts and not 24 months.

Didn't CA just say earlier that Caylee used to be chunkier when she was 2?

How would Cindy KNOW if Casey removed any duct tape from the house?

ding ding ding! you know who WOULD know if ICA removed any, dont you?!

hint: ICA spend 6 hours a day with him while out on bail, taking a full backpack with her every day

That is the most stupid line of questioning I have heard yet: size 24T on a child that wears 3T means whomever dressed her was unfamiliar with the child.

D-Uh, every bit of clothing fits differently. My daughter wears 24T, 3T, 4T and same goes with shoes. 3 different sizes depending on the brand!

See these straws? He's really grasping for them now.
