I strongly believe most of us here want a fair trial, and only if the prosecution can prove RA’s guilt to a jury BARD, should he then be convicted.

I initially felt the PCA was weak, and the bullet evidence and the witnesses would be heavily disputed at trial.

Ironically, it’s been the defense’s unusual approach that has strengthened my belief that the prosecution’s evidence against RA will be mighty and powerful at trial.

one feels the defence need a new strategy in any event. if their own witnesses take the stand and say they have no evidence against the alternate odinist suspects RA will likely be found guilty in a straight up comparison IMO as there is evidence against him.

perhaps they will focus on generic SODDI?

Yep but any new line of defense if the Odins did it is thrown out will delay them again IMO
 
You girls amaze me with your quickness in finding documents. Thank you both so much. You are correct in what I was referring to. I had forgotten the confession to the first sister, in hindsight I wonder if the call to LE on the 14th had been returned to her, would it have made a difference? :(

So, the one sister that was told on the 14th of February, 2017, definitely tried to call LE - is that correct? And this was confirmed.

Am not saying this is the case, but certain antianxiety and antidepressant medications can alter polygraph tests.

Should be alters I think.

In the document it has that she went 2-3 weeks after her brother brought it up which wasn't too long after, but not straight away either. After that - it took the LE a long time to follow up on that at all.

Now I know when she approached them which is what I wanted to know. Thanks!

Hard to know what they've been spending their time on I guess. Like do they have a medical expert on psychosis from a timely consultation in '23 or did they miss the boat on it? If they did, now what?

But it is odd that a year after Franks, they had nothing.

I think Gull probably will do them a favour here. They'd be better off focussing on KAK, the phone in the middle of the night, multiple killers, defective investigation etc

So LE can not be blamed for his poor mental health. He had it way it before he brutally murdered two innocent children on an afternoon walk and LE came knocking.

Yes, I think Dr. Wala said that and according to MS in 2019 he admitted himself in a mental health institution. I am wondering if was after or before the press conference.

Yesterday in my country in a public place in nature, where people camp, have picnis, etc, and where a lot of people were, a man spotted 2 girls, managed to isolate them, apparently he tried to rape them and they resisted, so he tied them and shot them - one in the back (she is in a critic condition in a hospital) and the other in a hand (I think he wanted to shot in another spot but the bullet went to the hand). 0 connection between the victims and the guy. The man acted alone and is 74 years old and the girls 22 and 17 years old. He tried to escape through the water but was caught.So imagine a younger guy in a more isolated place with a gun and two children like in Delphi. With some differences of course but the case reminded me of Delphi. It's absolutely possible a guy alone to control 2 girls or children or even adults with a gun. These crimes in trails/nature are almost always a guy alone with sick fantasies and random victims.

TRANSCRIPT INFORMATION

For the 3 Day Hearing it took 21 hours and there is about 750 pages approximately.

It is not automatically transcribed.

It is $5.75 per page for the first print so is estimated to cost about $4,312.50 and will take 4-6 weeks for it to be fully transcribed as any appellate cases will take priority.

Every print after that will be set at $1 per page so about $750, however, as it is an estimate the cost could change due to the number of pages which could be less than 750 or more.

In addition, after it is transcribed it isn't emailed it has to be picked up from the courthouse.

No one has requested the Hearing to be transcribed as yet. Eg Attorneys.

The way I understand it, with SODDI 2.0, they attack the investigation itself. With traditional SODDI, they need admissible evidence tying the alternate suspect to the crime.

Generic SODDI like generic odinism, KK, attack the investigation. I really hope they that they don't turn to the theory that were the families, the video is fake blabla.

I think if the confessions or some of them are allowed, RA will be found guilty.

Also we don't know what is found on RA's house but the defense is desesperate to tossed it out. It is possible it's because the bullet and the gun has some malfunction, so they can say with even more certainty the bullet is from that gun? Or is something more?

Ps- Interesting that MS said 1 person of the due process gang was there and someone sent sent them a video of what this person was saying about the hearings and it was mind-bowling how many errors and mistakes that person was saying lol. I don't know if it was BM or CP because both were there but I bet CP.

I don't think Judge Gull is going to allow any more delays in trial dates after this last May fiasco. The D will have plenty of time to readjust in she rules not to let ANY of the Odinist stuff in.

They might just go with angle Rick didn't do it and the State must prove he did BARD. They'll probably attack the confessions, his prison conditions, and the CAST info. IMO. Judge Gull may let a small part of Odinism in. IDK

Yes, leaving his personal, regularly used phone at home that day would make sense if you were going out to commit a gruesome double homicide. Taking a burner also makes sense if he even brought any phone at all.

What will put doubt in the weak theory that "hey look, RA's phone was at home the entire day on the 13th" will be RA's historical data usage over the years.

If he normally kept _x__ phone on him and used it daily to communicate with wife, mom, work, etc., why would it be conveniently left at home with no activity since we know he confessed to being at the scene of the crime? When do too many coincidences become too many?

Historical data usage for his known, personal cell will not be RA's friend. I'm not worried by the CAST info.

Good Question. IF he was telling the truth about being on his phone looking at his stocks, then his cell should tell the story of how long he was there in the park.

But if it doesn't show up there, then what? Was he LYING about watching the stock ticker? If so, WHY?
 
IMO Is it surprising a mental health report from an independent psychologist wasn’t ordered by the D. But then it might include a full background history.

“Prosecutors said Allen's shift toward bizarre behavior happened after a meeting with his lawyers. Dr. Monica Wala noted in past reports her concerns that Allen was faking his symptoms.”

I’m also curious what was going on in his life immediately prior to the Delphi murders. IMO the missing link is something that might’ve set him off him into a vicious, raging episode. Personal issues (ie threats from somebody, blackmail?), work issues (ie drug theft?), marital issues (ie infidelity?), alcohol or drug addiction, financial issues (ie bankruptcy?) to name a few are all situations everyday people get faced with from time to time. So what was going on in RA’s life early Feb, 2017? The silence is deafening.

I'm sure the D didn't want RA's week long stay in a mental health facility in 2019 to come out either. That was around the time Carter had the second sketch, change of direction, we'll be surprised, it's a local, have enough humanity left to admit it Pressor. I believe that was a tactic crafted at the direction of FBI Behavior Experts not just Carter.

Again, another coincidence?

ETA: I cannot state positively what date RA was in the mental health facility.

How do we know these sisters are telling the truth? Considering that Murphy, one of the author's of the report, came to the conclusion that EF was playing him and the other sister's word was unreliable, what's to say the other sister isn't also not telling the truth of things? Odds are high I'd say. Two out of the three were testified about (as far as we know) under oath by Murphy at the hearings. He, an investigator, had come to the conclusion there was no merit to the EF story. Should we not believe him? MO

If you do not audio or video record, you are running a huge risk of taking this person into a court room and having them on the stand and the lawyer asks them a question based on this written report and the person just says no, that’s not true. Then what?

You have no audio or video of them actually saying it, so you can’t prove it if they disagree, so none of that written report means anything because you can’t back it up. People write things down wrong all the time - Richard Whiteman. There’s a good reason why bodycameras/interview cameras/dash cams are standard now.

All true, but it is still physically and psychologically impossible to record and file away EVERY SINGLE discussion an officer has with a civilian potential witness. It is just not feasible. Cops walk Around all shift and talk to people endlessly, trying to figure out which ones need to be driven to the station to be interviewed on tape. Only a few will make that cut.

They cannot possibly interview everyone on video or audio that is filed away in perpetuity. Body cams will help if it is a large city. But otherwise, it's not going to be possible because time and resources are both lacking.

If they go back through their notes and realise one of the witnesses is going to be important they will do a follow up on tape. Otherwise, NoteBook it is.
 
There’s no actual video/audio evidence of his original story so I don’t know if it changed. I don’t take anyones word as fact.

If they had the cell data, it would say where he was all day long, or if he did something sketchy like left his phone at home for 9 hours straight untouched, that tells you something too.

Phone data has become pretty basic and expected evidence in these cases so I don’t get why it wouldn’t be introduced to bolster the states argument. Why rely on contradictory eyewitness accounts when they could just use phone data. It’s just so simple to me. It makes me suspicious.

Wait - IIRC - you stated last thread that the 1000 pg photocopy of discovery in prison was a fact. I didn’t think it was, and have not seen a link to verify. Point being - how do you verify facts?
